  • Rekonstruktion av företag inom insolvenslagstiftningens ramar : en jämförande studie av svensk och amerikansk insolvensrätt
  • 2001
  • Doktorsavhandling (övrigt vetenskapligt/konstnärligt)abstract
    • Insolvency law is the rooth of commercial and financial law because it obliges the legislator to chose. There is not enough money to go round so the law must chose who to pay. The law must always decide who is to bear the risk so there is always a winner and a loser. The insolvency law has been at the policy agenda in many countries in the last years. In France, Germany, Italy, Japan and other countries have the legal frameworks changed from liquidation procedures to reorganization business. The legal situation in Sweden has also changed from compositions to reorganization business, lagen om företagsrekonstruktion. The key issues are to encourage the formal proceeding by enlarging the debtors control of the business and by inroads creditors rights, in which case the proceeding is pro-debtor.This dissertation compares Swedish and American Bankruptcy Codes with respect to similarities and differences at macro- and micro perspectives. Chapter 11 Reorganization Business in America provides a corporate rehabilitation model, which has been used in other countries. The dissertation also compares the use of the concepts of - the purpose, - the function and - the direction of Swedish and American Bankruptcy Laws in order to establish whether the law is pro-debtor or pro-creditor. The key indicators of whether the rescue proceeding is pro-debtor or pro-creditor include; - How easy it is to enter the rescue proceeding. Debtor's incentives to commence proceeding, freeze on executions and liquidation petitions, impact on security, impact on title of finance, impact on set-off and netting, impact on contract rescissions and lease forfeitures. Disclaimer and abandonment, ability to replace the management, financing of the rescue, scope of the rehabilitation plan. It is argued that the optimal bankruptcy law can be achieved if the law purpose, the function and the law direction relate to each other in Sweden, in both reorganization business and in the liquidation code and it also compared with the American Bankruptcy Code. According to my opinion this is important both in a national and international context. The dissertation also deals with debtor's contract in an insolvency situation in reorganization business and in liquidation. Swedish Laws are compared to the American Bankruptcy Code and point out similarities and differences. In the American Bankruptcy Code there is a special section 365 § BC dealing with executory contract, this section is nearly the same for both the reorganization- and liquidationproceedings. The contracts must be unperformed which means the obligation of both the bankrupt and the other party in the contract are so far unperformed that the failure of either to complete performance would constitute a material breach excusing the performance of the other. If the contract is unperformed the debtor has the possibility to chose if the contracts shall be assumed, assumed and assigned or rejected. Section 365 § BC requires the court to consider whether assumption of the contract in question will further be needed in either rehabilitation or liquidation of the bankruptcy estate. The court reviews the financial impact of the estate and if it is benefiting becoming administratively obligated to perform. The court also review if is best to breach the contract. In Sweden we have different sections which regulate the situation. One section in our reorganization law, lagen om företagsrekonstruktion, we also have two special sections in the law of Sale of Goods, which deals with contract when a debtor became insolvent or file for reorganization business. But we don't have any section in our liquidation law, konkurslagstiftningen, which in my opinion is very strange. We also have a problem with the legislation about swaps and netting which are regulated in a special law, lagen om handel med finansiella intrument. Particular attention is given to the advantages and disadvantages of the existing rules in Swedish legal system compared with 365 § in American Bankruptcy Code. From a national point of view such section should preferably include all types of contract in only one section which is nearly the same as the American model of section 365 §.

  • Den kapitalistiska skådespelaren : Aktör eller leverantör?
  • 2014
  • Konstnärligt arbete (övrigt vetenskapligt/konstnärligt)abstract
    • The dissertation revolves around an actor’s craft as a changing craft. Theatre workers– like many other professions in Sweden – have experienced major changes in thelabour market during a relatively short period of time. In what way has capitalisticideology changed society over the last 25 years, and in what way has this affected theactor’s craft, and what impact has been experienced? What strategies can the field ofthe theatre, in general, and the actors, in particular, use to create space for the developmentof the craft of acting in a new era?The different parts of the dissertation attack the questions mentioned above from anumber of different angles. References from other disciplines such as philosophy, thehistory of ideas and sociology, which are placed in dialogue with the theatre in thisdissertation project, are all-important.In the first part of the dissertation, the author positions the research and himselfand also presents the methods used and the theories from other disciplines throughwhich he discusses the issues to be addressed. The next section discusses leadership and organisation through the 1990’s until today. The economic crises that affected Sweden during this time not only producedfairly extensive changes for publicly funded theatres but also brought about a changingbalance of power in theatres.Theatrical craft is discussed in the next section, where the main questions addressedare: In what way do changes in power relations affect the actor’s craft? What is theactor’s craft and who is really portraying the role? Actors in fact need what the authorwould like to call “informal power” in relation to their craft; however, this informalspace, the author argues, has been cut back. The fourth act in this dissertation consists of the text of a play, which adopts a freerand more associative approach to the issues discussed, and, as part of the discussion,is staged in a publicly funded theatre in connection with the actual public defence ofthe dissertation. The Epilogue carries and drives issues towards a changing future – if this futureexists.

  • Linjer : Linjer: Musikens rörelser – komposition i förändring
  • 2013
  • Konstnärligt arbete (övrigt vetenskapligt/konstnärligt)abstract
    • Title: Linjer. Musikens rörelser – komposition i förändringEnglish title: Lines: Music Moving – Composition ChangingAuthor: Kim Hedås Language: Swedish, with an English SummaryUniversity: The Academy of Music and Drama at the Faculty of Fine, Applied and Performing Arts, the University of Gothenburg, Box 100, SE-405 30 Gothenburg, SwedenKeywords: music, composition, relationship, connection, motion, movement, identity, time, memory, space, change, transformation, reflexivity, voice, meaning.ISBN: 978-91-979993-6-6 This dissertation takes the shape of a DVD, comprising the music in sixteen compositions, and a book, comprising the dissertation text. Lines: Music Moving – Composition Changing is a dissertation that focuses on relationships in music. The main question posed in this dissertation is: How does music relate to what is not music? Through an artistic inquiry, where a reflexive movement between the different parts produces the method used, the dissertation addresses the act of composing with particular focus on how music moves and how relations in music change. Results are also in motion, and traces – lines – move, change direction, and connect the music with what is not music. This inquiry embraces the following five themes: movement, identity, time, memory and space – which all relate to each other, and which, through composition, change, transform and reshape meaning as well as expression. The aim of this study is to demonstrate the changes that arise as a result of the relationships that are activated between music and what is not music, since an understanding of how these relationships work enables opportunities for the composition of new music.

  • Vems hand är det som gör? : En systertext om konst/hantverk, klass, feminism och om viljan att ta strid
  • 2019
  • Konstnärligt arbete (övrigt vetenskapligt/konstnärligt)abstract
    • Whose hand is making? And how can we understand craft practices in dialogue with society through making and objects? How do we understand objects that manifest resistance? This dissertation in artistic research explores craft practices within the fields of ceramics and textile, through the method and form of autoethnography, and on the basis of an intersectional perspective. It understands making as embodied experience and knowledge, conditioned, but not always bounded, by societal structures, and it documents the resistance against, and the resilience of, repressive structures, in dialogues and struggles where objects gain agency. It is an examination that moves between the bookishness of libraries and historical trajectories on the one hand and making as collective practice on the other, the latter represented in what this study defines as case studies of making. The study creates the term “together-making” to describe and analyse collective craft practice as simultaneously a method of research and of making as a potentially political and socially-conscious act.Through two case studies of making the study assembles an archive of willfulness. In the first case study of making, ceramic practice and historical objects emanating from feminist and anti-slavery movements, are explored through a process of together-making, putting together the exhibition From Pottery to Politics in 2016. In the actual exhibition, further ceramic objects from Swedish twentieth century come into play to re-direct the shape of the exhibition, exemplifying the ways in which this study understands objects as manifest, material politics inciting response. The second case study of making, takes off from the geographical area known as »de sju häraderna«: a centre for Swedish textile manufacture and home-based industry since the seventeenth century. Focusing on a group of local seamstresses who organized Sweden’s first women’s football series in the 1960s – Öxabäck IF – the study investigates textile objects in dialogue with society reflected through the textile history of labour and feminist political movements in the nineteenth and twentieth century. This case study also documents the process of research through together-making, and the exhibition Öxabäck IF – Without You no Tomorrow, 2016.

  • I främsta rummet : planerandet av en högskolebiblioteksbyggnad med studenters arbete i fokus
  • 2009
  • Doktorsavhandling (övrigt vetenskapligt/konstnärligt)abstract
    • The purpose of the thesis is to investigate planning processes for academic library buildings and the outcomes of such processes. This is accomplished through a case study utilising discourse analysis. The main question is: How is a vision of an academic library implemented in and through a building? The case study is retrospective and focused on the building of a new library at Kalmar University, Sweden, at the end of the 1990s. During this period, technological and educational developments and general societal change transformed the context of library planning and made way for renegotiations of the librarian profession. A critical realist approach characterises the study of visions, processes and the analysis of the various functions of the building. Results reveal the proactive nature of the activities of the library director in Kalmar. Early in the process he formulated a vision in which he presents the library as an information resource, a meeting place between different user groups and a workplace intended to promote learning and knowledge. From a professional point of view, the vision implied a dehierarchisation of relations both within the library staff and between library staff and visitors. The vision was based on an interpretation of Swedish national educational policy, and architecturally manifested by an ambition to reduce the physical and psychological boundaries between library staff and visitors. The early formulation of the vision together with the clients’ use of architectural expertise facilitated the choice of architects. However during the process a need arose to anchor the decision in the library field. Efforts were made to address library expertise and to collect user comments from a broader academic field. Discourses concerning the university library as a workplace and a meeting place were especially evident in the strategies of the leading agents. The discourses uncovered in the study correspond to more general discourses which became prominent in society and higher education during the period in question. The library itself has met growing appreciation by users both from within and outside the university. The proactive leadership demonstrated by the library director in Kalmar was based on hegemony rather than coercion. This corresponds to contemporary tendencies. Hegemonic consent may persist even after changes in leadership. In Kalmar however, architectural solutions with insufficient support from the library staff have been reconstructed after changes in leadership. Future research on architectural planning processes may pay further attention to different discursive resources, social fields and the positions within them.

  • Minnesrörelser
  • 2015
  • Konstnärligt arbete (övrigt vetenskapligt/konstnärligt)abstract
    • The starting point of the doctoral project Minnesrörelser (Movements of Memory) is a documentary material, based on interviews, archival documents, letters, diaries and more, from Germany and Sweden from the 1930's to present time, focusing on childhood, upbringing, eugenics, bilingualism. The family as a place for historical writing, family stories inevitably connected with political history, and how they can be passed on or kept secret makes up the main subject matter, where questions of memory and postmemory, heritage and transgenerational consequences of terror, war and guilt, as well as the role of silence, speaking and translation, are investigated. The way the project has developed and come to a preliminary end, that is, this dissertation, is in itself a story, an open end narrative, where the roles of the author and the reader are focused on. The well-known statement by Roland Barthes that "the birth of the reader must be at the cost of the death of the author" is used an impulse, along with Novalis' view on reading and writing as an ever continuing literary dissemination process.

  • Political Trust – More Personal Than We Thought? Explaining How and When Personality Traits Affect Political Trust.
  • 2023
  • Doktorsavhandling (övrigt vetenskapligt/konstnärligt)abstract
    • Political trust is crucial for a well-functioning society. Yet few countries enjoy the benefits of high political trust. This makes people wonder how trust in institutions is built. While trust in political institutions is considered to be an individual's evaluation of institutional performance, individuals within the same country make very different assessments. In this dissertation, I show that personality traits, that are genetic and socialized at an early age, can help explain why individuals' trust assessments differ. As personality traits reflect individuals' behavioral, cognitive, and emotional patterns, I argue that traits affect political trust in three ways, directly through our general tendencies, indirectly through how we process information and experiences, or how we interact with institutions. In three research papers, I study the relationship between personality traits and political trust in different political contexts, using different measurements of personality traits, political institutions, and institutional experiences. The results show that personality traits contribute to explaining why individuals' levels of trust in the same institutions differ. I conclude that personality traits are an important explanation for how political trust is formed and need to be considered when studying how trust changes over time.

  • Education for Democracy? : Life Orientation: Lessons on Leadeship Qualities and Voting in South African Comprehensive Schools
  • 2010
  • Doktorsavhandling (övrigt vetenskapligt/konstnärligt)abstract
    • This study takes as its starting point how teachers understand, interpret and teach social development aspects of Life Orientation in South African comprehensive schools. The specific focus is on lessons on leadership qualities and voting for third grade learners in four schools, each dominated by either Black, Coloured, White or mixed groups of learners. Field work with an ethnographic approach and a qualitative strategy was used to gain access to empirical data. Policy and curriculum documents, guidelines and textbooks were used. Classroom observations in four classes and interviews with 14 third grade teachers were conducted. Theoretical concepts of construction, deconstruction and reconstruction are applied. Ulf P Lundgren’s Frame Factor Theory is used to study school organization. Basil Bernstein’s Pedagogical Devices are considered when examining the different levels of pedagogical activities. To be a teacher in South Africa one needs to attend at least two years of teacher education after completing high school. Teachers in the classes studied underwent their teacher education during apartheid years. Due to limited in-service training, they sometimes experience problems of understanding and interpreting the learning area, which they usually tackle by consulting documents, colleagues or school authorities. The learners’ understanding varied based on their family background and type of school they attended. There were enormous differences in material, financial and organisational resources between classes and schools. The resources for teaching leadership qualities and voting were not, however, different between the classes. The lessons were teacher dominated and direct transmission was used as a method. The way teachers facilitated the lesson on leadership qualities and voting varied but all showed some democratic shortcomings. Apart from answering questions, learners were neither invited nor encouraged to participate to further their understanding of the theme. Limited aspects of leadership qualities were discussed, individual leaders’ roles were emphasised and the teachers picked candidates for class leaders in three of the classes. It was also evident that the class environments were not suitable for critical or creative thinking and democratic upbringing. The schools reproduced norms, values, languages and cultures of the different groups. Officially, teachers emphasised the common national South African identity. This emphasis on national identity could disguise the injustice some groups experience in society.

  • Prayer in Peasant Communities : Ideals and Practices of Prayer in the Late Medieval Ecclesiastical Province of Uppsala, Sweden
  • 2010
  • Doktorsavhandling (övrigt vetenskapligt/konstnärligt)abstract
    • The aim of this study has been to identify, explain and delineate praying among peasant communities in the ecclesiastical province of Uppsala, Sweden. Four aspects have been examined through the perspectives of ideals and practices, namely the standards of prayer, devotional prayer, prayer in times of need and prayer cultures. The standards of prayer considered the physical and mental behaviour of the praying peasant woman or man. The most ordinary way to act during prayer was to stand with hands together, palm against palm, and to pray in the vernacular often using mental themes to enhance the devotion. Devotional prayers were foremost the three ‘standard’ prayers Paternoster, Hail Mary and Apostolic Creed, and could be used separately or combined. Prayer in times of need was possibly considered a matter of praying to saints, something that cannot be proven to have been either practiced or recommended on other, ordinary occasions where God and the Virgin Mary were considered the proper recipients of prayer. A few authentic prayers exist that were possibly said by peasant women and men in connection with miracles and these show the ability to construct elaborate prayers and to propose businesslike agreements with saints. These three prayers were required knowledge for a peasant woman or man and were put to the test in order to become a godparent, and were therefore made available in the vernacular by the parish priests. Ways to maintain the prayer cultures were through mnemonic techniques, and indulgences stipulating and confirming prayers used or to be used in connection with certain churches, days and places within the churches. Name saints could also be used, since the person and the name saint were considered to have a special bond. Prayer could also be used as protection for the living; since a prayer was considered to generate either merits or favours from a celestial patron to his or her client. The prayer life of those belonging to peasant communities was both elaborate and full of nuances.
