    • Do children suffer from discriminatory structures in society and how can issues of social injustice against children be conceptualised and studied? The conceptual frame of childism is examined through everyday expressions in the aftermath of policies affecting children in Sweden, the UK and Ireland to develop knowledge of age-based and intersectional discrimination against children. While experiences in Sweden seem to indicate that young children rarely suffer severe symptoms from covid-19, or constitute a driving force in spreading the virus, policy decisions in the UK and Ireland to close down schools have had detrimental effects on children in terms of child hunger and violence against children. Policy decisions that have prioritised adults at the cost of children have unveiled a structural injustice against children, which is mirrored by individual examples of everyday societal prejudice.

    • It is a contested issue to what extent international conventions on human rights actually constrain states. While earlier shown that courts may invoke international conventions, this article investigates to what extent legislators, when it comes to migration, are similarly restrained. In a context where the trend is that states limit immigration and curb asylum seekers and undocumented immigrants' social rights, the answer would seem to be that states are obviously unhampered. However, in Sweden there have been changes to the Swedish Aliens Act and to the entitlement to health care which have rather safeguarded asylum seeking and undocumented children's situation. This article discusses the role that the United Nations Convention on the Rights of the Child (CRC) has played in this development and considers whether this has restrained Sweden's ability to act.

    • This article examines the teaching traditions of children's human rights in four levels of education in Swedish early childhood education and school by drawing on a three-year long didactic (Didaktik) research project on the teaching and learning of human rights. The purpose of the article is threefold. First, the aims, content and methods used in the teaching of the four levels are compiled. Second, the main characteristics of the observed teaching are analysed. Third, the question of why rights are taught is examined using Roberts' concept of curriculum emphases (1982). The article identifies the aims, content and methods used within each level of education and the main characteristics of the teaching of human rights and shows that the teaching of human rights often consists of the content themes interaction and the life conditions of others. When further analysed, the main conclusion is that the teaching tradition of human rights is strongly rooted in the fundamental and democratic values on which Swedish education is based (Education Act, 2010) - a democratic curriculum emphasis.

    • The aim of this paper is to develop educational theoretical concepts for analyses and descriptions of the teaching and learning traditions in children's human rights and to illustrate its diversity. The paper suggests viewing human rights as a subject field for research and education and using curriculum theory - particularly the concept of curriculum emphases - as a tool for the analyses. Drawing on the results of a previous international study (Brantefors and Quennerstedt, 2016), four teaching and learning traditions of rights are identified: (1) the participation emphasis; (2) the empowerment emphasis; (3) the awareness of rights emphasis; and (4) the right respecting emphasis. With the curriculum emphases concept it is possible to define the main motives for teaching and learning, and also to see what is emphasised in education. In the last section, the traditions are applied and tested on empirical examples. The conclusion is that the emphases concept is a fruitful analytical instrument that makes the different traditions of the teaching and learning of children's human rights visible.

    • The aim of the Speak up! study is to increase our knowledge of European children in vulnerable situations or with special needs, and their own views about their rights and what needs to be improved. The methodology was to play a children’s rights game and to hold in-depth discussions about children’s rights in focus groups with children in vulnerable situations and in control groups. The qualitative study of children took place in eight European countries. Children, particularly children in vulnerable situations or with special needs, are insufficiently aware of their rights. Children living in vulnerable situations have very little experience of being listened to. They face discrimination due to disability, ethnic background or social disadvantage, and also due to being under 18-years-old. This study concludes that children in vulnerable situations or with special needs should not be viewed as passive victims but as social actors with the right to be listened to.

    • This article highlights how migrant childrens’ rights to, and within, education can be negotiated at the national level. The aim is to underline and discuss the discourses that appear in selected Swedish legal and political documents relating to unaccompanied Afghan minors. Drawing on critical discourse analysis (cda), this research shows the co-existence of two different discourses on unaccompanied Afghan minors. The first discourse is based on the concept of unaccompanied Afghan minors as global rights holders and considers all children without exception as having the right to receive human assistance, education and appropriate protection against violence. The second discourse relates to the concept of unaccompanied Afghan minors as foreign citizens, which counteracts the work of Swedish authorities to deal with contradictions in policies assuring the rights of migrant children. This could also be a risk when the Convention on the Rights of the Child becomes Swedish law in 2020.

    • Child rights research has increased since the adoption of the Convention on the Rights of the Child (CRC) in 1989. Reviews of the research has indicated a lack of criticality and a reluctance to interrogate or challenge dominant views. Some scholars argue that this results from under theorisation, whereas other maintain that theorisation is abundant. The paradox suggesting that children's rights research can be both abundant and deficient in theory calls for a thorough discussion about theorisation. This systematic review engages in this debate by exploring what is positioned as "theory" in educational children's rights research, and what function theory has. Analysis determined that alignment with established theoretical approaches is uncommon. Previous research literature is instead often positioned as theory, mostly in combination with policy, law or an established theory. Main functions of theory are to construct the object of study and to provide analysis support. Some uses of theory appear to be more powerful than others.

  • Challenges in the Guardianship of Unaccompanied Minors Seeking Asylum

    • In this paper we explore the research literature relating to the guardianship of unaccompanied minors seeking asylum. In particular, we seek to find out what type of dilemmas have been identified by research concerning the guardianship of unaccompanied minors, and the focus that the literature has therefore taken. A comprehensive search of identified databases was conducted. Ultimately, 38 publications were selected for analysis. The review was qualitative and inductive. The results of the review suggest that research has identified and focused on challenges in the form of diverging policy such as gaps and inconsistencies in guardianship institutions, as well as challenges in balancing different objectives concerning the guardianship role, such as conflicting interest in the guardianship assignment or between different actors involved in protecting the child’s interest.The conclusion is that different configurations of guardianship institutions, as well as the identified challenges for practice, appear to be related to the welfare state model. Therefore, future research concerning guardianship for unaccompanied minors needs to move beyond legal sources and policy documents by focusing on empirically informed research on the relationship between child care/protection, principles of assessing the best interest of the child and the welfare state systems.

    • Incorporation is amongst the legislative measures of implementation of the UN Convention on the Rights of the Child (CRC) recommended by the Committee on the Rights of the Child. This article will discuss incorporation of the CRC in national law. It will show how incorporation is understood in different contexts, and highlight possible tensions between child rights and international law discourse and analysis. It begins by reviewing literature on incorporation of human rights treaties before discussing how incorporation is conceptualised in the context of the CRC. The focus then shifts to a review of studies that provide insights into how incorporation and legal integration of the CRC impact on how children's rights are treated in national legal systems. While primarily a commentary on the available literature, the authors reflect on the significance of incorporation and how this is understood for academic and legal analysis, and what the evidence tells us about its contribution to the realisation of children's rights.

    • Sweden was the first country in the world banning corporal punishment in 1979, protecting children’s physical and mental integrity. Forty years later, this fundamental view on children’s rights, respecting the child’s integrity, has not had any effect in Swedish health and medical care when children are patients. In this article, children’s rights when the child is a patient will be discussed in relation to the Swedish Patient Act (pa, 2014:81) and the advocacy role of Swedish patient organisations. It is shown that children’s rights in the Patient Act are constructed based on the child patient as deviant and subordinated to adult patients and parental rights, making not only the child’s voice subject to valuation by adults, but also the child’s integrity. Further, the patient organisations, acting as advocates for different patient groups in the legislative process, stay silent on issues concerning child patients’ basic human rights.
