    • Chapter 6 explores how the European Parliament (EP) has addressed the issue of entrepreneurship. In contrast to the European Commission or the Council of the European Union, the EP is a more heterogeneous institution constituted by different political parties, committees, politicians and bureaucrats. By analysing parliamentary debates, the author demonstrates how the EP has used its policy-influencing instruments to act as a political entrepreneur and to define entrepreneurship in a broader sense. The debates on the Small Business Act and The European Private Company (EPC) Statute show that the EP has extended the discussion on entrepreneurship by introducing legal and social aspects which have led to innovative approaches to promoting the common good. In addition, the EP has been able to influence the decision-making process and enhance the open method of coordination.

    • Chapter 5 focuses on the Council of Europe´s debates on the entrepreneurial action plans: the Small Business Act for Europe and the Entrepreneurship 2020 Action Plan. The chapter shows how the Council has acted as a political entrepreneur by adopting policies and policy measures that are favourable to entrepreneurs. As institutions determine the set of rules, they therefore have an important impact on entrepreneurship and entrepreneurial possibilities and can therefore be regarded as key to the foundation of entrepreneurship and self-employment. In responding to the 2008 crisis, the EU has tried to support innovative policies and measures for economic growth. The assumption that entrepreneurship is the basis for a growing economy has led the EU and national governments to promote entrepreneurship. The analysis shows that the Council has acted as a political entrepreneur by using the crises as a window of opportunity through which to place entrepreneurship on the political agenda.

    • Since 2008, Europe has been facing an economic crisis with considerable impacts on all EU member states. The enduring crisis situation has been an exogenous trigger for policy changes and has impacted different EU policy fields. Studies have examined the crisis effects on the European internal market by focusing predominantly on financial market regulations. One area has been neglected so far. The regulation of public procurement is one core driver for competitiveness and growth in the member states. Public procurement has become a ‘policy strategy instrument’ and is considered key for lifting the EU out of the crisis. It accounts for approximately 14% of EU GDP involving a population of over 250.000 contracting public authorities. In 2014, new EU rules were adopted to reshape the European public procurement procedures. The public procurement regime reflects two opposite dynamics: the strengthening of the internal market by harmonization and the orientation on national priorities. By analyzing the impacts of the economic crisis on the EU policy on public procurement through historical institutionalist lens, this study demonstrates how the economic crisis shaped the regime on public procurement and how the EU managed to enhance harmonization and European integration despite an increasing national protectionism.Share this page

    • While previous research on the impact of the economic crisis on EU policy has primarily focused on the internal market and financial market regulations, the effect on public procurement has so far been neglected. This lack of attention is surprising. Public procurement accounts for approximately 14% of the EU GDP and involves over 250.000 contracting public authorities.Therefore, procurement is considered essential for lifting the EU out of the crisis by promoting competitiveness and growth. Nevertheless, public procurement reflects contradictory developments. Whereas the European Commission strives for greater harmonisation, member states often focus on national priorities. By comparing the old and new procurement regimes through the lenses of historic institutionalism, this article demonstrates that the EU managed to enhance harmonisation despite tendencies of increased national protectionism. The article finds that procurement became a much more prominent policy instrument for greater market integration subsequent to the economic crisis.

    • Public procurement is a policy area located between two contradictory tendencies. On the one hand, the European Commission strives for greater competition to widen procurement markets. On the other hand, the boosting of competition encounters resistance among the member states. This article investigates how these colliding tendencies played out during the initial stages of the Covid-19 crisis and, more specifically, how changes in the field of procurement affected legitimate governance in the EU. Based on institutionalist and EU governance theories, the study contributes to the literature with three principal findings. First, it demonstrates that the pandemic enabled exogenously driven changes in the field of public procurement with new policies and guidelines, while the EU’s overall aims in this field were upheld. Second, the study demonstrates that the Commission was the main driver of change and that it enhanced the harmonisation of procurement rules and supranational integration despite the crisis. Third, while these changes strengthened the role of supranational actors, the study demonstrates that the changes introduced allow member states increased flexibility when it comes to the implementation. In practice, however, this flexibility has the potential to undermine the EU’s initial aims, thereby jeopardising the EU’s legitimacy.
