    • In this article, we attempt to extend and nuance the debate on intellectual property (IP) strategy, appropriation, and open innovation in dynamic and systemic innovation contexts. We present the case of four generations of mobile telecommunications systems (covering the period 1980-2015), and describe and analyze the co-evolution of strategic IP management and innovation ecosystems. Throughout this development, technologies and technological relationships were governed with different and shifting degrees of formality. Simultaneously, firms differentiated technology accessibility across actors and technologies to benefit from openness and appropriation of innovation. Our analysis shows that the discussion of competitiveness and appropriability needs to be expanded from the focal appropriability regime and complementary assets to the larger context of the innovation ecosystem and its cooperative and competitive actor relations, with dispersed complementary and substitute assets and technologies. Consequently, the shaping of complementary and substitute appropriability regimes is central when strategizing in dynamic and systemic innovation contexts. This holds important implications for the management of open innovation, innovation ecosystems, platforms, and coopetition.

    • The role of patents for capturing (appropriating) value from innovation investments has since long been of major interest to both practitioners and academics. Previous studies have implicitly assumed that firms appropriate value through in-house creation and marketing of innovative products and services. We question this assumption in light of the variety of business models and strategies now being available, including open innovation. We develop a basic typology of appropriation strategies, and investigate the role patents play for different strategies among 172 Swedish technology based firms. The results show that the importance of patents has a skew distribution with many firms rating patents as very important and with a fat tail of firms rating patents less important. This partly explains the limited importance of patents that previous studies have communicated. The results also show that the protection of sales and sales margins of innovative products and services is only one function of patents, and that patents are also important for the sales of technologies and stocks. Thus, patenting widens the range of appropriation strategies as well as financing strategies available to R&D management, which is especially important for cash strung technology based start-ups and SMEs, as well as for large firms with long R&D times.

  • The management and commercialisation of intellectual property in European universities

    • This report presents the results of an empirical study that explores intellectual property (IP) management practices among universities in the European Union. The report presents models and processes of IP management and research commercialisation – and their interdependencies. Furthermore, the report identifies four main challenges for IP management, including lack of funding for proof-of-concept work, resource constraints, a broad range of technologies and industries with which technology transfer offices (TTOs) need to work, and a non-existent local industry combined with legitimacy problems when trying to partner internationally. All in all, these challenges typically make IP management in the university setting more difficult than in the private industry setting. The dominant and linear IP management process that focuses primarily on value capture – the appropriation model – is criticised, and interviewees see a need to shift focus to better interact with industry and focus more on value creation and utilisation rather than only on appropriation.

    • PurposeExtant research and practice of patent management are often occupied with how to best utilize patenting as a source of competitive advantage. This paper instead suggests a patent management trichotomy where firms make strategic decisions between patenting, publishing, and secrecy. ApproachThe paper is conceptual in nature and draws on received IP-management literature to develop an analytical framework.FindingsWe suggest that the choice between patenting, publishing, and secrecy can be understood in terms of differences in the degree to which the firm can appropriate value from the invention and the degree to which it can operate freely. Originality/valueThrough an analysis along the dimensions of direct and indirect appropriation as well as static and dynamic freedom to operate, the article conceptualizes the choice between patenting, publishing, and secrecy in a way useful for management decisions as well as for academics.

    • We explain the Sulphur Emission Control Area (SECA) compliance through analyzing both rational and moral factors for compliance motivation. According to preliminary analysis based on samples and measurements, the compliance rate for SECA is rather good and air quality has improved significantly. As costs of compliance are rather high and penalties for non-compliance rather low for regulation targets, moral motivation factors must be relevant for compliance. Maintaining good relationships with control authorities and peers requires shipowners to comply with the rules for practical and moral legitimacy. Our interviews with Danish, Finnish and Estonian shipowners confirmed that most of them follow the law simply because it is the law, this applying both to current Baltic Sea SECA rules and the future global sulphur emission rules. Obeying environmental law thus has a taken-for-granted status among shipping companies. Almost half of the companies specifically mentioned they follow the SECA rules because they want to take care of the environment, thus having internalized the regulatory content. Some companies see global compliance to depend on efficient controls.

This tension sets the stage to discuss two research areas which call for further attention: lack of legitimacy of EU law and use of soft power to promote EU integration. Investigating these areas may contribute to identify institutional barriers to better decision making for radio spectrum use.
