  • The Water Framework Directive and Spatial Planning in Sweden - Time for Legal Integration!

    • Spatial planning activities plays a crucial role in the implementation of the EU Water Framework Directive (2000/60/EC) (‘WFD’) and the achievement of its environmental objectives. In Sweden, spatial planning is regulated foremost through the Planning and Building Act (2010:900) (‘PBA’). In this article, the lack of external integration of the integrated planning and adaptive water management system of the WFD into Swedish spatial planning law is addressed, and necessary legislative changes are discussed. The obligations for the municipalities in this regard are analysed in the light of our general legal obligations under EU law, particularly as interpreted by the Court of Justice of the European Union (‘CJEU’). In Weser, the WFD’s environmental objectives, including the obligation to prevent deterioration, were declared as legally binding in each stage of implementation. This entails that in each decision-making situation, including spatial planning decisions or local building permits that might have adverse impact on the aquatic environment, the WFD environmental objectives must be complied with. However, the result reveals a clear lack of legal integration between the freshwater governance system and the legal framework for spatial planning in Sweden. As a consequence, water quality aspects are at great risk of being ignored in planning activities at the local or regional level, making the WFD’s environmental objectives significantly more difficult to achieve under the current legal framework.

    • Nuclear and other industrial activities create rare likelihoods for very large catastrophes. Available insurance, intra-industry pooling of risk and the net worth of those who cause the risk, provide an inadequate coverage for compensation of third-party damage. In OECD countries, the top layer of damage compensation after such catastrophes is regularly transferred, explicitly or implicitly, to governments. This constitutes a subsidy of the risk-creating industries. For a variety of reasons, traditional insurers are unwilling to assume full liability for the potentially colossal damage of industrial catastrophes. Such risks could be offloaded to the immensely larger capital market through the issue of catastrophe bonds. This would obviate the need for public subsidy, and provide a means for market pricing of the risks, but considerable needs for public intervention would nevertheless remain.

    • An increased understanding of the existing markets for recycled (secondary) metals, including interactions with virgin material production, is essential for public decision-making processes concerning the implementation and evaluation of different categories of recycling policies. In this paper, we review the existing literature with the purpose of discussing (1) the impacts of various recycling policies on metal markets in which aggregate demand can be met by both primary and secondary production, and (2) a number of challenges that policy-makers need to confront in choosing between various types of recycling policies and policy designs. A simple partial equilibrium model is used as a pedagogical tool for shedding light on the impacts of tradable recycling credits, virgin material taxes, and recycling subsidies. In a second step, the paper identifies and discusses a few key challenges that policy-makers will need to address in recycling policy-making. These challenges include improving the functioning of secondary material markets by addressing various non-environmental market inefficiencies; identifying and designing (second-best) policy mixes due to the presence of incomplete monitoring and enforcement of waste disposal behavior, and regulating environmental impacts through price- or quantity-based policies. Throughout the analysis, we consult the empirical literature on the functioning of scrap metal markets (e.g., steel, copper, and aluminum).
