    • The legal responsibility of the employer and employee for the work environ­ment is designed for a working life where the work is mainly carried out on the employer’s premises and under his control. As work from home, which has in­creased significantly during the coronavirus pandemic, can be expected to persist in the future, the legal responsibility for the work environment that applies to the employer and the employee is highlighted. The purpose of this article is to analyze the legal responsibility for the working environment in working from home and teleworking and to outline the problems that regulation may cause.

    • This article examines rule of law (ROL) and security sector reform (SSR) linkages in crisis management. In particular, the article looks into why international assistance providers chose to categorize a situation and ensuing response strategy as rule of law or SSR, how this categorization is motivated and explained to international and national partners and stakeholders, and how this categorization affects national laws, institutions and other arrangements in post-conflict and crisis societies. The article is borne out of an observation, based on events in the Arab Spring, that the character of international community responses to rule of law threats and challenges has as a strong focus on security. Rule of law promotion taking place in UN and EU missions has undergone a ‘securitization’ in how reforms are conceived and put into practice, compared with rule of law in development aid and past experiences of rule of law assistance in post-communist transitions.

    • Previous studies show a lack of deference and activities when it comes to women's human rights and gender equality in the multi-level governance of the Arctic. According to the Committee on the Elimination of Discrimination against Women, women in the Arctic are vulnerable, in particular indigenous and rural women. Their rights are not upheld in the Arctic states for example when it comes to exposure to violence, equal participation in governing bodies, and economic self-support. The public governing bodies have almost no focus on gender equality at all, despite far-reaching international obligations and, for several of the states, national ambitious agendas for gender equality politics. International instruments with obligations to strive for gender equality, such as the CEDAW, the ILO Convention 169 and UNDRIP, are scarcely referred to and not sufficiently implemented by the public governance bodies. The aim of this article is to raise awareness of the obligations set up by human rights documents to promote women' rights in the governance of the Arctic, in order to put pressure on the states to develop strategies for a future gender equal governance. We have a special focus on the general lack of awareness within public governance, and on men's intimate partner violence against indigenous women.

    • This book examines, through a multi-disciplinary lens, the possibilities offered by relationships and family forms that challenge the nuclear family ideal, and some of the arguments that recommend or disqualify these as legitimate units in our societies. That children should be conceived naturally, born to and raised by their two young, heterosexual, married to each other, genetic parents; that this relationship between parents is also the ideal relationship between romantic or sexual partners; and that romance and sexual intimacy ought to be at the core of our closest personal relationships - all these elements converge towards the ideal of the nuclear family. The authors consider a range of relationship and family structures that depart from this ideal: polyamory and polygamy, single and polyparenting, parenting by gay and lesbian couples, as well as families created through current and prospective modes of assisted human reproduction such as surrogate motherhood, donor insemination, and reproductive cloning.

  • Expanding the Protection of Children's Rights towards a Dignified Life: : The Emerging Jurisprudential Developments in the Americas

    • The Inter-American Court of Human Rights (IACrtHR) has developed in recent years an innovative jurisprudence that has integrated the entity and extension of States’ obligations regarding children’s rights—as established in Article 19 ACHR—through the evolutive, dynamic, and effective interpretation of the American Convention on Human Rights (ACHR). In fact, by acknowledging the existence of an international corpus juris for the protection of children’s rights, the Court has examined this provision in the light of instruments enshrined within the corpus juris, such as the UN Convention of the Rights of the Child. This process of normative integration was not only limited to the application of international instruments adopted outside of the Inter-American system, but also includes internal references to interconnected rights recognised within the American Convention. Consequently, by analysing the scope of Article 19 ACHR in the light of Article 4 ACHR (right to life) and the corpus juris for the protection of children, the Inter-American Court has further expanded the protection of children’s rights towards the protection of the right to a dignified life. While focusing on the landmark jurisprudence developed by IACrtHR, this paper seeks to unveil the hermeneutical paths undertaken by the regional tribunal in connection with the systemic integration of Article 19 ACHR. In particular, it focuses on the emerging jurisprudential development of positive obligations upon States Members regarding the effective protection of children’s right to a dignified existence.

    • GLOBALISATION AND INTERNATIONALISATION have had significant consequences for the regulation of labour markets in recent decades. This volume addresses some of the questions raised by the necessary rethinking of labour law-related issues. Labour and employment law have become increasingly interdependent at all levels, while simultaneously an increasing fragmentation of legal sources has occurred. This collection of essays provides different perspectives on aspects of these processes, in international or European perspectives, in the light of fundamental human rights or with a view to Swedish labour and employment law. The volume ends by looking into the future through the lens of the fragmentation of labour and employment law.
