- Agricultural biotechnology, in particular genetically modified organisms (GMOs), is subject to regulation in many areas of the world, not least in the European Union (EU). A number of authors have argued that those regulatory processes are unfair, costly, and slow and that regulation therefore should move in the direction of increased ‘technology neutrality’. The issue is becoming more pressing, especially since new biotechnologies such as CRISPR increasingly blur the regulatory distinction between GMOs and non-GMOs. This paper offers a definition of technology neutrality, uses the EU GMO regulation as a starting point for exploring technology neutrality, and presents distinctions between variants of the call for technology neutral GMO regulation in the EU.

- In this introduction to the special symposium on the philosophy of hate crime, we provide an overview of the main philosophical aspects of hate crime and hate crime legislation. We point out that there are two overarching philosophical issues that span over the literature: the Conceptual Question—concerning what hate crime is—and the Normative Question—concerning the status of hate crimes and the justification of hate crime legislation. We also provide brief summaries of the articles in the special section and point to their relations to the broader themes.

- This paper analyses ethical issues in forensic psychiatric research on mentally disordered offenders, especially those detained in the psychiatric treatment system. The idea of a 'dual role' dilemma afflicting forensic psychiatry is more complicated than acknowledged. Our suggestion acknowledges the good of criminal law and crime prevention as a part that should be balanced against familiar research ethical considerations. Research aiming at improvements of criminal justice and treatment is a societal priority, and the total benefit of studies has to be balanced against the risks for research subjects inferred by almost all systematic studies. Direct substantial risks must be balanced by health benefits, and normal informed consent requirements apply. When direct risks are slight, as in register-based epidemiology, lack of consent may be counter-balanced by special measures to protect integrity and the general benefit of better understanding of susceptibility, treatment and prevention. Special requirements on consent procedures in the forensic psychiatric context are suggested, and the issue of the relation between decision competence and legal accountability is found to be in need of further study. The major ethical hazard in forensic psychiatric research connects to the role of researchers as assessors and consultants in a society entertaining strong prejudices against mentally disordered offenders.

Men uppskruvat tonläge, fokus på avsändaren och ensidig analys står ofta i vägen för konstruktiva slutsatser. Därför vill jag lyfta fem kärnfrågor som den utlovade ”Coronakommissionen” behöver behandla, skriver Christian Munthe, professor i praktisk filosofi vid Göteborgs universitet.

- Den svenska debatten om (frivillig, medicinsk) dödshjälp har länge stampat på samma fläck. Med jämna mellanrum görs olika utspel av opinionsbildare och aktivister för att legalisera dödshjälp, men ingenting väsentligt sker, till högljudda klagomål från de som vill se en förändring. Förklaringen är, som jag ser det, att utspelen som regel är orealistiska, utan hänsyn till de faktorer som avgör realpolitiken i frågan. Därför tänkte jag bistå med vad jag ser som en verkningsfull väg att faktiskt komma till en punkt där människor som genuint vill och har behov av det kan få medicinskt professionell hjälp att avsluta sina liv. Men som kommer framgå är det samtidigt en väg som mycket väl kan leda den som idag ser positivt på legal medicinsk dödshjälp kommer fram till att detta till syvende och sist är en dålig idé.

The Legal Ethical Backbone of Conscientious Refusal

- This article analyzes the idea of a legal right to conscientious refusal for healthcare professionals from a basic legal ethical standpoint, using refusal to perform tasks related to legal abortion (in cases of voluntary employment) as a case in point. The idea of a legal right to conscientious refusal is distinguished from ideas regarding moral rights or reasons related to conscientious refusal, and none of the latter are found to support the notion of a legal right. Reasons for allowing some sort of room for conscientious refusal for healthcare professionals based on the importance of cultural identity and the fostering of a critical atmosphere might provide some support, if no countervailing factors apply. One such factor is that a legal right to healthcare professionals’ conscientious refusal must comply with basic legal ethical tenets regarding the rule of law and equal treatment, and this requirement is found to create serious problems for those wishing to defend the idea under consideration. We conclude that the notion of a legal right to conscientious refusal for any profession is either fundamentally incompatible with elementary legal ethical requirements, or implausible because it undermines the functioning of a related professional sector (healthcare) or even of society as a whole.
