    • Intensifying global trade will result in increased numbers of plant pest and pathogen species inadvertently being transported along with cargo. This paper examines current mechanisms for prevention and management of potential introductions of forest insect pests and pathogens in the European Union (EU). Current European legislation has not been found sufficient in preventing invasion, establishment and spread of pest and pathogen species within the EU. Costs associated with future invasions are difficult to estimate but past invasions have led to negative economic impacts in the invaded country. The challenge is combining free trade and free movement of products (within the EU) with protection against invasive pests and pathogens. Public awareness may mobilise the public for prevention and detection of potential invasions and, simultaneously, increase support for eradication and control measures. We recommend focus on commodities in addition to pathways, an approach within the EU using a centralised response unit and, critically, to engage the general public in the battle against establishment and spread of these harmful pests and pathogens.

    • Rapporten behandlar rättsliga förutsättningar för intensivodling av skog: ett skogsbruk med produktionshöjande åtgärder som kan överskrida de begränsningar som återfinns i den nu gällande skogsvårdslagen och dess tillämpningsföreskrifter eller annan relevant lagstiftning.Rapportens första del visar den rättsliga kontexten i samband med intensivodling av skog, internationellt, inom EU och i Sverige. Andra delen behandlar författningsändringar. Det är idag rättsligt oklart om vissa intensivodlingar ska ses som jordbruk eller skogsbruk. I rapporten lämnas alternativa förslag till precisering. Intensivodling kan underlättas genom vissa ändringar i skogsvårdslagstiftningen: att i högre grad tillåta odling med vissa utländska trädslag, att den nu gällande arealrestriktionen upphävs för användning av vegetativt förökat skogsodlingsmaterial och att tillåta mer kvävegödsling än idag. Förutsättningar i samtliga fall är att (i) åtgärden sker på skogsmarker som visats sakna beaktansvärd betydelse med hänsyn till motstående intressen, (ii) åtgärden tillståndsprövas av Skogsstyrelsen och då ses som ändrad markanvändning, samt (iii) Skogsstyrelsen har sådant beslutsunderlag att den kan bedöma markens värde.Om det inte anses meningsfullt med naturvårdshänsyn vid intensivodling kan nu gällande krav enligt 30 § skogsvårdslagen undantas för de aktuella åtgärderna (utom i kantzoner). Lindringen kan kombineras med kompensationskrav på skogsbrukaren, mer konkret genom ett fondsystem med hänsynsavgift.

    • Two systems working in parallel have contributed to implementation difficulties in Swedish water governance. While the old system is designed to be predictable and stable over time, the new system is intended to be transparent and holistic, guided by the principles of Integrated Water Resource Management. The paper disentangles the challenges in Swedish water governance and proposes a blueprint for future research. The proposed research project is unique in the sense that it explores the imbalances between the new and the old water governance systems from a multi-disciplinary perspective, elaborating upon the clashes between the traditional, nationally based regulatory system and the new holistic water governance system from legal, political and economic perspectives.

    • The paper analyzes the prerequisites for a regulatory-driven transition toward radically lower air and water pollution in industry. This is achieved in the empirical context of the Swedish mining and metals industry, and by investigating the environmental licensing processes during two regulatory systems. The paper derives an analytical framework that explores under what circumstances such licensing processes can result in radical emissions reductions without seriously jeopardizing the competitiveness of the industry. Archived material covering six environmental licensing processes, three during each system, is used to illustrate the various design and implementation issues. The results suggest that regulatory-driven green transitions benefit from trust-based bargaining procedures in which companies are involved in repeated interactions with regulatory authorities, and which extended probation periods permit tests of novel abatement technologies (including innovation). The findings also illustrate the importance of abstaining from simplified normative notions about policy instrument choice (e.g. taxes versus standards).

  • Law in Integrated and Adaptive Governance of Freshwaters : A Study of the Swedish Implementation of the EU Water Framework Directive

    • Water is essential for sustaining life and providing ecosystem services for different human needs. In 2000, the European Union Water Framework Directive (WFD) was adopted against the background of increasing pressure on the waters of Europe. With the WFD, a new approach to governing freshwater resources within the Union was introduced, aimed at facilitating a shift from fragmented and sectoral water policies to a more holistic, integrated and adaptive governance system at the hydrological scale of river basins. This thesis has examined the Swedish implementation of the directive, with a primary aim to determine whether the Swedish formal institutional framework and water administration are sufficient to fully implement the freshwater governance model provided by the WFD and achieve the environmental results prescribed. The thesis consists of two main parts, where the first provides the contextual framework for the thesis, and the second part consists of four appended papers, which all in different ways contribute to achieving the overall purpose of the thesis. The thesis is founded on legal analysis and qualitative text interpretation of various sources of law, with emphasis on the analysis of national law in light of the WFD as well as EU legal principles and case law developed by the CJEU.The results show that the Swedish freshwater governance system and formal institutional framework encompasses opportunities as well as barriers for implementing the WFD. The governance arrangements reflect the hydrological requirement of the directive, and the Swedish system holds good opportunities for participation in decision-making procedures as well as adaptive potential, as the general legal framework for environmental and water law contains a relatively high degree of flexibility or adaptable rules.However, when analysing the Swedish freshwater governance system in light of four key functions (objectives and direction; administrative structure; adaptive capacity; and control and enforcement) identified in this study as crucial for the formal institutional framework to deliver in such integrated, adaptive and multi-level governance systems the WFD represents, the results reveal that central aspects of all four key functions are missing in the Swedish system. Due to these shortcomings, the overall conclusion is that no full regime shift towards the hydrological, adaptive and integrated system of the WFD has occurred in Sweden; the system for water planning and governance is not clearly reflected in the formal institutional framework nor sufficiently underpinned by the administrative structure at national level. Ten different proposals are presented to remedy the shortcomings.
