    • Constitutional reasoning has been a flourishing field of research in comparative constitutional law in the past decade. This essay reviews two books that have made a significant contribution to the field. The success of these books is also shown by the fact that both were reprinted in paperback last year. The first book, as the author András Jakab declares, “provides a theory for constitutional lawyers about fundamental questions of European constitutional law” (at 1). At the same time, it serves as a conceptual foundation for the second book, which is an edited collection on comparative constitutional reasoning, and the final product of a five-year research project, involving twenty-five scholars from four continents who authored the various contributions, each examining one court’s style of constitutional reasoning. András Jakab is among the leaders of this research project (together with Arthur Dyevre and Giulio Itzcovich) and the editors of the second book. The essay will present the two books in this order.

  • The turn to history in international law and the sources doctrine : Critical approaches and methodological imaginaries

    • Expanding now familiar debates about the impact of the 'historical turn' upon the field of international law, this article considers some of the different ways in which 'turn to history' scholars have confronted the methodological and theoretical tensions arising from the central, yet paradoxical, role occupied by the sources doctrine in international law. We suggest that the anxiety over the sources of international law as the basic methodological precepts of the discipline has been a catalyzing element for a radical reengagement with the canon of international law, one with a significant impact on the field's existing parameters and doctrinal limits. Within the three streams of scholarship we explore here, history has become a site of creative engagement for scholars in opening up the discipline to diverse ends, one in which a new doctrinal universe can be created, and new issues, sources, subjects, and approaches can be explored. Yet, by opening up international law's sources doctrine, reactionary causes and unjust ends may equally well be the result. This account is an attempt at diversifying the narrative surrounding the causal relationship between history and the ongoing changes to the field of international law, along with the differential practices, techniques and epistemological foundations behind the history of international law as an evolving discipline, and of the different scholarly motivations of its specialists.

    • I artikeln "Samebyars avtalsrätt" gör Eivind Torp bedömningen att den nuvarande rennäringslagen inte ger utrymme för att behandla renskötselrätten eller delar av rätten som ett civilrättsligt avtalsobjekt. Därför menar Torp att samebyarna saknar rättslig befogenhet att ingå avtal som innebär inskränkningar av renskötselrätten. Vi menar att Torp i sin analys av rättsläget bortser från den rättsutveckling som skett i tiden efter 1971 när den nuvarande rennäringslagen infördes. Dessutom är frågan om samebyarnas avtalsrätt mer komplex än vad den aktuella artikeln visar.

  • Israeli Digital Oppression and Cyber Surveillance in Palestine

    • Early in his writings, Elia Zureik connected Israeli surveillance of Palestinians as an extended conduct of settler colonialism and neoliberal apartheid, arguing that Israel’s Colonial Project in Palestine shows how central surveillance is to the maintenance of that project. More precisely, in his article in 2020: Settler Colonialism, Neoliberalism and Cyber Surveillance: The Case of Israel, he pointed out that the use of new technologies, especially the use of algorithmic predictions and biometrics, including facial recognition, has transformed Israel to a high-tech surveillance state, spreading fear among and tightening its control over the occupied Palestinian people.Departing from the notion of “cyber surveillance” in relation to control and settler colonialism, and building on Elia’s work, I will address three main points in turn. First: The status of Palestinians under Israeli cyber surveillance and digital oppression. Second: The use of AI-enhanced facial recognition systems to track Palestinians, systematizing massive surveillance and automating harsh restrictions to their rights and freedoms as part of a structural settler colonial oppression. Third: The role of social media platforms in facilitating cyber surveillance and digital oppression. I will conclude with a brief examination of the legality of the deployment of these technologies under international law of occupation.

    • Artikeln belyser hur personliga assistenter upplever sin arbetsmiljö och vilka möjligheter de anser sig ha, att påverka sina arbetsförhållanden utifrån ett rättssociologiskt perspektiv. Författaren länkar personliga assistenters arbetslivserfarenheter med några av de juridiska förutsättningarna, som gäller vid arbete i annans hem. Syftet är att utveckla förståelsen för vadsom händer vid dessa möten, då människor och juridik korsar varandra på ett arbetsrättsligt område, som i det närmsta verkar befinna sig i ett slags arbetsrättsligt ingenmansland. I artikeln diskuteras bland annat hur brukares och assistenters intressen kan tillgodoses, utan att den enas rättigheter inte kränker den andres?

    • Ocean temperatures are rising; species are shifting poleward, and pH is falling (ocean acidification, OA). We summarise current understanding of OA in the brackish Baltic-Skagerrak System, focussing on the direct, indirect and interactive effects of OA with other anthropogenic drivers on marine biogeochemistry, organisms and ecosystems. Substantial recent advances reveal a pattern of stronger responses (positive or negative) of species than ecosystems, more positive responses at lower trophic levels and strong indirect interactions in food-webs. Common emergent themes were as follows: OA drives planktonic systems toward the microbial loop, reducing energy transfer to zooplankton and fish; and nutrient/food availability ameliorates negative impacts of OA. We identify several key areas for further research, notably the need for OA-relevant biogeochemical and ecosystem models, and understanding the ecological and evolutionary capacity of Baltic-Skagerrak ecosystems to respond to OA and other anthropogenic drivers.

  • Police Conflict Management : A Scoping Review

    • Police officers frequently interact with the public, and many of these interactions involve some form of conflict. As professionals, and representatives of the state, police officers are expected to handle these conflicts in a professional and just manner to maintain positive relationships with the public. Therefore, solid conflict management skills are necessary for any officer in a democratic society. The present scoping review examines the current state of research on police involved conflicts and conflict management in a police context. Results indicate that a majority of the studies have been conducted in the USA and that many of these studies focus on use of force rather than effective conflict management strategies and methods. The study further indicates a number of methodological difficulties in researching this important area of policing, including difficulties in obtaining data as well as a lack of unified definitions of concepts and methods.
