  • The Role of National Legislation in Bioenergy Governance

    • Bioenergy supply chains pass several layers of governance, including both emerging governance mechanisms that specifically address bioenergy and existing regulations, such as environmental codes affecting forestry and agriculture. The sustainability requirements associated with the EU Renewable Energy Directive (EU-RED) is an example of how norms and sustainability priorities in one region can be expressed so as to influence activities in other regions, when actors in these other regions aim to produce for the EU market. Achieving aspirations for developing sustainable bioenergy production systems and supply and value chains requires coordination among actors and parties to ensure that all necessary governance mechanisms are in place and capable of fulfilling the appropriate standards setting, control, governance and assurance roles that are required, collectively. In this paper, the capacity of public governance to promote bioenergy production for the EU-RED market was assessed for thirteen countries in Africa, Asia, and Latin America. Environmental legislation was assessed on how it covers the sustainability requirements included in EU-RED, as well as general sustainability aspects. The countries’ capacities to enforce legislation were assessed by combining globally applicable indexes. While some aspects (e.g., nature protection) were found to be mostly covered well in legislation, other (e.g., wetland protection, GHG emissions) where covered less well. Results indicate that enforcement of legislation can be a challenge in many countries.

  • On Sustainability of Biomass for Energy and the Governance Thereof

    • Due to concerns about climate change, energy security, and resource scarcity, non- renewable resources are increasingly being displaced by biomass. As with most human activities, the production of biobased products can be associated with negative impacts. Primarily, this relates to the biomass supply systems, i.e., agriculture and forestry, which currently are major causes of biodiversity loss and degradation of ecosystem services. Developing sustainable production systems when transitioning from non-renewable resources to biomass is imperative. This thesis aims to clarify the meaning of sustainability in the context of biomass for bioenergy, and contribute to our understanding of how different forms of governance can promote sustainably sourced biomass for bioenergy. The thesis is based on five appended papers: Paper I analyses to what extent, where, and under what conditions oil palm for biodiesel in Brazil can be produced profitably, and what risks and opportunities that can be associated with introducing large-scale oil palm production in Brazil. Paper II lays the foundation for understanding how new biomass production can be introduced into landscapes while supporting rather than compromising the ability of the landscape to supply other ecosystem services. Paper III describes different forms of governance and shows how these can play different roles in promoting sustainable bioenergy in different countries. Paper IV focuses on how short rotation coppice production systems are affected by EU policy and how different governance forms can assist in adapting production systems to conform to the corresponding sustainability requirements. Finally, Paper V assesses how sustainability certification (private governance) addresses biodiversity conservation and contributes to our understanding of possible improvements.

  • The social contingency of law : Studies of social control during foreclosure in Sweden

    • Summary: This thesis empirically investigates how law and other social control responses during foreclosure in Sweden are contingent upon differences in social status. The thesis draws upon American sociologist Donald Black’s theoretical framework on social control to explain this social contingency. According to Black, variations in social control responses are explained and predicted by variations in the social structure pertaining to, for example, differences in wealth and relational distance between the stakeholders.The thesis consists of an introductory framework and four papers. Paper 1 employs register micro data from the Swedish Enforcement Authority (SEA) about foreclosure sale, and from Statistics Sweden about the foreclosure debtors, to explore how the socio-economic status of the debtors has changed from 2000 to 2014. Papers 2 and 3 employ the same type of data to explore different aspects of the behaviour of law: the relationship between lender–borrower relational distance and the quantity of law, and between borrower socio-economic status and the compensatory style of law, respectively. Paper 4 employs expert interviews with debt collection officers and managers to explore the relationship between how Swedish mortgage lenders organize and conduct debt collection measures aimed at delinquent borrowers, and the quantity of negotiation. The results in Papers 2–4 indicate that social control responses during foreclosure in Sweden are contingent upon differences in social status between the lender and the borrower.The thesis’ main contribution is that it provides empirical evidence of the socially contingent nature of law and other social control responses. This addresses one of the foundational debates within the sociology of law regarding the relationship between the institutions of law and social control, on the one hand, and the organization of social relations and behaviour, on the other. Specifically, the thesis contributes with empirical applications of Donald Black’s theoretical framework using register and interview data, and an independent theory of negotiation during foreclosure in the Blackian paradigm. Furthermore,by demonstrating the relevance of Black for empirical studies of social control and for understanding the social contingency of law, the thesis aims to contribute to ongoing discussions within the sociology of law regarding the possibility of attaining positivistic yet critical knowledge about law-related phenomena. In conclusion, the implications of the social contingency of law for the SEA are discussed.

  • Two Steps Forward, One Step Back: A Policy Analysis of the Swedish Guidelines for Trans-Specific Healthcare

    • Introduction Sweden has one of the world's longest histories of providing subsidized gender-confirming medical procedures for people with trans experiences. However, until 2015, Swedish trans-specific healthcare lacked formal guidelines. Methods In this study, we analyse the Swedish guidelines for trans-specific healthcare from 2015 using Bacchi's approach: "What's the problem represented to be?" Following this approach, we analyse problem representations in the guidelines with special focus on evaluation, diagnosis of gender dysphoria and criteria for access to care. Results Three problem representations were identified in our analysis: "the problem of (non)linear gender", "the mental health paradox" and "gender dysphoria as a psychiatric, psychological and psychosocial problem". Together, these problem representations construct gender dysphoria as a psychopathology and allocate the decision-making power to mental health care providers. Hence, the guidelines reconstruct the gatekeeping function among care providers while undermining care seekers' ability to attain self-determination. While the guidelines do allow for non-linear embodiment, they simultaneously reconstruct a linear relationship between gender identity and social gender role. Mental healthiness and, for migrants, having a residence permit seem to be favoured in the evaluation of gender dysphoria and for access to gender-confirming medical procedures, while aspects of gender euphoria are silenced. Conclusions We conclude that the guidelines resemble, and have similar effects to, the psychomedical understandings of gender dysphoria prevalent in medical research and practice. At the same time, the guidelines attempt to depathologize trans experiences and open up space for new subjectivities to be eligible for access to gender-confirming medical procedures. Policy Implication The knowledge from this study can be useful when constructing, revising or analysing guidelines for trans-specific healthcare in several contexts.

    • Cooperation between authorities is of great importance for effective crisis management. A new crisis management system was introduced in Sweden in 2002 to enhance the ability of public authorities to manage accidents and extraordinary events. It expects authorities to cooperate with each other both before and while dealing with such situations. An important aspect of this cooperation is the exchange of information, which is hampered when authorities are obliged to observe secrecy rules even if this limits their ability to manage accidents and extraordinary events. It may be said, therefore, that the legislation governing the exchange of information by authorities, chiefly the Public Access to Information and Secrecy Act (2009:400), is essentially at variance with the rules that require cooperation.The thesis analyses legal requirements on authorities to cooperate and exchange information when dealing with accidents and extraordinary events and how these requirements relate to secrecy rules. The study does not merely examine the legal requirements placed on authorities to cooperate and exchange information and to observe secrecy rules when dealing with accidents and extraordinary events; it also undertakes a critical analysis of the current legislation, with the aim of identifying deficiencies and ambiguities, taking as its criteria that good legislation should be clear, coherent and well-balanced. Since the thesis shows that there are deficiencies in the legislation, it also suggests improvements and alternative forms of regulation.

  • Getting invasive species on the political agenda : agenda setting and policy formulation in the case of ash dieback in the UK

    • This study reviews how the issue of ash dieback has been placed on the political agenda in the UK, a country where the disease has affected one of the largest national extents, thus representing a particularly severe case. Comparisons are made between how the scientific community framed the ash dieback threat and the resulting response strategy and how both the media and the British government framed the problem. Representing one example of media framing, the study analyses one British newspaper’s coverage of the disease and the response strategies (the Daily Telegraph). The analysis highlights a gap between the biologically rooted perspective and the perspective of policymakers, where policy must manoeuvre between disparate viewpoints and needs. Crucially, none of Pautasso et al.’s (Biol Conserv 158:37–49, 2013) five plant-science-based solutions were explicitly adopted by the British Government in their response strategy to ash dieback disease. The same is true of the biological control recommendations offered by Kirisits et al. (J Agric Ext Rural Dev 4(9):230–235, 2012). Instead, the government adopted a broader, more comprehensive approach than that recommended by plant scientists. The present analysis thus provides an example of a holistic perspective on the multiple competing factors that policymakers must navigate in their attempts to delineate action. It highlights instances in which proposed biological responses were rendered less applicable by a failure to understand the agenda-setting process and the policy-making arena. The present findings suggest that an improved understanding of the factors influencing agenda setting and policy action is essential to arriving at a more effective and integrated understanding of responses to biological threats.

    • The rapid development of the law governing the protection of children implies clearly that they are definitely the formable generation of international social construction. Consequently, the legal philosophy of protecting a suspect child must bear several important principles before, during and after the criminal proceedings and should guarantee the demand of law and order. This includes the application of the law within national and international courts. It is therefore of great importance that the fundamental distinctive marks of legal security are clearly presented for a child under suspicion of a crime as well as for the relevant legal system. In a constitutional state as well as in an international sphere, and particularly within the legal areas of criminal law and criminal procedural legislation, law and order is recognized by the effective implementation of the principles of de lege lata, objectivity, proportionality and that any action by a legal authority may be foreseen. Any divergence from such a practice may not only harm the child but also the international community as a whole. In other words, the comparative focus of the law of different nations should have the same consequence in the demand of law and order.

    • Legal and general history is two neighbouring academic fields. The first one being a rather small part within more general legal studies, while the other deals with law as just one part of a much larger field, which includes for instance political, social, cultural, environmental and military aspects. In Actors and structures context, anyone trying to influence international law has to grapple with two kinds of structures. On one hand, there is the social and historical context where and when the intervention takes place. On the other hand, law is itself a structure with a certain kind of inertia. To the extent that the latter also binds the former through institutional arrangements, there is a dialectical connection between the two. Lawyers are not only the products of their historical circumstances; they also have to navigate within legal structures that are the result of struggles engaged in by their predecessors.

    • This population-based time-trend study examines gun violence rates among males in Sweden during the years 1996 to 2015 and compares the rate in Sweden to other Western European countries. Data were collected from six registries and are presented descriptively per 100,000 inhabitants. The risks among males in Sweden increased considerably in both lethal and non-lethal gun victimization and perpetration. Among males aged 15 to 29 there was a five-fold increase in risk for victimization in lethal and non-lethal gun violence during the 20-year observation period. In a comparative perspective the rate of gun homicide victimization among males 15 to 29 years was higher in Sweden compared to other Western European countries, while the risk for males over age 30 was at an average level. Based on the results of this study we conclude that gun violence among young males in Sweden has been on the rise and is at a high level compared to other Western European countries. The development of gun violence in Sweden can be characterized as endemic, prevalent in both population and socially vulnerable areas.

  • A new high-resolution nationwide aboveground carbon map for Brazil

    • Brazil is home to the largest tracts of tropical vegetation in the world, harbouring high levels of biodiversity and carbon. Several biomass maps have been produced for Brazil, using different approaches and methods, and for different purposes. These maps have been used to estimate historic, recent, and future carbon emissions from land use change (LUC). It can be difficult to determine which map to use for what purpose. The implications of using an unsuitable map can be significant, since the maps have large differences, both in terms of total carbon storage and its spatial distribution. This paper presents comparisons of Brazil’s new ‘official’ carbon map; that is, the map used in the third national communication to the UNFCCC in 2016, with the former official map, and four carbon maps from the scientific literature. General strengths and weaknesses of the different maps are identified, including their suitability for different types of studies. No carbon map was found suitable for studies concerned with existing land use/cover (LULC) and LUC outside of existing forests, partly because they do not represent the current LULC sufficiently well, and partly because they generally overestimate carbon values for agricultural land. A new map of aboveground carbon is presented, which was created based on data from existing maps and an up- to-date LULC map. This new map reflects current LULC, has high accuracy and resolution (50 m), and a national coverage. It can be a useful alternative for scientific studies and policy initiatives concerned with existing LULC and LUC outside of existing forests, especially at local scales when high resolution is necessary, and/or outside the Amazon biome. We identify five ongoing climate policy initiatives in Brazil that can benefit from using this map.
