  • Intellectual Property Law Compliance in Europe: Illegal File Sharing and the Role of Social Norms

    • The current study empirically demonstrates the widely discussed gap between copyright law and social norms. Theoretically founded in the sociology of law, the study uses a well-defined concept of norms to quantitatively measure changes in the strength of social norms before and after the implementation of legislation. The ‘IPRED law’ was implemented in Sweden on 1 April 2009, as a result of the EU IPR Enforcement Directive 2004/48/EC. It aims at enforcing copyright, as well as other IP rights, when they are violated, especially online. A survey was conducted three months before the IPRED law came into force, and it was repeated six months later. The approximately one thousand respondents between fifteen and twenty-five years-of-age showed, among other things, that although actual file-sharing behaviour had to some extent decreased in frequency, social norms remained unaffected by the law.

  • Norms in Law and Society: Towards a Definition of the Socio-Legal Concept of Norms

    • The aim of this paper is to present a model for creating a more coherent concept, designed to meet the demands of the multidisciplinary field of Sociology of Law. This model is built on an ontological analysis that can incorporate different perspectives. The suggested analysis is mainly founded on the Aristotelian concepts of ‘essence’ and ‘accident.’ Thus, the method is concerned with distinguishing between norms’ ‘essential’ attributes that lie in their (the norms’) nature, (together they form the general definition of the socio-legal concept of norms); and other ‘accidental’ attributes that are characteristic within certain groups of norms (for example social and legal). The socio-legal concept of norms, presented here, acknowledges three essential attributes that define the nature of norms. The first two are relating to the dual ontological existence/shape of norms and the third to the importance of acknowledging the behavioural dimension. Hence, all types of norms (for example, social, legal, etc.) have two ontological attributes and one behavioural. Accordingly, norms are: (a) imperatives; (b) social facts; and (c) beliefs.

    • In this article we argue the need for more socio-legal scrutiny in a digitally mediated and data-driven development. We focus and briefly outline socio-legally relevant aspects of the “sharing” economy, that poses a number of conceptual issues on how we understand and regulate innovative platform based ventures. This also arguably underscores a number of issues relating to the role of consumer and user data and the implications of this “datafication”, not least in terms of questions of accountability and balancing of both powers and privacy in a data-driven world that often is described as a “black box” (cf. Pasquale, 2015) in the sense that much of the automated processes – such as the workings of algorithms and third party trade of consumer data – is withheld from insight and transparency.

  • Corruption in a culture of money: Understanding social norms in post-Soviet Uzbekistan

    • The aim of this article is to explore the social meaning and ordinary activities surrounding informal transactions in order to better understand the social context forming the premises and informing the meaning of corruption in Uzbekistan. A theoretically founded hypothesis is that informal transactions in Uzbek society reflect different cultural meanings than in the Western world. If this is true, there may be reasons to re-evaluate the concept of corruption in order to reflect the morality of exchange in Uzbekistan. This article is based on two periods of field research between 2009-2010 in Oltiariq district of Fergana region, Uzbekistan. We used ethnographic methods and the case of wedding ceremonies in order to illustrate local perceptions of informal exchange. Our results can be summarised in three main points: (a) informal transactions are deeply embedded in cultural practices; (b) not all informal transactions are corrupt; (c) when talking about (or measuring) corruption, local perceptions should be taken into account.

  • Welfare as a means for political stability : a law and society analysis

    • There have been extensive discussions in academic circles of why some countries develop into welfare states while others do not. Two main factors mentioned in these discussions are economic growth and the need for political stability. In these discussions, the example of Sweden, where the welfare state allegedly emerged from a ‘culture of consensus’, has often been treated as an historic exception. In this article we discuss the relevance of the two main factors suggested in the literature, and investigate whether Sweden is a rare case of a country where welfare arose out of a culture of consensus or if welfare in Sweden emerged as a product of strategies that aimed at promoting political stability, and thereby followed a similar pattern to other Western European countries. In undertaking this task, we have conducted a review of the literature and used Migdal’s ‘state-in-society’ perspective and the ‘institutional approach’ as a theoretical framework. Our results can be summarised under three headings: (a) until the mid-twentieth century, Sweden was a highly unstable, conflict-ridden class society, and thereby a followed similar pattern to other Western European countries; (b) welfare reforms in Sweden were introduced as a means of addressing political and social instability; (c) Sweden is therefore no exception to the theory that deep political crises trigger welfare reforms.

    • The fact that the debate concerning copyright in a digital society has been both intense and filled with polemic conflicts ever since the late 1990s makes it clear that it is a most complicated issue to solve, or even grasp. Basically, both the legal and societal discussion and development are explicitly dependent on a greater understanding of the on-going processes surrounding copyright. This presents a well-suited point of departure for research such as the one conducted within the Cybernorms research group – both in terms of providing valuable insights into the field of sociology of law when it comes to understanding how to relate to the framework provided by digitalization in general and the Internet in particular, and in terms of providing more accurate knowledge and toolsets to legislators in related fields.

  • The social contingency of law : Studies of social control during foreclosure in Sweden

    • Summary: This thesis empirically investigates how law and other social control responses during foreclosure in Sweden are contingent upon differences in social status. The thesis draws upon American sociologist Donald Black’s theoretical framework on social control to explain this social contingency. According to Black, variations in social control responses are explained and predicted by variations in the social structure pertaining to, for example, differences in wealth and relational distance between the stakeholders.The thesis consists of an introductory framework and four papers. Paper 1 employs register micro data from the Swedish Enforcement Authority (SEA) about foreclosure sale, and from Statistics Sweden about the foreclosure debtors, to explore how the socio-economic status of the debtors has changed from 2000 to 2014. Papers 2 and 3 employ the same type of data to explore different aspects of the behaviour of law: the relationship between lender–borrower relational distance and the quantity of law, and between borrower socio-economic status and the compensatory style of law, respectively. Paper 4 employs expert interviews with debt collection officers and managers to explore the relationship between how Swedish mortgage lenders organize and conduct debt collection measures aimed at delinquent borrowers, and the quantity of negotiation. The results in Papers 2–4 indicate that social control responses during foreclosure in Sweden are contingent upon differences in social status between the lender and the borrower.The thesis’ main contribution is that it provides empirical evidence of the socially contingent nature of law and other social control responses. This addresses one of the foundational debates within the sociology of law regarding the relationship between the institutions of law and social control, on the one hand, and the organization of social relations and behaviour, on the other. Specifically, the thesis contributes with empirical applications of Donald Black’s theoretical framework using register and interview data, and an independent theory of negotiation during foreclosure in the Blackian paradigm. Furthermore,by demonstrating the relevance of Black for empirical studies of social control and for understanding the social contingency of law, the thesis aims to contribute to ongoing discussions within the sociology of law regarding the possibility of attaining positivistic yet critical knowledge about law-related phenomena. In conclusion, the implications of the social contingency of law for the SEA are discussed.

  • Law, Norms, Piracy and Online Anonymity – Practices of de-identification in the global file sharing community

    • Purpose The purpose of this study is to better understand online anonymity in the global file-sharing community in the context of social norms and copyright law. The study describes the respondents in terms of use of Virtual Private Networks (VPNs) or similar services with respect to age, gender, geographical location, as well as analysing the correlation with file-sharing frequencies. Design/methodology/approach This study, to a large extent, collected descriptive data through a web-based survey. This was carried out in collaboration with the BitTorrent tracker The Pirate Bay (TPB), which allowed us to link the survey from the main logo of their site. In 72 hours, we received over 75,000 responses, providing the opportunity to compare use of anonymity services with factors of age, geographical region, file-sharing frequency, etc. Findings Overall, 17.8 per cent of the respondents used a VPN or similar service (free or paid). A core of high-frequency uploaders is more inclined to use VPNs or similar services than the average file sharer. Online anonymity practices in the file-sharing community depend on how legal and social norms correlate (more enforcement means more anonymity). Research limitations/implications The web-based survey was in English and mainly attracted visitors on The Pirate Bay’s web site. This means that it is likely that those who do not have the language skills necessary were excluded from the survey. Practical implications This study adds to the knowledge of online anonymity practices in terms of traceability and identification, and therefore describes some of the conditions for legal enforcement in a digital environment. Social implications This study adds to the knowledge of how the Internet is changing in terms of a polarization between stronger means of legally enforced identification and a growing awareness of how to be more untraceable. Originality/value The scale of the survey, with over 75,000 respondents from most parts of the world, has likely not been seen before on this topic. The descriptive study of anonymity practices in the global file-sharing community is therefore likely unique.

    • This book summarizes the project work of the very first batch of participants of Lund University’s international Social Innovation in a Digital Context programme, financed by the Swedish Institute. The programme targets human rights activists in a position from which they can initiate projects of change in their home countries in the area of social innovation. During the programme all participants initiate a change project using the knowledge and skills obtained during the programme and using digital technology. This book contains reports on projects aimed at creating sociopolitical improvement in Algeria, Gaza, Iraq, Jordan, Syria and Tunisia.
