- The Treaty of Lisbon presents itself as the answer to three key constitutional questions: How should the division of competencies between the Union and the member states best be defined? How can actors be positioned and procedures be structured to increase the Union’s capacity to act? What provisions will make the EU system ‚more democratic‘ and thereby increase its legitimacy? In answering these questions the member states are faced with a number of structural dilemmas. A series of changes to the existing provisions is expected to lead to increased efficiency as well as more democratic participation and controls within individual institutions and procedures. It is uncertain, however, if these effects will prove mutually reinforcing or if, on the contrary, they will turn out to be counterproductive in combination. The underlying constitutional problems and questions are not conclusively addressed by the Lisbon Treaty.

- Existential crises are causes and amplifiers of fundamental shifts in inter-institutional relations in all political systems. This is especially true for the European Union and the crisis of Economic and Monetary Union. The aim of this article is to investigate these shifts in the institutional framework of the European Union as the crisis progresses. The article poses three central questions that organise the analysis. How does the crisis re-sponse change the vertical division of competences between the member states and the Union? How do the measures taken alter the horizontal balance of power among the institutions of the EU? What sources of democratic legitimacy do the decision-makers claim? Our analysis points to the continuation of existing trends and some surprising breaks.

Einige Analysten sehen sie auf dem Rückzug, verdrängt durch nichtstaatliche Akteure wie multinationale Unternehmen auf der einen Seite und supranationale Organisationen auf der anderen. Andere sehen ihre Rolle als traditionelle Träger der Souveränität trotz geringfügiger Anpassungen im Wesentlichen unverändert.
