    • The ocean provides essential ecosystem services such as food production, off- shore renewable energy, carbon sequestration, and recreation. However, scientif- ic evidence warns us about the severe impacts the ocean is facing due to pollution, unsustainable fishing practices, and climate change effects. These effects include ocean acidification, biodiversity loss, and sea level rise. From international, EU, and national perspectives, there is an outspoken aim to boost the ‘blue’ economy while securing healthy marine ecosystems. However, the legal system handling these integrated demands is diverse and fragmented regarding sectoral aims, geographical areas, and governance levels. In their current form, they are not designed or fit to provide an ecosystem-based approach to managing human–ocean relations or to implementing the objective of a healthy and sustainable ocean. To integrate legal competence relevant to ocean governance in both practice and theory, scholars of different legal areas within the Department of Law col- laborate internally and, more importantly, with scholars within other disciplines and actors outside academia. Our ambition is for this interdisciplinary endeavor to prompt changes in socio-environmental governance structures and legal ed- ucation. From a socio-environmental perspective, we examine opportunities to integrate our knowledge of different legal areas and improve our transdisciplinary capacity. We analyze and discuss challenges, drivers, and pathways to provide knowledge supporting a transformation to a more sustainable blue economy. From a legal education perspective, interdisciplinarity requires a problem-based approach and the introduction of threshold concepts that shape how we apprehend a particular phenomenon. Ocean governance is an example of a concept providing a valuable opportunity for broader legal reasoning and for finding meaning- ful connections between national, regional, and international law.

    • I den här artikeln undersöker vi hur ankring hanteras och skulle kunna hanteras inom det svenska miljörättsliga prövningssystemet, fram för allt miljöbalken. Sjöfarten är världens största transportsystem och står för 75 % av världens transportarbete. Mycket har skrivits om sjöfartens globala miljöpåverkan och utsläpp av växthusgaser. Mindre har dock skrivits om den lokala miljöpåverkan som uppstår när fartyg ankrar och hur den kan hanteras rättsligt. I artikeln analyseras hur rätten genom geografiska avgränsningar (var), mandat för förvaltning (vem) samt avgränsning och ansvar (vad) påverkar och styr hur ett fenomen hanteras. Utifrån detta förs en diskussion om vad som vore en lämplig typ av förvaltning för att hantera ankringens lokala miljöpåverkan. Vi kommer fram till att ankringen idag egentligen inte i någon större utsträckning hanteras inom ramen för det miljörättsliga prövningssystemet. Därmed finns det ingen möjlighet för förprövning av ankringsområden, vilket leder till en reaktiv förvaltning som är beroende av tillsynsmyndigheternas resurser och kompetens. Om istället ankringsområden betraktades som tillståndspliktiga miljöfarliga verksamheter och Sjöfartsverket ansågs vara verksamhetsutövare i kraft av att man pekar ut områdena, skulle det ge större möjligheter till en preventiv förvaltning. En sådan ordning vore mer i linje med hur liknande miljöpåverkan på land hanteras och skulle säkerställa att ankringsområden lokaliserades till platser där ankringen kan ske med så liten negativ miljöpåverkan som möjligt.

Although very different in their approach, the two articles share a common focus on space-based governance instruments; marine spatial planning and area-based management tools, respectively.

  • Realizing the Social Dimension of EU Coastal Water Management

    • In the last 20 years, the EU has adopted some rather ambitious pieces of legislation with the aim to achieve a good environmental status in freshwater and marine ecosystems. Both the Water Framework Directive (WFD) and the Marine Strategy Framework Directive (MSFD) have a strong focus on the natural environment and biological criteria for assessing the status of the relevant ecosystems. In the same time period, much research on environmental governance has focused on the interconnectedness of social systems and ecosystems, so-called social-ecological systems (SES). While having high aspirations, the legal frameworks underpinning current EU water and marine management do not necessarily reflect the advances of contemporary science relating to SES. Using the geographical intersection of the two directives, i.e., coastal waters as a focal point, the paper explores the inchoate integration of social and ecological perspectives in the EU marine governance. What are the main challenges for the current EU legal regimes for managing coastal waters in a way that builds on the understanding of social and ecological systems as interconnected? Having explored the two directives, the paper introduces the possibility of using marine spatial planning (MSP), and the EU directive establishing a framework for maritime spatial planning (MSPD) as a bridge between the social and ecological dimensions and discusses what implications this would have for the current system for governing coastal waters in Europe.

    • The report engages with the concepts of ecosystem approach and maritime spatial planning and the relationship between them with a particular focus on the Baltic Sea context. The HELCOM-VASAB Guideline for the implementation of ecosystem-based approach in maritime spatial planning is assessed in the light of scientific literature on the ecosystem approach, selected reports and pertinent guidance documents. The assessment reveals significant room for improvement. This includes potential amendments aimed at dealing with uncertainty and precaution in a more systematic fashion, ensuring that public participation processes enable genuine two-way communication and avoid capture by particularly resourceful or articulated interests, as well as increasing transparency concerning trade-offs among users and interest.

    • © 2018 Elsevier Ltd The ecosystem approach has become a common tool in environmental governance over the last decade. Within the EU context, this is most clearly accentuated through the adoption of the Marine Strategy Framework Directive and the Directive on Maritime Spatial Planning, that both include requirements for Member States to apply the approach. This paper examines the organization of marine spatial planning (MSP) by the EU countries in the Baltic Sea Region in terms of management levels and geographic delimitations. The research shows that there is no consistent interpretation of what is the appropriate level of management, or ecosystem scale. These findings are used to inform a discussion on the application of the ecosystem approach in the countries around the Baltic Sea, and its effect on the potential of transboundary cooperation initiatives.
