    • Hur hanterar föräldrabalken att män föder barn och att kvinnor kan ha spermier? År 2013 avskaffades krav på sterilisering i samband med ändring av juridisk könstillhörighet och år 2019 infördes ett nytt avsnitt i föräldrabalken om transpersoners och intersexpersoners föräldraskap. Ytterligare bestämmelser införs i januari 2022. Denna artikel syftar till att beskriva och kritiskt analysera den rättsliga regleringen för föräldraskap vid ändrad könstillhörighet. Artikeln beskriver hur regleringen växt fram och förklarar hur den tillämpas i olika situationer. Reglerna har blivit anmärkningsvärt komplicerade, framför allt för att lagstiftaren har behållit de traditionella reglerna för faderskap och moderskap oförändrade och i stället lagt till ett separat avsnitt med tilläggsbestämmelser. Detta medför ett flertal praktiska och stigmatiserande problem. En utredning har tillsatts för att överväga hur föräldrabalken kan göras mer könsneutral för att undvika sådana problem. Avslutningsvis diskuteras därför möjliga utformningar av en sådan lagstiftning.

    • The problem of excessive debt among households in Sweden is increasing. As a result of the development within the financial sector, households in Sweden have increased their debt incurrence markedly. It has been relatively easy to borrow money, due to the deregulation of the credit market in Sweden in the 1990s and the low interest rates in recent years. As mortgage loan is the bulk of the total household debt, the risk that individuals will be affected by excessive debt incurrence and insolvency has therefore increased. Therefore, a number of new legislative changes have been implemented to overcome this problem. In order to prevent these risks, the Financial Authority has adopted a rule that stipulates that new loans should not exceed 85% of the property market value. Reports from both the Swedish Enforcement Authority and the Swedish Financial Supervisory Authority show that 20% of Swedish households have a difficult time making ends meet. Those who are affected by excessive debt often experience a lower standard of living since frequently they are impacted by distraint.The aim of this paper is to describe and analyze the excessive debt situation in terms of insolvency and effects on households and society. Firstly, we intend to investigate foreclosures in Sweden, both regionally and over time. Why are certain regions less frequently affected by these risks while other regions show higher levels of risk even during generally good years? Secondly, we will investigate whether (a) whether properties that have undergone executive auction are sold at a lesser value, (b) if these properties have an impact on the property prices in the vicinity and (c) if those who buy these properties themselves run a greater risk of insolvency. Thirdly, a closely related area of legal interest is investigating to what extent legislation provides a protective net for the debtor who, through the executive auction, thereby loses his/her residence.

    • Intensifying global trade will result in increased numbers of plant pest and pathogen species inadvertently being transported along with cargo. This paper examines current mechanisms for prevention and management of potential introductions of forest insect pests and pathogens in the European Union (EU). Current European legislation has not been found sufficient in preventing invasion, establishment and spread of pest and pathogen species within the EU. Costs associated with future invasions are difficult to estimate but past invasions have led to negative economic impacts in the invaded country. The challenge is combining free trade and free movement of products (within the EU) with protection against invasive pests and pathogens. Public awareness may mobilise the public for prevention and detection of potential invasions and, simultaneously, increase support for eradication and control measures. We recommend focus on commodities in addition to pathways, an approach within the EU using a centralised response unit and, critically, to engage the general public in the battle against establishment and spread of these harmful pests and pathogens.

  • Employee Health Data in European Law : Privacy is (not) an Option?

    • While there are many feasible reasons for employers to process employee health data, the protection of such data is a fundamental issue for ensuring employee rights to privacy in the workplace. The sharing of health data within workplaces can lead to various consequences, such as losing a sense of privacy, stigmatisation, job insecurity and social dumping. At the European level, the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and EU General Data Protection Regulation (GDPR)–two interconnected instruments–offer the most enforceable protection of employee health data. The article analyses the limits of employees’ right to privacy regarding health data, as delineated by the ECHR and GDPR. Using three fictive examples, we illustrate how the level of protection differs in these two instruments. In particular, we show that the protection of health data offered by the GDPR is seen as an objective act of processing at the time it is carried out, where the actual impact caused by the processing on private life is not considered. On the contrary, the ECHR’s applicability and offered level of protection in the employment context depend on subjective factors, such as the consequences of sharing the data.

    • Twenty years ago, the Swedish National Council for Crime Prevention presented a report that highlighted serious problems with regard to identifying, investigating, and sentencing offenders for hate crimes. The same problems have also been described in international research from several other countries. Since then, several measures have been taken to remedy these problems, but it remains unknown whether these measures have been successful. The aim of the present study is therefore to trace developments over time, using Sweden as a case study, and to evaluate the extent to which the problems identified earlier have been remedied. The results show that the problems identified by the Swedish National Council for Crime Prevention still remain despite a continuous process of reform. Theoretical links and parallels to international research are discussed throughout the article.

    • Consideration of victims and how best to acknowledge their rights and position in the criminal prosecution process has become an intrinsic part of the drafting and negotiation of new international criminal law instruments. In studies of states’ implementation of international victims’ rights, Sweden often places at the top of the class. This article challenges the concept of successful implementation of human rights norms by critically analysing the conformity of Swedish law with international legal obligations towards victims of crime. It further contributes to existing literature describing the factors that may facilitate or obstruct such implementation, and demonstrates that Sweden’s position as a model of successful implementation is more the result of the historical position given to victims of crime in the country than of its commitment to live up to its international obligations. The article also raises doubt as to the Swedish government’s commitment to assuring that Swedish national law upholds its present conformity with international law norms, protecting victims into the future.

    • International trade and climate change have increased the movement potential for invasive alien species (IAS), including invasive pests and pathogens (IPPs), to the point where biological invasions are considered one of the major threats to biodiversity. However, practical implementation of plant health with regard to IAS and IPPs is difficult: regulative responsibilities are commonly spread across different authorities, and resources on the ground are often limited. Based on a legislative and literature review and semi-structured qualitative interviews (N = 7), the present study examines the possibilities and potential risks of monitoring and detection of forest invasive species in Sweden, with a particular focus on forest plant nurseries. The study thus adds practical implementation aspects concerning possibilities to limit the spread of invasive species in the plant trade.
