  • Technology-based coopetition and intellectual property management: The case of post-divestiture coopetition
  • 2018
  • In: The Routledge companion to coopetition strategies.
  • Book chapter (other academic/artistic)abstract
    • This chapter introduces intellectual property (IP) management in technology-based coopetition. It includes a general description of the role for IP management in competition and collaboration, as well as a framework for classifying IP relevant to coopetition. Based on this framework, IP agreements are shaped to combine the logics of competition and collaboration in coopetition. A key point is that knowledge, technology, and IP can be protected to enable controlled sharing through licensing in coopetition. The chapter also introduces the concept of post-divestiture coopetition, in which IP management is critical, and exemplifies it with two cases from the automotive industry.

  • Legal imperialism in the regulation of stem cell research and therapy: the problem of extraterritorial jurisdiction
  • 2010
  • In: Capps BJ & Campbell AV (eds.). CONTESTED CELLS: Global Perspectives on the Stem Cell Debate. - London : Imperial College Press. - 9781848164376 ; , s. 95-119
  • Book chapter (other academic/artistic)abstract
    • Countries worldwide have very different national regulations on human embryonic stem (ES) cell research, informed by a range of ethical values. Some countries find reason to extend the applicability of their regulations on such research to its citizens when they visit other countries. Extraterritorial jurisdiction has recently been identified as a potential challenge towards global regulation of ES cell research. This chapter explores the implications and impact of extraterritorial jurisdiction and global regulation of ES cell research on researchers, clinicians and national health systems, and how this may affect patients. The authors argue that it would make ethical sense for ES cell restrictive countries to extend its regulations on ES cell research beyond its borders, because, if these countries really consider embryo destruction to be objectionable on the basis on the status of the embryo, then they ought to count it morally on par with murder (and thus have a moral imperative to protect embryos from the actions of its own citizens). However, doing so could lead to a legal situation that would result in substantial harm to central values in areas besides research, such as health care, the job market, basic freedom of movement, and strategic international finance and politics. Thus, it seems that restrictive extraterritorial jurisdiction in respect to ES cell research would be deeply problematic, given that the ethical permissibility of ES cell research is characterised by deep and wide disagreement.

  • Management av immateriella rättigheter i öppen innovation
  • 2016
  • In: Öppen innovation – i teori och praktik. - 9789144112428 ; , s. 113-126
  • Book chapter (other academic/artistic)abstract

  • Gender, bargaining strategies and strikes in Sweden
  • 2019. - 1
  • In: Nordic equality at a crossroads. - : Routledge. - 9781138620032 - 9780815390732 - 9781351152327 ; , s. 47-68, s. 47-68
  • Book chapter (peer-reviewed)abstract
    • This chapter discusses the effects on women in Swedish working life. It explores the gendered patterns in bargaining strategies and the use of strikes. The chapter argues that gender differences in conflict patterns and bargaining strategies exist both among and within different industries. The collective agreement emerged in an unregulated field of law. Relations between the bargaining parties, as well as disputes over the content and application of collective agreements were solved via self-regulation. The rights of association and of negotiation are main components in the Swedish industrial relations system. The women’s organizations disappeared from the labour market in the heydays of the Swedish model and the solidaristic wage policy, but the different strategies between men and women remained. The new strategy is not only a result of a transformation of the collective bargaining system. The shift was also facilitated by some general changes in the labour market legislation.

  • On Legal Complexity: Between Law in Books and Planning in Practice
  • 2013
  • In: Social and Legal Norms: towards a socio-legal understanding of normativity. - Farnham, England : Ashgate Publishing. - 9781409453437 ; , s. 285-307
  • Book chapter (peer-reviewed)abstract
    • This chapter addresses the difference between the intentions of the law and its application by using mobile telephony infrastructure development in Sweden as a case. Three possible pitfalls for policy management in general are concluded and analyzed. The first pitfall deals with legal complexity, which may be a result of piecemeal changes to the governing legal bodies over a longer time and is here argued to be of relevance for issues of public participation and access to justice. Another problematic pitfall concerns when law is internally contradictory without any clear hierarchy, which is exemplified below. The third possible pitfall, which often is a point of focus in sociology of law, concerns when extra-legal factors interfere in the legal decision-making without this being pronounced or acknowledged. This means that economy and politics can affect the application of law to the extent that legal security and predictability is jeopardized. These three possible pitfalls in policy represent issues of general character in the legal government of land use and spatial planning, and are here analysed from a socio-legal perspective.
