- This paper proposes a methodological redirection of the philosophical debate on artificial moral agency (AMA) in view of increasingly pressing practical needs due to technological development. This “normative approach” suggests abandoning theoretical discussions about what conditions may hold for moral agency and to what extent these may be met by artificial entities such as AI systems and robots. Instead, the debate should focus on how and to what extent such entities should be included in human practices normally assuming moral agency and responsibility of participants. The proposal is backed up by an analysis of the AMA debate, which is found to be overly caught in the opposition between so-called standard and functionalist conceptions of moral agency, conceptually confused and practically inert. Additionally, we outline some main themes of research in need of attention in light of the suggested normative approach to AMA.

Regulation of ships at anchor: Safety and environmental implications

- Ships waiting at anchor are associated with considerable environmental pressures and impacts. Growing and congested anchoring areas are receiving increasing scholarly attention to understand the environmental effects caused by large sea-going ships anchoring in coastal waters. While there is a lack of studies addressing the entire spectrum of environmental pressures and impacts from ships at anchor, ranging from scouring of the seafloor, operational emissions and discharges and waste from maintenance carried out while at anchor, it is well established that anchoring is associated with such pressures. This article takes a problem-oriented approach since there are potential cumulative environmental impacts of ships waiting at anchor. From both a public and private law perspective, we examine the legal structures and challenges associated with the regulation of ships waiting at anchor. We also analyze the public and private law factors that may limit the ability to prevent harmful anchoring practices. Our examination shows that while coastal states have significant jurisdictional powers to regulate anchoring in coastal waters, the current international regulatory framework addresses anchoring incidentally and lacks mechanisms for considering the cumulative impacts of anchoring. Furthermore, the incentives for ships to spend a considerable amount of time at anchor appear to differ substantially across different types of charterparties. Improved regulation requires better scientific knowledge, substantial mapping of legal structures, and a stakeholder survey providing a basis for the exploration of potential contractual practices that may reduce market incentives for anchoring.

- This chapter introduces intellectual property (IP) management in technology-based coopetition. It includes a general description of the role for IP management in competition and collaboration, as well as a framework for classifying IP relevant to coopetition. Based on this framework, IP agreements are shaped to combine the logics of competition and collaboration in coopetition. A key point is that knowledge, technology, and IP can be protected to enable controlled sharing through licensing in coopetition. The chapter also introduces the concept of post-divestiture coopetition, in which IP management is critical, and exemplifies it with two cases from the automotive industry.

- In this article, we attempt to extend and nuance the debate on intellectual property (IP) strategy, appropriation, and open innovation in dynamic and systemic innovation contexts. We present the case of four generations of mobile telecommunications systems (covering the period 1980-2015), and describe and analyze the co-evolution of strategic IP management and innovation ecosystems. Throughout this development, technologies and technological relationships were governed with different and shifting degrees of formality. Simultaneously, firms differentiated technology accessibility across actors and technologies to benefit from openness and appropriation of innovation. Our analysis shows that the discussion of competitiveness and appropriability needs to be expanded from the focal appropriability regime and complementary assets to the larger context of the innovation ecosystem and its cooperative and competitive actor relations, with dispersed complementary and substitute assets and technologies. Consequently, the shaping of complementary and substitute appropriability regimes is central when strategizing in dynamic and systemic innovation contexts. This holds important implications for the management of open innovation, innovation ecosystems, platforms, and coopetition.

- Countries worldwide have very different national regulations on human embryonic stem (ES) cell research, informed by a range of ethical values. Some countries find reason to extend the applicability of their regulations on such research to its citizens when they visit other countries. Extraterritorial jurisdiction has recently been identified as a potential challenge towards global regulation of ES cell research. This chapter explores the implications and impact of extraterritorial jurisdiction and global regulation of ES cell research on researchers, clinicians and national health systems, and how this may affect patients. The authors argue that it would make ethical sense for ES cell restrictive countries to extend its regulations on ES cell research beyond its borders, because, if these countries really consider embryo destruction to be objectionable on the basis on the status of the embryo, then they ought to count it morally on par with murder (and thus have a moral imperative to protect embryos from the actions of its own citizens). However, doing so could lead to a legal situation that would result in substantial harm to central values in areas besides research, such as health care, the job market, basic freedom of movement, and strategic international finance and politics. Thus, it seems that restrictive extraterritorial jurisdiction in respect to ES cell research would be deeply problematic, given that the ethical permissibility of ES cell research is characterised by deep and wide disagreement.

Proposing a Mathematical Dynamic Model to Develop a National Maritime Security Assessment and Build a National Maritime Security Plan

- A proper assessment of maritime security risks at the national level is crucial to a national maritime security plan (NMSP) in order to secure the concerned country’s ports, vessels and territorial sea. Thus, the importance of implementing a national maritime security assessment (NMSA) to counter security threats and ensure the continuity of national and international trade. The most important set of international regulations concerning maritime security is the International Ship and Port Facility Security (ISPS) Code, which includes revision, approval and control of compliance of the Port Facility Security Plan (PFSP), which shall be based upon the Port Facility Security Assessment (PFSA). This paper proposes a mathematical dynamic model that calculates in real time the residual risk for the whole country and each of its ports by adapting and expanding the formula and procedures established in the Code, which since it has already been implemented around the world, gives the opportunity to take advantage of this quantitative solution to administrate maritime security risks on a nation-wide basis and create an effective national maritime security plan, which would allow the concerned authorities to improve situational awareness and adapt to security changes through a better planning of human, economic and material resources to deter security threats. The model was tested with the use of five encoded categories as countries, each of them with three ports, which encompassed three port facilities. The results indicate that this methodology is easy to implement and widespread use of that model could strength robustness in national security.
