    • Who is a mother? In recent decades, a broader array of family and parenthood scenarios has been legally recognized in Sweden, as well as in several other jurisdictions. However, at least in Sweden, the rules of maternity continue to be rooted in ancient Roman principles, presuming that a child's mother is the woman who gives birth. This principle has been challenged by adoption, uncertain maternity, egg donation, surrogacy, same-sex couples, and transgender parents. Yet, these situations are governed by exception rules, which are often more complicated and less favourable for the child. My PhD thesis explores the evolution of legal parenthood from a norm-critical perspective. This involves critically examining and highlighting what is perceived as standard or neutral, what are considered special cases or exceptions to such norms, and what is viewed as non-existent. Maternity is intimately tied to perceptions of womanhood. This paper seeks to explore how patterns of norms and exceptions in legal parenthood can be understood when approached from different angles, such as essentialism, social constructivism, performative acts, and material conditions.

    • I detta samtal bjuder vi in till ett utbyte av erfarenheter och tankar om hur vi som pedagoger kan arbeta med kunskap som på ett mer grundläggande plan är utmanande för studenterna. Med utmanande menar vi i detta sammanhang inte att kunskapen är tekniskt svår eller komplex utan att den ger studenten skäl att ifrågasätta tidigare positioner. Ett ifrågasättande som direkt eller i förlängningen berör inte bara det ämne som är fokus för undervisningen utan studentens självbild, samhällssyn, ideologi mm. Vi talar om en typ av transformativ kunskap som på något plan är irreversibel (den enskilde studenten kan inte gå tillbaka till en position som förelåg kunskapandet) och vilken inte sällan kan ge upphov till ilska, irritation, och frustration hos studenter. Snarare än att få en ’lösning’ når studenten ett tillstånd av kunskapande som genererar nya frågor. Temat knyter an till det som Perkins benämnt ”troublesome learning” (Perkins 1999). Vi (Stendahl och Arvidsson) har båda från olika håll och med olika pedagogiska verktyg medvetet arbetet med besvärligt kunskapande i högskolepedagogiska situationer. Stendahl i sitt arbete med tröskelbegrepp (Meyer, Land 2003, 2005; Stendahl, Swedrup, Åberg 2021) och Arvidsson i sitt pedagogiska arbete i akademisk handledning med ’den analytiska situationen’ utifrån psykoanalytisk teori och praktik (Owler 1999, Arvidsson 2023).   • To have or not to have? Success rates in the termination of protective custody of children in Sweden

    • Sweden comparatively has a large proportion of children in protective custody, as well as long terms of placement. This can be understood as a token of social welfare ambition, but also of its failure. Law and society-literature show that experienced litigants enjoy higher success rates in court proceedings than one-shot litigants. In compulsory care proceedings, individual parties against whom coercive measures are brought are usually “have nots”, whereas opposing authorities have vast resources at their disposal. The termination of protective custody is against this background examined, tracing not only relevant factors, but also explaining individual outcomes. In administrative proceedings of all types (Risenfors/Lorentzson) individuals’ success rates were overall low; however, protective custody and its termination were even lower (up to 99%). Child protective custody proceedings have certain particularities, explaining success rates. It is a typical case of haves vs haves not (in Galanter’s terminology) – public authorities enjoy the necessary litigation infrastructure whereas individuals are subjected to protective custody proceedings because of various incapacities. On the other hand, it is not a clean-cut matter of litigation experience, as many individuals in protective custody are also repeat players (albeit less so than their opposing parties). There remain other tokens of procedural imbalance. The litigation type includes a representation anomaly as compared to other administrative procedures. On the one hand, individuals are always granted legal aid; on the other, this does not constitute effective counsel (Wejedal/Östlund). The context of “therapeutic law” in itself produces an inequality of arms (Sjöström/Jacobsson. Albeit formally inter partes, in this respect it is not truly adversarial, which places the problem’s procedural dimensions within the wider legal discourse on access to justice, and ultimately within dimensions of social inequalities.

    • The Swedish government is currently preparing the introduction of age restriction for social media. The age restriction risk being as high as 16 years. In reality, this means that children will be put in a situation were they need to ask their parent for permission to use social media such as for example Facebook, Instagram, Snapchat. The Swedish response is based upon the agreement reached by the European Parliament and Council on the data protection reform proposed by the Commission. They argue that the reform is an essential step to strengthen citizens' fundamental rights in the digital age and describes the specific protection for children as follows: The Regulation recognizes that children deserve specific protection of their personal data, as they may be less aware of risks, consequences, safeguards and their rights in relation to the processing of personal data. For instance, they benefit from a clearer right to be forgotten. When it comes to information society services offered directly to a child, the Regulation foresees that consent for processing the data of a child must be given or authorized by the holder of the parental responsibility over the child. The age threshold is for Member States to define within a range of 13 to 16 years. The aim of this specific provision aims at protecting children from being pressured to share personal data without fully realizing the consequences. It will not to stop teenagers from using the Internet to get information, advice, education etc. Moreover, the Regulation specifies that the consent of the holder of parental responsibility should not be necessary in the context of preventive or counselling services offered directly to a child. This study will focus upon the child’s perspective on the suggestion of introducing age restrictions on social media as an attempt to strengthen the protection of children in the digital society and discuss potential dilemmas. Focus groups will be conducted within this study.

    • Agricultural biotechnology, in particular genetically modified organisms (GMOs), is subject to regulation in many areas of the world, not least in the European Union (EU). A number of authors have argued that those regulatory processes are unfair, costly, and slow and that regulation therefore should move in the direction of increased ‘technology neutrality’. The issue is becoming more pressing, especially since new biotechnologies such as CRISPR increasingly blur the regulatory distinction between GMOs and non-GMOs. This paper offers a definition of technology neutrality, uses the EU GMO regulation as a starting point for exploring technology neutrality, and presents distinctions between variants of the call for technology neutral GMO regulation in the EU.
