    • As in other areas of social engineering, Sweden is considered as world-leading in creating systems that address social inequality. One of the cases in point is the Swedish day-fine system which has been considered as pioneering by systematically considering both the wealth of the offender and the seriousness of the offence when imposing the penalty. This chapter analyses in detail the Swedish day-fine system. The case study of Sweden sheds light on the pros and cons of day-fines by recalling the discussion in Sweden prior to introducing the system and the recent academic debates on extending the use of day-fines. The chapter also offers an account of the comprehensive prosecutorial guidelines as well as an analysis of the relevant case law, particularly in relation to adjustment of day-fines. The chapter argues that the Swedish day-fine system overall must be considered as a largely successful project which holds high esteem among courts and practitioners. The common view is that it is a merit of the system that it forces the courts to consider the economic circumstances of the accused and to articulate openly for the way in which such consideration has been done.

    • This article examines how subsidiarity can limit the exercise of EU procedural criminal law competence. It argues for a narrow understanding of subsidiarity, suggesting that EU procedural criminal law legislation can only be directed at problems which are of a cross-border nature. By analysing a specific piece of EU legislation, the new Victims Directive, it is shown how the subsidiarity principle can be enforced. The article sustains that the Victims Directive can be criticised on subsidiarity grounds as the directive fails to adequately account for the link between victim rights and the application of the principle of mutual recognition, since the directive fails to explain properly the need to regulate local victim rights. The article also draws some broader reflections on the justifications for EU harmonization. It is argued that EU initiatives in procedural criminal law have not primarily been driven by the need to facilitate mutual recognition and free movement but rather motivated by a general concern to deliver a common European sense of justice. Whilst this approach from the EU legislator can be justified from a moral perspective, it flies in the face of the idea that decisions should be taken as closely as possible in respect of citizens.

    • This article examines how subsidiarity can limit the exercise of EU competence. It suggests that the problems of reconstructing subsidiarity cannot be seen in isolation from the issue of judicial review. In a substantive sense it contends that subsidiarity can be reconceptualised as a principle that challenges the internal market justification for exercise of Union competences. It argues for a narrow understanding of subsidiarity, suggesting the EU legislator to demonstrate the risk or the existence of a transnational market failure or a transnational interest in order to substantiate EU harmonization. From the perspective of judicial enforcement the key argument is to change the focus from ‘substantive review’ to ‘procedural review’ of subsidiarity in order to meet institutional concerns. The proposed standard of review suggests that the EU legislator must offer ‘adequate reasoning’ and ‘relevant evidence’ to maintain that EU legislation conforms to the subsidiarity principle.

Associationsrättens grunder ger en systematisk överblick över rättsområdet och dess centrala problem. Fokus ligger på allmänna bolags- och föreningsformer, men boken redogör även för regleringen av stiftelser. I boken diskuteras frågor om juridisk personlighet, ansvar för förpliktelser, beslutsfattande, företrädarskap, medlemsskydd, borgenärsskydd och redovisning och revision. Utöver detta behandlas vissa straffrättsliga regler av betydelse för bedrivande av verksamhet i företag och företagsbot som särskild sanktion. Boken placerar associationsrätten i en samhällelig kontext, bland annat mot bakgrund av de hållbarhetssträvanden som sker inom EU och internationellt. Associationsrättens grunder vänder sig i första hand till studenter inom juridikutbildningar men kan också användas som vägledning för den som är praktiskt verksam inom området.

    • Det inomobligatoriska medhjälparansvaret har länge ansetts bygga på oskrivna tillräknanderegler. Anta att B anlitar C för att utföra något som uppfyller B:s avtalsförpliktelse mot A och att C orsakar A skada genom handlingen eller underlåtelsen H. Frågan om B:s skadeståndsansvar mot A ska enligt dessa regler avgöras på samma sätt som om B själv hade företagit H. De centrala frågorna blir då om H strider mot någon avtalsförpliktelse som B har mot A och om C har företagit H på ett sådant sätt att den i relationen mellan A och B tillämpliga ansvarsgrunden (t.ex. oaktsamhet) är uppfylld. Den traditionella bilden har emellertid utmanats i litteraturen och även i prejudikatet NJA 2018 s. 301. Artikeln argumenterar för att de konkurrerande beskrivningarna är omotiverade och att gällande rätt alltjämt svarar mot den traditionella bilden.

    • This chapter addresses the EU’s policy in the field of procedural criminal law. It sketches how issues similar to those discussed in the field of substantive EU criminal law can arise in the field of procedural law and argues that they should also be studied from within multiple disciplines. It tentatively proposes that a more evidence- based understanding of the exercise of competences in this field is a feasible model to restrain illegitimate ‘competence creep’ from the EU legislator.

    • This article critically examines the claim that EPPO is a proper federal supranational prosecutor. The article observes that the EPPO among policymakers and commentators appears to be a hallmark of the transformation of EU criminal law from an intergovernmental paradigm to a strong federal and supranational polity. The EPPO primarily stands out among other EU agencies by having been conferred with an independent competence to prosecute crimes relating to the common EU financial interest. By establishing the EPPO, the Union has practically assumed such competences that traditionally belong to the central government in a federal state. The article discusses comprehensively the scope, nature and limits to the EPPO’s powers as well as its operating structure in light of Article 86 TFEU and the recently adopted EPPO Regulation. It departs from the basic assumption that the EPPO stands in the midst of supranationalism and intergovernmentalism. Whilst the EPPO is envisaged to be independent from the Member States, the EPPO’s complicated, multifaceted and vertical structure entails that Member States maintain a certain direction of its activities. It, however, argues that a general assessment of the EPPO’s operational and strategic direction (where its operational activities are managed and supervised by centralised ‘European’ prosecutors), and the type (direct criminal enforcement powers) and nature of its powers (criminal prosecutorial powers) makes it distinctive as the most ‘integrated’ and ‘supranational’ EU agency.

    • This article considers the possible effects of ‘Brexit’ on British nationals who would no longer be EU citizens. Any Member State withdrawing from the Union is unlikely to cut all ties to the Internal Market. It is almost inevitable that a departing State would need to set up a bilateral or multilateral arrangement for the purpose of continuing to participate in the Internal Market. The analysis compares the legal status of the citizens of a withdrawing state vis-à-vis EU citizens and examines whether and under what conditions third country nationals are conferred rights and obligations in the EU Internal Market which are equal to those enjoyed by EU citizens. In this context, the possibility of using the Polydor doctrine to empower third country nationals to an extent comparable to EU nationals is explored.

    • This article addresses supranational governance of EU criminal justice agencies from the perspective of the various agencies of policy and rulemaking who have contributed to the impressive developments in the field of EU criminal law. Taking as a working hypothesis the happenstance and haphazard character of this field of policy and law, it suggests that there is an absence of design. In the discussion the article proposes the Platonic analogy of the ‘ship of fools’ (Plato, Republic, Book VI) as an explanatory tool. The ship's captain is the guiding spirit of criminal law, but the crew of the ship, who have the power to take control, have diverse interests and ideas about how the ship should be taken to sea and navigated. The article addresses thematically and chronologically the development of EU criminal policy by means of this framework. Subsequently it discusses the extent to which the ‘ship of fools’ analogy is relevant to the development of EU criminal justice agencies, and to the emergence of a European Public Prosecutor. Underlying all this discussion is the uneasy sense that the true pilot of EU criminal law and policy has been displaced, in particular by ‘instrumental’ pilots of securitisation and effectiveness.
