  • Employee Health Data in European Law : Privacy is (not) an Option?

    • While there are many feasible reasons for employers to process employee health data, the protection of such data is a fundamental issue for ensuring employee rights to privacy in the workplace. The sharing of health data within workplaces can lead to various consequences, such as losing a sense of privacy, stigmatisation, job insecurity and social dumping. At the European level, the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and EU General Data Protection Regulation (GDPR)–two interconnected instruments–offer the most enforceable protection of employee health data. The article analyses the limits of employees’ right to privacy regarding health data, as delineated by the ECHR and GDPR. Using three fictive examples, we illustrate how the level of protection differs in these two instruments. In particular, we show that the protection of health data offered by the GDPR is seen as an objective act of processing at the time it is carried out, where the actual impact caused by the processing on private life is not considered. On the contrary, the ECHR’s applicability and offered level of protection in the employment context depend on subjective factors, such as the consequences of sharing the data.

    • Efter det att Sverige ratificerade Europakonventionen om kommunal självstyrelse (the European Charter of Local Self-Government) 1989, den s.k. självstyrelsekonventionen, har ett antal reformer av det lokala och regionala självstyret ägt rum. Frågan är i vilken utsträckning dessa reformer kan ses som anpassningar till konventionen. Analyser av granskningsrapporter och förarbeten indikerar att reformerna till stor del är inspirerade av konventionen men att några nyckelfunktioner i det svenska rättssystemet, t.ex. bristen på erforderliga rättsmedel, förblir opåverkade trots de i konventionen uppställda kraven.

  • Expanding the Protection of Children's Rights towards a Dignified Life: : The Emerging Jurisprudential Developments in the Americas

    • The Inter-American Court of Human Rights (IACrtHR) has developed in recent years an innovative jurisprudence that has integrated the entity and extension of States’ obligations regarding children’s rights—as established in Article 19 ACHR—through the evolutive, dynamic, and effective interpretation of the American Convention on Human Rights (ACHR). In fact, by acknowledging the existence of an international corpus juris for the protection of children’s rights, the Court has examined this provision in the light of instruments enshrined within the corpus juris, such as the UN Convention of the Rights of the Child. This process of normative integration was not only limited to the application of international instruments adopted outside of the Inter-American system, but also includes internal references to interconnected rights recognised within the American Convention. Consequently, by analysing the scope of Article 19 ACHR in the light of Article 4 ACHR (right to life) and the corpus juris for the protection of children, the Inter-American Court has further expanded the protection of children’s rights towards the protection of the right to a dignified life. While focusing on the landmark jurisprudence developed by IACrtHR, this paper seeks to unveil the hermeneutical paths undertaken by the regional tribunal in connection with the systemic integration of Article 19 ACHR. In particular, it focuses on the emerging jurisprudential development of positive obligations upon States Members regarding the effective protection of children’s right to a dignified existence.

    • The UN Convention on the Rights of the Child is a human rights treaty adopted by the UN General Assembly in 1989, which has had a major impact on children’s rights, policies and legislation in many countries around the world. This paper describes longstanding experiences of running a Sida-funded training programme on children’s rights at Lund University. The authors have participated in the programme as teachers, and have, over the years, visited around 20 countries and gained deep insights into change processes at different administrative levels of these countries’ education systems. These experiences from similar projects in other countries and continents help put developments in Sweden into perspective. The aim of the present chapter is firstly to gain an understanding of how the CRC can be used to bring about change in schools and in the classroom. The chapter’s secondary aim is to analyse and reflect on, from a norm perspective, how the Convention on the Rights of the Child (CRC) has contributed to bringing about change at different levels of the participating countries’ education systems. The chapter consists of five sections. Each one begins by describing the programme’s background, goal and objective. This is followed by a description of the changes implemented in the participating countries since 2003, which are based in three key CRC perspectives: ’Participation’, ’Protection’ and ’Provision’. The third section introduces norm-theory and the importance of norms in change processes, both in an international as well as as a Swedish context. The fourth section deals with change processes from the local to the national level and can be initiated both from the bottom–up as well as top–down. The final discussion addresses how some school problems, seen from a Swedish perspective, could be discussed in terms of changing norms in areas where children and students are able to exert a degree of influence. The terms “children”, “pupils” and “students” are used variably throughout the text. The Swedish Education Act adheres to the CRC and defines children as “every human being below the age of eighteen years” (the Swedish Education Act 2010:800, Chap.1 §10). Additionally, the student is also defined as “whomsoever participates in education under this act, with the exception of children attending preschool” (the Swedish Education Act 2010:800, Chap.1 §10).

    • The UN Convention on the Rights of the Child is a human rights legal document decided and adopted by the UN General Assembly in November 1989. This international convention has had a major impact on children’s rights, policies and legislation in many countries around the world. Another prominent feature of the development, however, is the lack of research in many areas on implementation of children’s rights. This underline the importance of a book like this with contributions from countries seldom represented with research in their own context. This book has been initiated by researchers at the Child Rights Institute, Lund University, a research network with the aim to act for and support the rights of the child in different contexts, national and international, in research, in education or in other relevant practices. The Institute gather researchers to stimulate and to support new and continued research with a point of departure in the CRC. It provides an open and suitable arena for researchers to publish new material on implementing CRC in society. Invitation of researchers from our global network to contribute to an anthology was therefore fully in line with this ambition.Fifteen new international studies on the enactment of children’s rights in schools and education are presented in this book. The authors are researchers from Colombia, Zambia, Viet Nam, Egypt, India, Kenya, Indonesia and China. They are researchers and scholars active in many different academic environments as research universities (Indonesia, Zambia, China, Kenya, Egypt, and Sweden), teacher training universities (China and India), National University of Education (Viet Nam, Colombia), Institute of Social Work and Health (India), District Teacher Training Institution, DIET (India).

    • This paper proposes a critical analysis of the innovative jurisprudential approaches taken by the Inter-American Court of Human Rights in integrating the content and scope of protection of the human rights of children, in the context of migration processes. How might one provide an effective protection to unaccompanied children that enter irregularly into the territory of a given country, when the safeguards guaranteed at the national level are elusive or inefficient? By focusing on the pioneering jurisprudence developed by the Inter-American Court of Human Rights in recent years, this paper intends to unveil how a systemic integration of children’s rights, under the light of the current international law developments, could provide an effective protection for the rights of children in the context of migration processes. In fact, as a result of an evolutive, dynamic and effective interpretation, the regional tribunal has expanded the scope of protection of the American Convention on Human Rights, by taking into consideration and making known, references to instruments and provisions enshrined within the corpus juris of international human rights law, such as the UN Convention of the Rights of the Child, and—consequently—improving the level of protection of millions of children in the Americas.

    • The aim of this study was to explore community perceptions about child sexual abuse in Tanzania. Thirteen focus group discussions were conducted with adult community members. The core category, children's rights challenged by lack of agency, was supported by eight categories. Aware but distressed portrayed feelings of hopelessness, lack of trust in the healthcare and legal systems reflected perceived malpractice, decreased respect for children's rights referred to poor parental care and substance abuse, myths justifying CSA illustrated cultural beliefs to rationalize child sexual abuse, disclosure threatened by fear of stigma and discrimination aligned the manifestations that prevent disclosure, actions driven by economic circumstances described the economical dependence of victims, urging a change in procedures reflected informants' wish to ally with local governance and pressure groups, and willingness to act indicated the community's role in supporting victims. The study showed how lack of agency calls for efforts to increase children's human rights at all levels.

    • This article reports parental experiences of legally reporting child sexual abuse in Tanzania. Based on in-depth interviews, four types of sexual abuse incidents are portrayed. Each evokes different reactions from parents and the community. An incident characterized as the innocent child was associated with a determination to seek justice. The forced-sex youth elicited feelings of parental betrayal of their child. The consenting curious youth resulted in uncertainty of how to proceed, while the transactional-sex youth evoked a sense of parental powerlessness to control the child because of low economic status. Differentiating between types of sexual abuse incidents may increase awareness of the complexities of child sexual abuse reporting. Education on laws regulating sexual offenses and a functional national child protection system are needed to address child sexual abuse complexities and safeguard the rights of children in Tanzania.

    • FN:s konvention om barnets rättigheter är en internationell överenskommelse, beslutad 1989, som fått stort inflytande på barnpolitik och lagstiftning i många av världens länder. Vi presenterar här några erfarenheter från ett mångårigt utbild-ningsprogram om barns rättigheter inom utbildningssektorn, finansierat av Sida och genomfört av Lunds universitet. Författarna har medverkat i programmet som lärare och har genom åren besökt ett 20-tal länder och fått nära inblick i förändringsarbeten på skilda administrativa nivåer i dessa länders skolsystem. Kunskaper om hur implementering kan gå till i andra länder och världsdelar ger perspektiv på utvecklingen i Sverige.
