    • The rapid development of the law governing the protection of children implies clearly that they are definitely the formable generation of international social construction. Consequently, the legal philosophy of protecting a suspect child must bear several important principles before, during and after the criminal proceedings and should guarantee the demand of law and order. This includes the application of the law within national and international courts. It is therefore of great importance that the fundamental distinctive marks of legal security are clearly presented for a child under suspicion of a crime as well as for the relevant legal system. In a constitutional state as well as in an international sphere, and particularly within the legal areas of criminal law and criminal procedural legislation, law and order is recognized by the effective implementation of the principles of de lege lata, objectivity, proportionality and that any action by a legal authority may be foreseen. Any divergence from such a practice may not only harm the child but also the international community as a whole. In other words, the comparative focus of the law of different nations should have the same consequence in the demand of law and order.

  • The Role of National Legislation in Bioenergy Governance

    • Bioenergy supply chains pass several layers of governance, including both emerging governance mechanisms that specifically address bioenergy and existing regulations, such as environmental codes affecting forestry and agriculture. The sustainability requirements associated with the EU Renewable Energy Directive (EU-RED) is an example of how norms and sustainability priorities in one region can be expressed so as to influence activities in other regions, when actors in these other regions aim to produce for the EU market. Achieving aspirations for developing sustainable bioenergy production systems and supply and value chains requires coordination among actors and parties to ensure that all necessary governance mechanisms are in place and capable of fulfilling the appropriate standards setting, control, governance and assurance roles that are required, collectively. In this paper, the capacity of public governance to promote bioenergy production for the EU-RED market was assessed for thirteen countries in Africa, Asia, and Latin America. Environmental legislation was assessed on how it covers the sustainability requirements included in EU-RED, as well as general sustainability aspects. The countries’ capacities to enforce legislation were assessed by combining globally applicable indexes. While some aspects (e.g., nature protection) were found to be mostly covered well in legislation, other (e.g., wetland protection, GHG emissions) where covered less well. Results indicate that enforcement of legislation can be a challenge in many countries.

    • Homeowners are facing worse personal finances with inflation and increasing interest rates. New groupsare at risk of overindebtedness and foreclosure. The entire household are affected by worse health andwell-being. This leads to large societal costs. Hence, it is imperative to break the negative cycle ofoverindebtedness for these households. Foreclosure is enforced by Kronofogden and aims to pay thedebts. However, an unintended consequence may be that foreclosure is perceived as repressive. Thedegree of repression depends on how Kronofogden handles the proceedings. This research projectcontributes with knowledge about these mechanisms and how they may make it more difficult to breaksocial and economic exclusion by answering the research question: How repressive are the foreclosureproceedings at Kronofogden?We answer the research question by surveying and interviewing homeowners who have been subject toforeclosure about repression. Repression is a multi-facetted concept that may be employed to study bothopen displays of state violence as well as “soft” exercises of public authority through, for example,stigmatization. We are inspired by this latter understanding and We take advantage of a randomizedcontrolled trial (RCT) in which Kronofogden randomized foreclosure sales to auction or brokered sale inan effort to investigate which sales form resulted in higher payment. While auction sales arecharacterized by coercion, no interactions with the homeowner, and no possibility for the homeowner toaffect the outcomes through personal involvement, the success of brokered sales depends oncollaboration with the homeowner, participation on behalf of, and involvement from the homeowner.Given these different characteristics, the RCT provides an opportunity for us to examine whether whichsales form – auction or broker – was employed had an impact on the level of repression as measured byperceived fairness and institutional trust. Due to its characteristics, we hypothesize that brokered saleresults in a lower level of repression. This hypothesis is tested with a survey that targets the foreclosedhomeowners that were included in Kronofogden’s RCT. We also interview homeowners about theirexperiences and group interviews with homeowners to ask them about whether they consider theforeclosure proceedings to be repressive.

  • Regulating Police Body-Worn Camera Practice - A Four Modality Perspective

    • Police authorities in a number of countries have recently introduced body-worn cameras (BWC). With the use of body-worn cameras, the police have gained access to new forms of wearable and powerful law enforcing technologies. The cameras enable collection of large volume of personal information and in some cases even sensitive information that must be managed and stored within the organisation in line with rules of law. As is often the case when technology develops faster than societal norms and values, a range of questions concerning issues related to regulation of these practises are still uninvestigated. Therefore, this paper will analyse what actually regulates individual police officers’ body-worn camera practice. Empirically, we use the Swedish police as a case and our study is based on qualitative interviews. Theoretically we draw upon Lawrence Les-sig’s four modality model - law, norms, market, and architecture - and we conclude that i) law is considered important although law regarding BWC is still in its infancy, ii) while law and official directives have a more macro applicability, norms are developed and maintained more locally, iii) market regulate indirectly via availability and cost, and iv) architecture is not necessarily as self-executed as often stated.

    • Laws concerning compulsory care for alcoholics and drug addicts exist in the great majority of countries, although with great variations in lengths, legal systems, and ambitions. In many countries, compulsory care is the last resort when society doesn't accept to let go of the most severe cases. They suffer often from somatic and mental comorbidity and poor quality of life. At the same time they are also least motivated to accept voluntary help. Professional helpers may feel hopeless about them. There is now a growing body of research concerning evidence-based models for psychosocial rehabilitation of alcoholics and drug addicts. But, what about compulsory care? What do we know from Swedish and international experiences? This presentation concern (1) the international use of compulsory commitment, (2) factors in severe cases that affect motivation to treatment, (3) evidence-based models for psychosocial rehabilitation, and (4) synthesis of research on some factors in compulsory care.

    • Under föredraget kommer Rikard Karlsson att fokusera på ett antal rättsliga frågor som det ökade distansarbetet har gett upphov till. Mer specifikt kommer han att redogöra för rättsliga förutsättningar för att använda digitala verktyg för intern kommunikation. Att kunna kommunicera digitalt är en viktig strategisk fråga för alla myndigheter. Användningen av digitala kommunikationsverktyg innebär att stora mängder personuppgifter och sekretessreglerade uppgifter kommer att behandlas i systemen. Innan nya digitala verktyg införs i verksamheten måste en rad rättsliga frågor beaktas.
