    • The rapid development of the law governing the protection of children implies clearly that they are definitely the formable generation of international social construction. Consequently, the legal philosophy of protecting a suspect child must bear several important principles before, during and after the criminal proceedings and should guarantee the demand of law and order. This includes the application of the law within national and international courts. It is therefore of great importance that the fundamental distinctive marks of legal security are clearly presented for a child under suspicion of a crime as well as for the relevant legal system. In a constitutional state as well as in an international sphere, and particularly within the legal areas of criminal law and criminal procedural legislation, law and order is recognized by the effective implementation of the principles of de lege lata, objectivity, proportionality and that any action by a legal authority may be foreseen. Any divergence from such a practice may not only harm the child but also the international community as a whole. In other words, the comparative focus of the law of different nations should have the same consequence in the demand of law and order.

    • Unga lagöverträdare i social-, straff- och processrätt behandlar det omfattande och till innehållet variationsrika rättsvetenskapliga forskningsområdet gällande misstanke om brott begånget av ett barn eller en ung person. I boken diskuteras om kravet gällande rättssäkerhet i dess traditionella bemärkelse, d.v.s. legalitet, objektivitet och förutsebarhet samt kravet om proportionalitet, kan anses tillgodosedda inom området. I boken behandlas fyra delar av rättsvetenskapen i förhållande till unga lagöverträdare. Dessa delar är socialrätt, förvaltningsprocessrätt, straffrätt och straffprocessrätt. Syftet med att samla relevanta rättsvetenskapliga områden är att skap en rättsdogmatisk ram och därmed bidra till förståelsen av forskningen i ämnet. Frågeställningar kring unga lagöverträdare är ett rättsvetenskapligt område av dynamisk karaktär och med avgörande effekt på juridikens konstruktion och framtid.

    • Researchers have pointed out the association between exposure to alcohol during pregnancy and damage to the foetus. The offspring show an increased perinatal mortality and morbidity rate. Other substances may also cause foetal damage but without any typical adverse effects. Over the years, the issue of widening the scope of the Swedish Substance Abuse Act (LVM) to encompass a protection of the foetus has been discussed. A change in law raises many questions including the conflict of interest between woman and foetus.The purpose of the thesis is twofold. Firstly, to investigate how LVM is interpreted and applied when a pregnant woman is considered for coercieve care and if there is reason to clarify the law's application. Secondly, to discuss the appropriateness of an extension to include explicit protection of the foetus taking into account the handling of the foetus in historical legislation.The legal dogmatic method is used to analyse LVM and its practical application is investigated by analysing case law from county administrative courts.A legal dogmatic approach is also used to look in to the handling of the foetus on decisive points in public administrative law, penal law, civil law, international and constitutional law. A review of the historical law-making is performed to see if this may serve as a complementary way of understanding the conceptual development of the legal person.I find, that a change of LVM would not per se alter the idea of general legal capacity beginning at the moment of birth. A scrutiny of the law as well as the law in action does not prove that it is necessary to extend the coercive law to encompass a protection explicitly of the foetus as an independent ground for coercive measures.A future change of law should focus on optimal care for the pregnant woman, because this would be advantageous for the foetus as well.Based on the study results, I propose changes in existing law to optimize the care in cases of coercive measures.To this effect the content quality and duration of the care and an option for appealing not only of the decision of coercive measures as such but also of the care content should be elaborated further.

    • RESEARCH OBJECTIVE: In this article the research objectives are the rights of children deprivedof liberty and suspected of having committed crimes in international and regional agreements aswell as in Swedish legislations and intended to preserve the child’s dignity.THE RESEARCH PROBLEM AND METHODS: The method applied to study their dignity is, onone hand, in the context of international and regional agreements; on the other hand, in the contextof Swedish legislations, which are relevant to these children.THE PROCESS OF ARGUMENTATION: The argument is whether in Sweden children underthe age of 15 years deprived of liberty and suspected of having committed crimes are treated ina manner consistent with promoting the child’s sense of dignity during the investigation of the crime.These children are of particular interest as they are more vulnerable than adults in the same situation;the spirit of dignity should therefore be more explicitly expressed for them.RESEARCH RESULTS: The research result confirms that dignity is fundamental for the rights ofchildren as expressed in the studied international and regional agreements and, more specifically,in the CRC Articles 37 and 40.CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Swedish legislations still needimprovements to preserve the dignity of children, particularly regarding the rights of children underthe age of 15 deprived of liberty and suspected of having committed crimes.

    • In this article, the #MeToo movement, as a socio-political form of e-discourse (discourse enacted on social media platforms and other types of online channels), will be examined in terms of the effectiveness of its discursive forms and the kinds of effects these have had on social consciousness generally with regard to sexual misconduct in the workplace, and in terms of the cases it has made famous against individuals via “trial-by-social-media,” and their outcomes in people’s lives. The specific cases discussed in this paper are those concerning well-known Swedish and American media personalities, which are assessed within a broad discourse and legal framework. Overall, we conclude that, while movement has had a profound effect on social consciousness, so far it has not impugned the validity of legal systems in countries such as Sweden and the United States.
