    • The online exploitation of copyright-protected content frustrates its effective enforcement. This is because the global reach of the internet stands in stark contrast to the territoriality principle of international copyright law, whereby each State determines whether and the extent to which content is protected within its own territorial borders. When protected content is exploited online, it has the potential to infringe in every State where the content is accessible. This poses a challenge for private international law because its rules are based on localizing connecting factors within a geographical territory. These rules can be difficult to apply in an online copyright case because the infringement can be ubiquitous. This chapter describes how the European Union (EU) rules on jurisdiction and applicable law apply to online copyright infringement cases and analyzes whether the Court of Justice of the European Union’s (CJEU) interpretations of these rules fulfil the underlying objectives of private international law. Lastly, the chapter provides some perspectives for the future.

  • A Case of Contested Cremains Analyzed Through Metric and Chemical Comparison

    • Since the 1980s, cremation has become the fastest growing area of the U.S. funeral industry. At the same time, the number of litigations against funeral homes and cremation facilities has increased. Forensic anthropologists are often asked to determine whether the contents of an urn are actually cremated bone, and to address questions regarding the identity of the remains. This study uses both metric and chemical analyses for resolving a case of contested cremains. A cremains weight of 2021.8 g was predicted based on the decedent's reported stature and weight. However, the urn contents weighed 4173.5 g. The urn contents also contained material inconsistent with cremains (e.g., moist sediment, stones, ferrous metal). Analysis using XRD and SEM demonstrated that the urn contained thermally altered bone as well as inorganic material consistent with glass fiber cement. Although forensically challenging, cremains cases such as this one can be resolved using a multidisciplinary approach.

  • Sexual dimorphism in frontal bone roundness quantified by a novel 3D-based and landmark-free method

    • In this study we present a novel and landmark-free method for quantifying shape differences between male and female frontal bones. CT scans were recorded for 80 male and 80 female Turkish hospital patients, age 25-40. The frontal bones were first isolated from the 3D models by digital cutting along the bordering sutures, and then aligned to a CAD-based sphere. This allowed us to quantify the amount of frontal bone overlapping with the sphere (on average 43.2 +/- 6.5% for males and 33.9 +/- 6.6% for females, the difference is significant at p < 0.0001), and to identify areas of shape difference and deviation from the sphere surface in male and female bones. The larger proportion of spherical frontal bone surface in males challenges the common description of the female forehead as rounder''. Based on the overlap data, we developed discriminant functions able to correctly classify 77.5% of the frontal bone models as male/female. This demonstrates that 3D-based and landmark-free approaches to statistical shape analysis may become a viable alternative to the currently dominating landmark-based approaches for shape investigation.

    • The essay discusses the liquid spatiality that characterizes the activities of the pirate, the juridical liquid space that is created in his or her wake, and reactions to pirate activity that in various ways attempt to territorialize the open sea. The essay also considers the ways in which the activities of modern pirates affect the relationship between the juridical and the political. The focus is on legal, cultural, and political relationships between activities and spatialities, and in particular on the relationship between solid and liquid states. Although the perspective is mainly that of intellectual history, the essay also discusses some recent historical events, in particular the legal processes against the Swedish file-sharing site The Pirate Bay.

    • The objective of the dissertation is to examine national legal issues arising with the enactment of emissions allowances, electricity certificates and other similar trading objects. Several of the issues identified in this dissertation have their origins in the same problems that arose with the enactment of the legislation regarding promissory notes in the 1910’s and the legislation concerning the digitalization/dematerialization of financial instruments in the 1980’s. Simply stated, the fundamental problem is what has the legislator created? The dissertation’s interdisciplinary character has facilitated an approximation of issues that have arisen, which would not have been possible through studies solely of individual legal areas. This method has proven itself to be particularly relevant as new legal figures are introduced in an existing legal system. A starting point for any study of the trading object is that it is an independent legal object, separate from any authorization to emit, etc. This means that the trading object does not consist of any right to act in a certain manner (emit, etc.). A legal classification of the trading object has shown itself to be difficult to achieve within all of the studied legal areas. The private law conceptual apparatus and its categorizations of property have been debated in this dissertation from different perspectives. How the economic value of the trading object is treated in a legal context has shown itself to be dependent upon which legal context is intended, and how the trading object is classified in this context. The trading object’s private law character and its ability to be owned has certain significance for the accounting, income, and VAT law classifications of the trading object. The legal classification of the trading objects raises, to a great extent, a general and fundamental classification problem

  • Cultural Universals and Cultural Differences in Meta-Norms about Peer Punishment

    • Violators of cooperation norms may be informally punished by their peers. How such norm enforcement is judged by others can be regarded as a meta-norm (i.e., a second-order norm). We examined whether meta-norms about peer punishment vary across cultures by having students in eight countries judge animations in which an agent who over-harvested a common resource was punished either by a single peer or by the entire peer group. Whether the punishment was retributive or restorative varied between two studies, and findings were largely consistent across these two types of punishment. Across all countries, punishment was judged as more appropriate when implemented by the entire peer group than by an individual. Differences between countries were revealed in judgments of punishers vs. non-punishers. Specifically, appraisals of punishers were relatively negative in three Western countries and Japan, and more neutral in Pakistan, UAE, Russia, and China, consistent with the influence of individualism, power distance, and/or indulgence. Our studies constitute a first step in mapping how meta-norms vary around the globe, demonstrating both cultural universals and cultural differences.

    • Study objective: Femoral nerve blockade is a regional anesthetic procedure that may be used in prehospital and emergency settings in cases of femoral trauma. Its speed and performance depend on how well the puncture site can be accurately located, something that usually is achieved via visible landmarks and/or by combining various universal preestablished measurements. Most of these methods have been derived from cadaver studies, which often suffer limitations in clinical settings. To facilitate a quick and easy determination of the puncture site, we here attempt to find an in vivo anthropometric measure that closely corresponds to the distance between the femoral artery and femoral nerve.Design: This is a prospective observational study.Patients: The study includes 67 patients presenting for elective surgery.Measurements: The distance from the femoral nerve to the femoral artery, projected to the skin, was measured by a 13-MHz ultrasonographic linear probe. Anthropometric measurements of the width of the hand fingers were carried out at the distal interphalangeal joints.Results: The distance from the femoral artery to the femoral nerve projected to the skin was found to closely correspond to the width of the fifth finger of the dominant hand measured at the distal interphalangeal joint.Conclusion: Because it relies on individual anthropometric information, this finding offers an individualized approach to determining the puncture site in a given patient. We believe that such an approach can improve and simplify femoral nerve blockade procedures in prehospital and emergency settings.

Vidare analyseras möjliga principkonflikter, i den nyss nämnda situationen.
