  • The Obligation and Sensitivity of Administrative Independence under EU law: Time for an updated Toolbox?

    • To efficiently ensure that EU law will have an impact on the national level, the EU is dependent on the loyal cooperation of national administrative authorities, which has been described as a distributed administration. To further this, the CJEU has developed certain responsibilities flowing from EU law ensuring that national administrative authorities will give full effect to EU law within their respective areas of responsibility. This includes a responsibility that in many states would be otherwise reserved for courts – namely, to disapply national legislation when it conflicts with requirements under EU law. In this post, which is based on our recently published article ‘Administrative independence under EU law: Stuck between a rock and Costanzo?’ in European Public Law, we will illustrate how this may create a tension between the hierarchical structure of Member State administrations on the one hand, and the mandates and responsibilities provided to administrative authorities on the other. It may force a subordinate administrative authority to override their own government. Similar to courts, national administrative authorities thus have the invidious position of serving two masters at once, while not enjoying the same structural or legal independence towards the national government.

    • Genom de lagändringar i föräldrabalken som började gälla den 1 juli 2021 har barn fått en stärkt rätt att komma till tals och få sina åsikter beaktade och dokumenterade i frågor om vårdnad, boende och umgänge. Detta är ett tydligt genomslag av barnkonventionens artikel 12 och är samtidigt en förutsättning för att barnets bästa i frågan ska kunna bedömas. Numera har barn rätt att framföra åsikter i en vidare bemärkelse än att bara uttrycka en viss vilja eller inställning. Barn ska pratas med, för att frågorna ska kunna utredas, konstaterar Maria Forsman i sin analys av de nya reglerna.

    • Jämställdhet är utan tvekan en systembärande idé för rättvisa och hållbara skatter. Problemet är att många skattelagar, under rådande skatteideologi, bidragit till att befästa och fördjupa den ekonomiska ojämställdheten. Det är dessutom svårt att se en förändringspotential så länge som vetenskapliga förgivettaganden och försanthållanden om skatternas funktion i samhället utesluter principiella övervägande om relationen mellan skatterättvisa och jämställdhet. I den här krönikan är avsikten att visa på dolda jämställdhetsproblem i svensk skatterätt som vi i kontexten av kris och behovet av hållbara skattebaser inte längre kan ignorera. Den här krönikan  bygger till stor del på den forskning som bedrivits inom Horisont 2020-projektet Revisioning the ‘Fiscal EU’: Fair, Sustainable, and Coordinated Tax and Social Policies (FairTax).

  • Expanding the Protection of Migrant Children's Rights in the Americas. Judicial Integration of Regional Human Rights Standards

    • The focus of this research brief is to propose a critical analysis of the judicial interrelation (and potential cross-fertilization) between international and regional human rights systems, with particular focus on the effective recognition of asylum-seeking children’s rights within the Inter-American system. In this sense, this study intends to make a contribution towards the better understanding of the emerging role that regional systems have (or could have) in reinforcing and guaranteeing the effective enjoyment of human rights of children in the context of migration processes. It focuses on the pioneering jurisprudence developed by the Inter-American Court of Human Rights in the past years, which has developed an evolutive, dynamic and effective interpretation of the American Convention on Human Rights, under the light of the systemic integration of international human rights law. As a result of this innovative method of interpretation, the regional tribunal has reinforced the interpretational guiding value of various provisions of the UN Convention on the Rights of the Child, paving the way for the enhancement of the level of protection of millions of children in the Americas and expanding States’ positive obligations in relation to them.

  • Gender Equality and Taxation - International Perspectives

    • The National tax laws and international tax policies have, despite impressive growth performances in many economies, worked against economic gender equality. The broad concept of tax fairness has become equivalent to what is good for economic growth and detached from social justice, leading to increasing income gaps and poverty. As a result, many aspects of taxation have indirectly had a substantial effect on gender-related socio-economic inequalities even though most domestic tax laws being gender neutral. The ignorance to consider gender inequalities, when designing tax laws, is obviously in conflict with several legal obligations and policies, on national, regional and international levels. In this paper, novel insights concerning the relationship between gender equality and taxation are presented. These insights have been pushed forward by both the societal challenges of financial crisis and now the pandemic crisis. Based on legal and economic perspectives, the anlysis in the text provides an overview of gender aspects within taxation when related to current tax policy trends.

  • Foreseeability and the rule of law in data protection after the PNR judgment

    • In the following, we reflect on the Passenger Name Record Directive (PNR Directive), as recently interpreted by the Court of Justice of the European Union (CJEU) in the Ligue des droits humains judgement, from the perspective of the aforementioned postulates concerning the rule of law. The CJEU was requested to respond to a number of pertinent questions regarding the asymmetry of powers provided by the PNR Directive in relation to individuals, whose personal data and privacy are at stake by the processing of PNR data. In this contribution, we will focus specifically on how the Court addressed the problem of foreseeability of measures established under the PNR Directive. We argue that the Court shared the concern about the PNR system’s compliance with the rule of law, but failed to provide conclusively guidance on what minimum criteria to demand of the quality of the law that governs modern security measures.
