- Parenthood, from a legal perspective, has always been perceived as a rather unambiguous concept in Swedish legislation. It is the biological parent of a child who should be given legal status as parent and thereby also all the rights and duties of a parent.In the first part of the thesis examines some of the reasons for studying the legislation concerning parenthood. The laws regulating the relationship between parent and child originate from laws enacted at the beginning of the twentieth century. One hundred years later, changing family patterns and the development of different techniques for assisted reproduction are only a few of the factors that puts legislation concerning parenthood in a new light. Of even greater importance is a changing view of the child and the ambition to always put the interests of the child first. It is submitted that the regulation concerning the attainment of legal status as parent must be re-examined, like any other legislation concerning children, in view of the best interest of the child.The second part of the thesis examines the grounds for legal status as parent according to applicable Swedish laws. Particular attention is given to the question of the extent to which biological kinship can be replaced as the basis for legal status and the reasons behind this. The third part of the thesis analyses the legal construction of parenthood. The various interests of parent and child that are met by the present legislation are clarified, in particular the interests of the child in this context. It is concluded that the child has several interests that should be satisfied when establishing legal status. A question discussed in this part of the thesis is whether it is possible to satisfy the child's various interest in this context, independently of one another and without having to change the child's legal family status.The fourth and final part of the thesis discusses legal parenthood and how the legislation could be formed in order to protect the interests of the child in a more effective manner than today. It is argued that the legal regulation of parenthood needs to be more flexible, allowing for the various interests that the child has in connection with parenthood to be met independently of one another. This means that there might be a need to let go of biological parentage as the model for legislation on parenthood. A child perhaps needs not two but several parents during childhood.

Surrogacy Arrangements and Legal Parenthood : Swedish Law in a Comparative Context

- Surrogacy arrangements have become an increasingly popular way for childless people to build a family. Yet many jurisdictions do not regulate surrogacy. Even in the ab-sence of surrogacy regulation, if a jurisdiction has no specific legal rules that clarify parenthood following surrogacy, the result is often uncertainty in relation to the legal parental status of the surrogate mother, her spouse or cohabitant, any possible donors, and the commissioning parents. This, in turn, leaves the surrogate-born child’s family law status uncertain. This thesis examines the legal aspects of parenthood and how it is, or could be, determined in Sweden following surrogacy arrangements. Important aims are to estab-lish whether the current national laws regulating family law can sufficiently protect the interests of the surrogate-born child and the parties to surrogacy arrangements, with an emphasis on interests connected to family law status; to examine the ways in which other jurisdictions (England and Wales, and Israel) have responded to similar issues; and to identify problems and propose alternative solutions in relation to the specific issue of establishing legal parenthood following surrogacy at a domestic level, either with or without State regulation of surrogacy agreements. Consideration is given to whether it might be appropriate to re-evaluate or qualify the existing presumptions of parenthood, in particular the unwritten presumption of maternity. Several alternatives for the transfer of legal parenthood from the surrogate mother, and her spouse or cohabitant as the case may be, to the commissioning parent or parents are also examined. In addition, the ethical implications of surrogacy ar-rangements are explored in order to provide an insight into the way in which subcon-scious or hidden values might make it difficult for a State to regulate certain areas of private life such as parenthood. The starting point for the thesis is that it is in the best interests of the child to have parents at birth and that this interest must be prioritised over an intended parent’s interest in becoming a parent. This view is based on and is consistent with existing Swedish law and policy.

Preskription av äktenskapets rättsverkningar?

- Ett äktenskap medför flera rättsverkningar. Av stor praktisk betydelse är giftorätten, som innebär att nettovärdet av det sammanlagda giftorättsgodset delas lika mellan makarna vid äktenskapets upplösning. Äktenskapsbalkens regler ger därtill en make med störst behov rätt att vid äktenskapets upplösning överta den gemensamma bostaden. Det finns dock inga regler om frister inom vilken tid efter upplösningen av ett äktenskap som ett anspråk på bodelning eller övertagande av bostad ska framställas. Rättigheter av ekonomisk respektive social karaktär grundade av äktenskap träffas inte heller av reglerna om tioårig preskription av fordringar. På senare tid har det visat sig att faktumet att några av de rättigheter som ett äktenskap grundar inte preskriberas kan ge upphov till problem, dels på grund av den tid som kan förflyta från det att rättigheten uppstått till dess att den utkrävs, dels på grund av den okunnighet som förefaller finnas såväl bland folk i gemen som hos jurister rörande dessa rättigheters innebörd och bestånd. Med utgångspunkt i tre rättsfall analyseras och utvärderas rättsläget. Sammantaget finner vi att det finns goda skäl för att införa en preskriptionstid.
