    • In this article, the #MeToo movement, as a socio-political form of e-discourse (discourse enacted on social media platforms and other types of online channels), will be examined in terms of the effectiveness of its discursive forms and the kinds of effects these have had on social consciousness generally with regard to sexual misconduct in the workplace, and in terms of the cases it has made famous against individuals via “trial-by-social-media,” and their outcomes in people’s lives. The specific cases discussed in this paper are those concerning well-known Swedish and American media personalities, which are assessed within a broad discourse and legal framework. Overall, we conclude that, while movement has had a profound effect on social consciousness, so far it has not impugned the validity of legal systems in countries such as Sweden and the United States.

    • This papers analyses the main contents of the Finland Constitution and the Judiciary. Finland Constitution is the basis of all legislation. It exercises of government power, and it details the fundamental rules, values and principles of Finnish democracy. According to the Constitution, judicial power lies with independent courts of law. The courts are independent: they are bound only by the law in force. Finnish procedural law has been both internationalized and constitutionalized since the 1990s and the result of court proceedings plays a more significant role for the parties.

    • Human rights/ human considerations have started to carry more weight nowadays, especially in enforcement matters. Both rehabilitative and social aims in legal matters have been strengthened during recent decades. At the same time, increasingly intensive instruments to handle artificial arrangements and fraudulent debtors have emerged. Thus, the question arises whether the enforcement system embodies a creditor-biased or a debtor-biased framework. The present article debates this question in the context of Finnish legislation, focusing on two perspectives of the Finnish enforcement system: How are debtors protected? How can we ensure that the enforcement is efficient?

    • Sia in Svezia che in Finlandia (Paesi appartenenti all’area legale scandinava) esistono tre gradi di giurisdizione. Dopo un primo appello è consentito, a certe condizioni, un secondo appello dinanzi alla Corte suprema di entrambi gli ordinamenti. Si osservano le regole contenute nel c.p.c. svedese del 1948 (quale ripetutamente modificato negli ultimi anni, segnatamente nel 2008) e nel c.p.c. finlandese, anch’esso oggetto di incisive riforme (sin dal 1993) volte a migliorarne, come in Svezia, la efficienza e ad introdurvi l’uso delle nuove tecnologie. Il legislatore ha previsto in ambedue gli stati l’istituto del c.d. permesso per appellare, che subordina l’accesso al giudice superiore (inclusa la Corte suprema) ad una autorizzazione preventiva variamente modulata. La fisionomia dell’appello è quella di un giudizio diretto a riesaminare la decisione emessa nel grado inferiore e non a permettere lo svolgimento di una ulteriore fase del giudizio (attraverso l’assunzione di nuove prove): se in Svezia questo modello si è definitivamente consolidato, diversamente accade in Finlandia, dove esistono ancora forti resistenze che riflettono la tradizionale preoccupazione dei finlandesi per i diritti processuali delle parti.

  • Plea Bargaining as an Example of the Recent Changes in the Finnish Criminal Procedural Paradigm

    • In Finland, a government bill on plea bargaining is now at the parliament. In Estonia, Norway, Denmark, Germany and Latvia they have adopted similar systems already. In Sweden and Iceland plea bargaining is not possible. As a procedural instrument, plea bargaining is something quite new in Europe, and in the Baltic and in the Nordic countries. How does it fit into our systems and into our way of thinking? If we look at the current trends in criminal proceedings fairness, procedural justice, conflict resolution, negotiated law, pragmatically acceptable compromise, procedural truth, party autonomy, court service, communication and interaction are good examples of the topics which are currently being discussed. All these examples indicate that the criminal jurisdiction has become more communal. It has even been said that criminal proceedings have recently become closer civil proceedings, which seems to be quite true. Still, efficiency plays a major role in European adjudication thanks to economic crisis and lack of resources. How to understand the role of plea bargaining in this set? At least the legislator has pointed out the efficiency, the appropriate allocation of resources and the simplifying the criminal proceedings when suggesting adopting the plea bargaining in Finland. The novelty has not been put into philosophical context or into the systemic context of criminal proceedings. It looks like the legislator adopts some single instruments from the foreign legal orders if they seem to fit well into legislators’ puzzle to intensify the proceedings and to save the state money. However, there seem to be more coherent trends behind all of that as well – namely, the change of paradigm

In this chapter, the concepts and dimensions of sustainability are discussed first. This is followed by a description of the way in which sustainability fits in with the East-Nordic theoretical context of Scandinavian realism. Before the conclusions, the contemporary procedural paradigm is discussed from a sustainability perspective.

    • In this article, it will be discussed how the EU Directive on Representative Actions for the Protection of the Collective Interests of Consumers will affect the East-Nordic countries. In this context, Finland and Sweden are compared. Special emphasis is placed on the current problems concerning class actions vis á vis access to justice and how the new EU Directive will possibly solve the experienced deficiencies. Additionally, the more general perspective on problems in access to justice will be studied from the class-action point of view. Thus, one of the research objectives of this paper is to evaluate whether the current scope of class actions at the national and EU levels is satisfactory and whether there is still space for improvement and additional development at both the EU and national levels.
