    • The Swedish Network for European Legal Studies is happy to announce the third volume in this series of annual publications which acts as a forum for the publication of studies on European law by Swedish scholars. The annual this year focuses on competition aspects of Intellectual property law, and contains peer-reviewed articles aimed at spreading Swedish legal research on European law to a wide international audience. The articles in the volume are concerned with European law, its development, impact and reform. Furthermore they are original, analytical contributions to doctrinal debates and questions, by legal researchers mainly, but not exclusively, connected with the Swedish universities.

    • Abstract in UndeterminedThe Nordic countries have been slow EU integrators. Some of them are not even members of the Union. Little does it matter. Competition law has been at the forefront of the vivid Nordic academic debate for years. A result: The establishment of a solid network among researchers at the Nordic universities.In 2012 the Network came together in Lund, Sweden to address how trade and development is affected by dynamic, rather than static competition. This area has been topical for some years now and is especially active at the crossroads between competition and IPR legislation. Currently some ten Nordic PhD students are addressing this matter from different perspectives.In this book senior researchers take a look at this dialogue and discuss the matter from a number of perspectives in the search for a workable balance. Is it all just a question of giving priority to competition law in case of conflict? How does the Technology Transfer Regulation fit into the picture and has it done its job and achieved its objectives with respect to trade in goods? Do similar types of problems appear in the provision of services?From this more general helicopter approach the contributors also address some specific and current concerns like price squeeze in the telecom service sector and standardization in the computer technology field. The contributors also cover developments in the health care industry, which constitute matters of concern to all, especially in relation to generic competition and conflicts with applicable pharmaceutical legislation. The question of who controls “follow on inventions” in the licensing arena is of common interest and a matter of crucial interest for any technology transfer activity and therefore deserves special attention.The contributors to this book are all leading competition law researchers in the Nordic countries. The book ends with a forward looking chapter by an EU Commission official (of course, acting in his own capacity) from a regulatory perspective who discusses the future of the EU dynamic process as expressed in the Europe 2020 Strategy.

  • Protecting and transferring biotech inventions

    • The 2002/2003 joint masters students’ efforts deal with the general protection of inventions covering such issues as the concepts of industrial application, novelty and inventive step. The students are also i.a. taking a closer look at university inventions and biotechnology aspects such as the cloning of humans, patentability of stem cells, germ line intervention and animal suffering. The discussion on protection also made them investigate how biotech inventions can be transferred through licensing arrangements and the different types of provisions contained in a licensing agreement.

  • Sustainable technology transfer

    • There are more than eighty international agreements and many additional programmes dealing with technology transfer. Moreover, several international conventions require that aid programs, both to address acute emergencies and to assist in the longer-term building of viable infrastructures, be undertaken in specific and concrete ways. However, problems inevitably arise when good intentions are put to the test, particularly in connection with rights to the ownership of intellectual property assets. Some even claim that it is only when IPRs are respected that sustainable support can be expected. To examine the existing status of international law in this important area – and to offer recommendations for potential improvements and solutions – the Faculty of Law of Lund University hosted a conference in Vietnam in October 2010 on the subject of sustainable technology transfer from developed countries to developing countries. Focusing on the legal problems which sustainable technology transfer may give rise to and how they may be addressed – and with emphasis on health, environment, energy, and climate change – this book summarizes the most important findings of that conference. Twelve penetrating essays by fourteen distinguished European, American, and Asian legal scholars address the questions of what is required to satisfy existing international obligations and to what extent developing countries may use flexibilities in international conventions to advance their own development. The essays are concerned with such issues and topics as the following: - the major institutions and players in the formulation and enforcement of rules affecting technology transfer; - the real-world value of legislative enactments in the area; - a factual account of actual technology transfers; - to what extent competition rules offer developing countries a way to escape the more severe consequences of undertakings they have accepted; - the impact of compulsory licensing; - the potential effect of the Anti-Counterfei ting Trade Agreement of 2010 (ACTA); and - specific conditions pertaining to conser vation of biodiversity, climate change and energy. Included are thorough analyses of the obligations and flexibilities expressed in numerous international conventions – including the TRIPS Agreement, the Convention on Biological Diversity, and the UN Framework Convention on Climate Change – as well as how these obligations and flexibilities function in practice. The book concludes with a view from a developing country perspective and forwardlooking statements issuing from a heightened awareness of the role that technology transfer might play, if properly deployed, in the development of the disadvantaged countries of the world. Although few will argue with the Millennium Development Declaration’s affirmation that those who benefit least deserve help from those who benefit most, disagreement continues over crucial details such as how technology transfer should take place and the role of the law in facilitating it.

    • Boken fångar in den nya utveckling som varumärkesrätten genomgår till följd av förslag om ny lagstiftning, men också till följd av den explosiva utveckling som sker på EG-planet. Den som för några år sedan uppfattade varumärket som en begränsad monopolrätt för att ange varors ursprung måste nu acceptera att helt nya vindar blåser, som medför att det mesta går att registrera och att skyddet förstärks. Studenterna presenterar i sina uppsatser viktiga nyheter och kortfattade och kärnfulla slutsatser. Hittillsvarande praxis skärskådas. Svensk lagstiftning ställs mot alla de direktiv, förordningar och meddelanden som EG i en febril takt producerat under de senaste åren. Nationell rättspraxis kontrasteras mot EG-domstolens domar. OHIMs praxis från besvärsnämnderna har följts upp i förstainstansen och nu senast genom EG-domstolens förvånande inbrytning i Baby Dry-målet. Konsumtions- och licensfrågor blir också föremål för en tvärvetenskaplig betraktelse. De korta och kärnfulla uppsatserna speglar varumärkesutvecklingen och ger på ett lättillgängligt sätt en uppfattning om en utvecklingen, men också de problem som följer i fortspåren av förändringarna.

  • Transferring technology to developing countries

    • In 2003/2004 the Masters of European Affairs Programme looked at IPRs and the relationship between developed and developing countries as it pertained to technology transfer, and specifically the TRIPS Agreement. They addressed three crucial issues: Can the rules on international exhaustion of IPR provide the means to transfer essential medicines to developing countries? Having determined that exhaustion was not the answer, the masters looked at possibilities of compulsory licensing in emergency situations, and how it has been exercised by developing countries. Included is a section looking at the treatment of indigenous peoples and their traditional knowledge and the biological and genetic resources. Finally the question how the 1992 Convention on biological diversity is related to the TRIPS agreement and a closer look at how disputes under the WTO settlement system are resolved.
