  • Spillover or activist leapfrogging? Criminal Competence and the Sensitiveness of the European Court of Justice

    • The law concerning the choice of legal basis representsan important constitutional development in Communitylaw. The European Court of Justice (ECJ) has throughits case-law shaped and defined the boundaries betweenthe European Union and its Member States and betweenthe actors involved in the lawmaking process of the EuropeanUnion. This article is based on three levels ofanalysis of this case-law. It argues that a “sensitiveness”reading of four high-profile cases on the choice of legalbasis and Community internal and external competencecould help explain these cases as well as more recent legaldevelopments. The four cases, Titanium Dioxide, Waste,Tobacco Advertising and Environmental Crimes, were ruledupon in different time periods and exemplify differenttypes of competence battles. According to this analysisthe Environmental Crimes case from 2005, which highlightsthe division of competence between the pillars andthe supranational and intergovernmental elements of theEuropean Union, is neither a result of spillover, nor activistleapfrogging between pillars. In contrast, it shouldbe read in the light of the unison will of the MemberStates as pronounced in a Treaty change, not necessarilyyet in force. Arguably, such a rule of sensitive interpretationfalls within the ambit of the current Treaties, althoughseeking guidance in changes not necessarily yet in force.
