  • Personlig assistans - en arbetsrättslig limbo
  • 2017
  • Ingår i: Arbetsmarknad & Arbetsliv. - Arbetsmarknadsstyrelsen och Arbetslivsinstitutet. - 1400-9692. ; 23:3, s. 24-24

  • 2019
  • Ingår i: Svensk juristtidning. - 0039-6591. ; :3, s. 165-169

  • Citizenship, Migration, and Social Integration in Sweden: A Model for Europe?
  • 2007
  • Ingår i: CERIS Working Paper No.52, January 2007, Toronto, Canada.. ; :52, s. 73
  • Forskningsöversikt (populärvet., debatt m.m.)abstract
    • Transnational migration has been a constant element of human existence. Admission andintegration of migrants has, in time, become an increasingly important element of decision-makingpolicies in many nations. Classifications of voluntary and involuntary migrants according to theirreasons for migrating and the socio-economic and political reasons for the acceptance of suchindividuals by the receiving countries have been the object of numerous national and internationalpieces of legislation. This has served to underscore the importance of belonging for all partiesinvolved: both migrants (more or less welcome in their adoptive countries) and states alike. In aformal sense, the ultimate signal of unlimited acceptance remains the granting of citizenship byhis/her new country to the “adoptee-resident.” Only citizens normally enjoy an unconditional rightto live and reside without restrictions in a given country. Traditionally, this ultimate form ofacceptance was (mutually) exclusive, which, for a long time, made it practically impossible for aperson to be a citizen of more than one state. Gradual globalization and an unprecedenteddevelopment of the very concept of citizenship, from a horizontal, national perspective to anemerging vertical, supra-national level (consider, for example, the concept of EU-citizenship andthe special case of the Nordic states), required, at some point, a redefinition and re-evaluation of theconcept of citizenship, in both formal legal and more informal terms. This paper examines thisredefinition and re-evaluation within the context of Sweden.

  • The evolving EU regulatory framework for precision breeding
  • 2019
  • Ingår i: TAG Theoretical and Applied Genetics. - Springer Verlag (Germany). - 0040-5752 .- 1432-2242. ; 132, s. 569-573
  • Forskningsöversikt (refereegranskat)abstract
    • Plant breeding has always relied on progress in various scientific disciplines to generate and enable access to genetic variation. Until the 1970s, available techniques generated mostly random genetic alterations that were subject to a selection procedure in the plant material. Recombinant nucleic acid technology, however, started a new era of targeted genetic alterations, or precision breeding, enabling a much more targeted approach to trait management. More recently, developments in genome editing are now providing yet more control by enabling alterations at exact locations in the genome. The potential of recombinant nucleic acid technology fueled discussions about potentially new associated risks and, starting in the late 1980s, biosafety legislation for genetically modified organisms (GMOs) has developed in the European Union. However, the last decade has witnessed a lot of discussions as to whether or not genome editing and other precision breeding techniques should be encompassed by the EU GMO legislation. A recent ruling from the Court of Justice of the European Union indicated that directed mutagenesis techniques should be subject to the provisions of the GMO Directive, essentially putting many precision breeding techniques in the same regulatory basket. This review outlines the evolving EU regulatory framework for GMOs and discusses some potential routes that the EU may take for the regulation of precision breeding.

  • The Swedish policy approach to directed mutagenesis in a European context
  • 2018
  • Ingår i: Physiologia Plantarum. - Wiley: 12 months. - 0031-9317 .- 1399-3054. ; 164, s. 385-395
  • Forskningsöversikt (refereegranskat)abstract
    • This review describes the Swedish approach to directed mutagenesis in plants and puts it in a comparative European perspective. Directed mutagenesis is accomplished by a number of genome editing techniques; however, the legal status of these techniques and their resulting products is uncertain in the European Union (EU) as there is no political consensus on whether or not these should be regulated as genetically modified organisms (GMOs). A number of cases have developed over the past few years, putting the GMO regulatory framework to the test. These include oilseed rape developed by oligonucleotide-directed mutagenesis, Arabidopsis developed by clustered regularly interspaced short palindromic repeat-Cas9, and the case on mutagenesis for which the French Court requested a preliminary ruling from the Court of Justice of the EU. In this review, the involvement of the Swedish Government and governmental authorities in these cases is described and compared with that of other EU member states and/or EU entity statements and reports. Various approaches to the definition of recombinant nucleic acids are also discussed, as this is crucial for the EU GMO definition thus affecting the legal status of products developed by directed mutagenesis.

  • The Pricing of Financial Instruments in Tax Disputes
  • 2019
  • Ingår i: Derivatives & Financial Instruments. - IBFD. - 1389-1863. ; 21:2
  • Forskningsöversikt (övrigt vetenskapligt)abstract
    • The pricing of uncertainties, when establishing the market value of financial instruments, is problematic in taxlitigation since the outcome of the litigation is binary. Different values can be equally correct, depending on thechoice of models, assumptions regarding model parameters and forecasting techniques. The purpose of thisarticle is to illustrate the challenges for tax administrations and courts in terms of the need and ability to priceuncertainties in the market valuation of financial instruments. The authors illustrate the complexities with a casebased on a publicly traded instrument, which gives a lower limit of the uncertainty associated with valuation. The authors then problematize the valuation of over-the-counter traded and non-publicly traded instruments, which, due to uncertainty, tends to create leeway for tax arbitrage. This illustration shows the necessity to furtherunderstand the manner in which courts reason, the dependency on experts and the use of models.
