    • Legal research in Sweden has traditionally focused on a systematization of the legal rules and their practical application, while the task of studying the effects of the application of the laws has been handed over to other branches of the social sciences. In contrast, new legal theories focusing on proactive and therapeutic dimensions in law have gained increasing attention in the international arena. These approaches may be better suited for evaluating legislation governing compulsory psychiatric care. Theoretical discussions and studies of causal mechanisms underlying criminal behaviour, as well as the implementation and value of instruments for predicting behaviour, are relevant to contemporary criminological research. Criminal behaviour varies across different groups of perpetrators, and the causes can be sought in the interplay between the individual and social factors. Multi-disciplinary efforts, integrating research from forensic psychiatry, psychology, sociology, and criminology, would be beneficial in leading to a better understanding of the causes underlying criminal behaviour.

    • Gun violence is a serious issue in many countries across the globe. It has been shown that there is an elevated risk for a further shooting nearby within a short time span of a shooting incident, so-called near-repeat patterning. The present study presents new evidence on near-repeat patterning in Sweden, with a focus on neighbourhoods which the police have labelled as ‘vulnerable’ – deprived neighbourhoods where criminal networks have a large impact on local communities. Such neighbourhoods tend to have open drug markets, and to have high levels of gun violence. The present paper analyses the association of open drug markets and vulnerable neighbourhoods with gun violence and near-repeat patterning of gun violence in two Swedish cities. Our findings suggest that gun violence is strongly concentrated on open drug markets in vulnerable neighbourhoods, and that those locations in addition exhibit high risks for repeat shootings after an initial shooting event. We propose that the police can use this knowledge to improve practices to prevent or disrupt gun violence.

    • Twenty years ago, the Swedish National Council for Crime Prevention presented a report that highlighted serious problems with regard to identifying, investigating, and sentencing offenders for hate crimes. The same problems have also been described in international research from several other countries. Since then, several measures have been taken to remedy these problems, but it remains unknown whether these measures have been successful. The aim of the present study is therefore to trace developments over time, using Sweden as a case study, and to evaluate the extent to which the problems identified earlier have been remedied. The results show that the problems identified by the Swedish National Council for Crime Prevention still remain despite a continuous process of reform. Theoretical links and parallels to international research are discussed throughout the article.

    • This article is based on a two-year research project, ‘The Best Interests of the Child – From Words to Deeds’. The aim of the article is to present and highlight findings on the discrepancy between the policy of the ‘best interests’ principle and its implementation in the asylum application procedures at the Swedish Migration Board. There is a clear ambition to implement the principle of the best interests of the child in the Swedish asylum process. The Swedish Aliens Act and policy documents call for authorities and courts to give due weight to the best interests principle, mainly by taking children's own experiences into account and by analysing the potential impacts of the Board's decisions in individual cases. However, several discrepancies between words and deeds were identified. Firstly, children were not heard to the extent expected in light of the Swedish legislation, and the children's individual grounds for asylum were seldom addressed in interviews with them. Secondly, children's responses were not taken seriously in the assessment of asylum claims. Finally, the ‘best interests’ paragraph in the legislation was mainly used to legitimate rejected asylum applications. Despite the aspirations of civil servants to take individual children's needs and rights into account, a number of challenges often cause children's rights to be neglected. These include the officer's fear of reviving children's traumatic past experiences, mistrust regarding the grounds of asylum claims, and the lack of time caused by under-resourcing. The main finding drawn from the study is that, at the Migration Board, children's rights are treated as secondary to the national interest of keeping overall migration numbers down. A solution to this problem, presented in the article, would be to more clearly assess children's asylum claims in light of the Convention on the Rights of the Child (CRC). Such a rights-based approach to the best interests of the child would help officials to act within their discretion.

    • The criminalization of welfare and policing has often been analysed as being indicative of the global rise of a neoliberal political agenda. The current paper examines how governmental power is organized to govern investigators responsible for policing welfare in Sweden. Using empirical illustrations from the Swedish case, it shows how multiple governmental logics are enacted in the context of a broader political will to crack down on welfare fraud. Specifically, it demonstrates how so-called control investigators are tasked to realize a neoconservative agenda. To this end, these investigators are themselves governed using an amalgam of neoliberal and bureaucratic rationalities and technologies. The paper argues that examinations of the articulation of multiple governmental rationalities offer one route for thinking intelligibly about power and criminalization and by extension about the limits of neoliberal rule.

    • Objectives: Assessing the predictive accuracy of using prior crime, place attributes, ambient population, community structural, and social characteristics, in isolation and combined when forecasting different violent and property crimes.Method: Using multilevel negative binomial regression, crime is forecasted into the subsequent year, in 50-m grid-cells. Incidence rate ratio (IRR), Prediction Accuracy Index (PAI), and Prediction Efficacy Index (PEI*) are interpreted for all combined crime generators and community characteristics. This study is partially a test of a crude version of the Risk Terrain Modeling technique.Results: Where crime has been in the past, the risk for future crime is higher. Where characteristics conducive to crime congregate, the risk for crime is higher. Community structural characteristics and ambient population are important for some crime types. Combining variables increases the accuracy for most crime types, looking at the IRR. Taking the geographical area into account, crime history in combination with both place- and neighborhood characteristics reaches similar accuracy as crime history alone for most crime types and most hotspot cutoffs.Conclusions: Crime history, place-, and neighborhood-level attributes are all important when trying to accurately forecast crime, long-term at the micro-place. Only counting past crimes, however, still does a really good job.

    • This chapter critically engages with a central policy norm developed by key international actors working on statelessness and refugeeness over the last three decades. This is the norm that for stateless refugees their refugeeness effectively trumps their statelessness. I term this norm, which arbitrarily separates and ranks statelessness and refugeeness, the “protection hierarchy”. This norm is increasingly being called into question by a range of actors due to growth of research on stateless refugees which shows that statelessness is both very impactful and highly intertwined with refugeeness.The chapter empirically interrogates this normative policy position, showing that the “protection hierarchy” not only fails to protect stateless refugees, but actually increases the populations’ vulnerability. Due to this, the chapter argues for the use of evidenced based policies on stateless refugees and the dismantling of the ”protection hierarchy”.
