    • This dissertation investigates the role of the law in affording the conditions of possibility for exploitation to install and reproduce itself in the context of contemporary capitalism. It engages with the dialectical incompossibility of some of the key normative assumptions embedded in the law and the economy vis-à-vis their phenomenological consequences. With support from Niklas Luhmann’s systems theory, the dissertation relies on two main examples – patents on essential medicines and labour exploitation – to examine the tension between expropriation and accumulation. It advances the novel concept of “ablegality” as a register for the remainder that every phenomenological-hermeneutic operation will inevitably generate as the potentiality that accompanies all phenomenological reduction. The principal contribution made through this dissertation lies in articulating the role of the invisibilised side of legal operations as drivers for exploitation and, ultimately, for injustice to manifest legally.

    • This chapter traces the prehistory, genesis and application of Article 6(5) of the Second Additional Protocol to the 1949 Geneva Conventions (1977) and its implications for the question of right authority. Under international law, a sovereign government has sovereign rights (and obligations) towards her subjects while the relation between belligerents is different: It is one of enmity and equality, regulated by the law of war (or international humanitarian law [IHL] or jus in bello). Rebels can be punished for using force against the sovereign, but soldiers of a belligerent not; they have the ” combatant privilege” to kill other soldiers. In present international law, this right of the sovereign (a right authority) is undermined by certain tendencies in the jus in bello. To the extent that non-state armed groups (NSAGs) can start a war without negative legal consequences and thus acquire belligerent rights, they actually have a de facto authority, or at least they are undermining the state’s exclusive authority. Article 6(5) states that ” [a]t the end of hostilities, the authorities in power shall endeavor to grant the broadest possible amnesty to persons who have participated in the armed conflict…” The many amnesty agreements concluded since, demonstrates an emerging trend towards ” retroactive combatant immunity.” Thus, rebel fighters have a reasonable chance of being provided with the ” combatant privilege,” albeit post factum.

    • What would international law look like in a world without states — or with states being non-dominant? How would it be formed and who would be its protagonists? And would that world be a better place? To think about international law without states might seem like a ludicrous idea. After all, inter-national is often interpreted to mean “inter-state”, and for many people, any law without the state seems impossible to think. However, the state has been around for only a few hundred years, and yet there have been norms between political communities — whether we call that international “law” or not – for much longer. International law without the state could mean de facto anarchy and even perennial war. But it could also mean inter-communal law between communities that are not states, if we assume that people without states would spontaneously form political communities, albeit of a different nature. Or it could be mainly transnational law, formed between apolitical bodies, like corporations. Or, perhaps, a bit of all of that.

    • This chapter discusses different historiographies of the protection of cultural heritage, which provides quite different perspectives and delimitations of this body of law, and finds that most or all of them contain important silences, or gaps, which inhibit a broader understanding of the legal treatment of such property. In 2005, the International Committee of the Red Cross published its monumental study "Customary International Humanitarian Law." The histories of a legal regime help determine the pedigree, the identity, and the content of its norms. The writing of the intrinsic history of international law the history of the law itself – re-form our consciousness of the identity, the functioning, and the potentiality of international law as law. The writing of the extrinsic history of international law – its relationship to the history of other social phenomena – reform our consciousness of the role of international law in the forming, re-forming, and re-making of international society.

    • This essay will discuss how intrusive (hacking) cyber espionage in peacetime is legally justified, in particular by some US defense sources.  In their reading, “cyberspace” has become a virtual "space" of exception from the usual peacetime rules of respect for sovereignty. Given the ubiquitous and interlinked nature of “cyberspace”, exceptions previously applicable only in war or in other hostile relations, have now de facto become the rule, and states have sought ways to rationalise and justify that, without openly flouting the established categories of war, peace and sovereignty. In the US, this has occurred through a very limited conception of sovereignty (sovereignty as a non-binding principle). This leaves much of “cyberspace” in a legal no-mans-land, or more adequately, a free-for-all-land, in which states can search and manipulate data on computers in foreign states without much legal consequence. This very limited conception of territorial sovereignty is related to the metaphorical spatialalisation of the Internet as a new "domain", a "cyberspace", rather than as a network of hardware located in interlinked but still separate national jurisdictions.
