- The paper discusses the issue of sexual violence against women during the past military dictatorships in Latin America, especially in Argentina, and some consequences in the current practice of their sexual and reproductive rights. It analyzes the extent the exercise of sexuality has a connection with the exercise of power, which organizes, manages, and prioritizes behavior depending on a political, social and cultural project, in a context of time and space. This means that the public and private, power and sexuality depend on the idea of the nation, class, race and religion, and consequently implies the political control of reproduction and the family model, including expressions of gender sexual violence. The paper discusses feminist theoretical concepts, such as the concept of gender and nation from an intersectional perspective (Yuval Davis), the idea of post colonialism and decolonization of feminism (Mohanty), and the relationship between gender and globalization (Fraser).

- The proposal for a Regulation on jurisdiction, applicable law, recognition and enforcement of decisions and authentic instruments in matters of succession and the creation of a Euro- pean Certificate of Succession follows a recent trend in EU private international law regulations in thatits rules on jurisdiction are intended to apply universally. In order to compensate for the non–referral to national rules of jurisdiction, the proposed Regulation itself contains rules on subsidiary jurisdiction in Article 6 which foresees a kind of jurisdiction based on the location of property. And an Article 6a on forum necessitatis has also been added in the latest text discussed in the Council. But the proposal has some lacunae, that must be remedied before the final adoption or there is great risk that a situation of unnecessary ‘limping’ devolutions of estates will occur. The paper proposes three different ways to avoid such ‘limping’ devolutions: renvoi, deference to the foreign devolution and limiting the devolution to assets.

- The relationship between law and politics is one of the most debated topics in legal theory. There is no consensus on the range and scope of the political and the legal element in law. Legislation or lawmaking is conceptually ambiguous because it indicates the law which has been promulgated, and therefore the primary object of many modern theories of law, but also the process of making it, that many theories of law usually locate outside the scope of jurisprudence and more specifically in the realm of politics. The first section sets the problem of legislation by distinguishing a number of different problems that often appear indistinctly under this label. Standpoints can be viewed according to a spectrum stretching from legal theories holding politics to essentially permeate the law to those claiming the opposite. The aim is to situate Hägerström’s view on law-making along this spectrum. My claim is that Scandinavian realism holds middle ground in that ideological constructs structurally affect the law yet legal normativity cannot be reduced to the will of de facto holders of power: law cannot be reduced to any idea of will, including that of the majority or of the people. To substantiate this claim the article investigates Hägerström’s view on the foundation of a new constitution pursuant to a political revolution, the ultimate touchstone for maintaining the (in)distinctiveness of law and politics. His bottom line is that the problem cannot be explained in terms of discovery of public interest, because of his non-cognitivist approach. But it cannot be explained in terms of decision-making either. Law-making here amounts to access and control of technical procedures grounded in a form of faith, or in his own terms “ideas governing men’s minds”.

- This study analyzes some of the factors that facilitate and complicate advanced legal teaching in human rights as a subject of international law. The main objective is to offer a reflection on the challenges faced by the teacher in this field and which arise as a result of the expansion, diversification, and confrontation of the subject taught. According to the argument developed, a classical or traditional approach to teaching inspired by international legal positivism does not offer the necessary resources to address these challenges. In its place, the study advances a wider approach that incorporates all the teaching objectives included in the common vision of Human Rights Education (HRE) and adapts them to the realm of advanced legal studies. Unlike a classical approach, the HRE-based framework fosters a more complex account of teaching tasks, which is not limited to cognitive development but extends to moral and ethical development alongside the development of action-oriented capacities. For this reason, it enables the elaboration of responses to the challenges faced that recognize the relevance of all the values sustained by international human rights law (IHRL) as guiding principles for teachers in this field. In addition, it permits a positive appreciation of the contributions made by other disciplines and critical studies of human rights, without discarding the utility of legal positivism to distinguish between IHRL as it is, from what it should be, and from what it can be.
