    • Rättsstatens principer är en grundläggande del av det svenska statsskicket, en central del av EU:s kärnvärden och en förutsättning för internationella relationer stater emellan. På samtliga dessa nivåer framhålls vikten av att rättsstatens principer upprätthålls för att uppnå och skydda andra värden såsom demokrati, fri- och rättigheter och hållbar utveckling.Boken förklarar rättsstatens olika beståndsdelar och relevans, samt hur rättsstaten definieras och kommer till användning på internationell, europeisk och svensk nivå. I boken redogörs för de mest väsentliga aktörerna på de olika nivåerna, vilka betoningar och prioriteringar dessa har vad gäller rättsstatsprincipens innehåll, samt hur de relaterar, kommunicerar och på andra sätt interagerar med varandra. Författarna har en lång och bred erfarenhet av rättsstatsfrågor kopplat  till både praktik och teori.

    • In this article we discuss ableist manifestations about chronically ill and disabled schoolchildren in Sweden. On claiming their right to schooling, these children risk being excluded due to not conforming with norms while being refused alternative formats that would enable participation. They are then accused of not attending school and construed as problematic. Parents are derided as mollycoddling perpetrators by teachers who perceive themselves as superior knowers of disability and illness, polarising an already infected school debate. Alternative formats for participation are derided, claiming that certain disabilities do not exist or that parents exaggerate their children’s symptoms. We concede that teachers’ poor work environments due to underfunding and unreasonable workloads are problematic, but we are adamant that unfavourable work conditions must not entail unethical professional conduct. We hope this article will contribute to putting the situation of chronically ill and disabled schoolchildren in Sweden on the radar of Critical Disability Studies as well as in relevant fields of practice and that it might stimulate a change in public debate

    • The right to water has been recently recognized as a fundamental human right by the United Nations, thereby clarifying its status as 'legally binding', making it 'justiciable' and enforceable. This development has been heralded as a key that holds great potential to change the lives of the billions who still lack access to clean water. Many of those deprived of enjoyment of the right are children, who constitute up to a third of the population in the developing world. What is the value added of the rights-based approach for access to water, especially for children? Would recognition of the right to water as legally binding deliver real benefits to children in improving their access to water? Does it really offer anything new that can help them realize their right to water more effectively? These questions will be explored in this paper using empirical evidence from India, where water has been legally interpreted as a fundamental right, and as a welfare state, where there has been consistent effort on part of the state to improve children's access to water.

    • Nandita Singh and her colleagues look at children's right to water in India. They argue for the exercise of the right by children by analyzing the universal normative-legal framework and its difference to the local socio-culturally defined framework. They suggest that defining problems and designing actions only within the normative-legal framework can obscure understanding the critical realities at the right-holders' end. They suggest that interventions at various levels, such as through policy and targeted programmes, have at best provided an ‘enabling environment’, but the process of implementation of children's rights at the right-holders' end is to date an incomplete socio-cultural process.

    • An important area in the discourse on gender and water is water supply where women are seen as the key actors and beneficiaries. A human rights approach to development has been adopted with access to safe water explicitly recognized as a basic human right. This right places a legal obligation upon governments to translate the international norms into practice.But does explicitly acknowledging the human right to water make a practical difference in women's lives? Using an actor-oriented perspective, this paper analyzes how the international legal norms for realization of the right get reconstructed in local communities where women are the right holders. The empirical data for the analysis will be drawn from a first-hand qualitative study in rural India.The findings of the study show how the socio-cultural matrix provides the environment for implementing the right and determines its equitable and effective exercise by women.

    • This chapter provides a short overview and investigation of gender perspectives on transitional justice. It examines some of the gender implications of the 'transitional' theory of justice. The chapter explains conceptualising the role of gender analysis in transitional justice and what it means to add gender to transitional justice. It discusses key points of contention and the case study of Bosnia-Herzegovina; zoom in on gendered justice gaps connected to accountability, acknowledgement and reparation. The chapter explores gender as a relational concept that more broadly informs an understanding of power, exclusion and marginalisation. Transitional justice practices aim to right wrongs in the past, institutionalise the rule of law and new juridical and normative frameworks in the present, as well as prevent the recurrence of violence and future harm. The efforts to break the impunity for these crimes and unveil the extensive harm suffered by women paradoxically risks cementing conservative gender roles of women as victims and men as perpetrators.

    • I dagens samhällsdebatt, i media och vetenskaplig forskning, uppmärksammas människors utsatthet för våldsbrott som ett mycket allvarligt problem. Utmärkande för det offentliga samtalet är dess skarpa fokusering på den våldsamme mannen. Mäns utsatthet för andra mäns våld är däremot en problematik som ytterst sällan förs på tal. Här råder en påfallande tystnad. Christopher Collstedt menar i denna bok att rötterna till vår tids tal och tystnader om våld mellan män, djupast sett och för svenska förhållanden, kan spåras tillbaka till genomgripande förändringar inom samhället och rättsväsendet under perioden från 1700-talets slut till 1900-talets början. Dessa omvandlingar möjliggjordes genom framväxten av en modern sekulär världsbild och den politiska etableringen av en naturvetenskaplig, biologistiskt grundad förståelse av mannens natur, kropp och inre liv. Genom djuplodande analyser av bland annat lagar, politiska debatter, rättspsykiatriska och kriminalpsykologiska fallbeskrivningar samt rättsprotokoll och domar söker "I begynnelsen var dådet" historisera och avnaturalisera de tankestrukturer, normer och kategorier som ligger till grund för vår tids offentliga samtal om våld mellan män och vill på så vis bredda debatten på området.

    • This article explores three entrepreneurial ventures that have evolved in proximity to online piracy. In reviewing the respective cases of Spotify, Skype, and The Pirate Bay, the argument outlines the radically divergent strategies with which the entrepreneurs have sought to legitimise their ventures and underlying technologies. The article concludes that: 1) the context of practices labelled ‘pirate’ are paradigmatic examples of fields in which entrepreneurs must work exceptionally hard to legitimise themselves; 2) in this context, it is crucial that the role of law is analytically isolated from the role of institutionalised legitimacy; 3) success in legitimisation is largely dependent upon the entrepreneur’s ability to demonstrate that the venture is governed by ‘the natural order’ of the economy. It is further argued that piracy-proximate ventures may contribute to the entrepreneurship field, inasmuch as they teeter on the border of being considered too disruptive, and thus suffer from a ‘liability of politicalness’.

    • Following an increase in Roma migration under the European “freedom of movement” laws, Swedish municipalities initiated more than 80 evictions of informal Roma settlements on the grounds of poor sanitation between 2013 and 2016. These evictions echo policies from earlier in the 20th century, when Roma living in Sweden were often marginalized through the denial of access to water and sanitation facilities. The recent Swedish evictions also follow similar government actions across Europe, where Roma settlements are controlled through the denial of access to water and sanitation. However, access to water and sanitation—central aspects of human health—are universal human rights that must be available to all people present in a jurisdiction, regardless of their legal status. The evictions described here violated Sweden’s obligations under both European and international human rights law. More positive government responses are required, such as providing shelters or camping sites, setting up temporary facilities, and directly engaging with communities to address water and sanitation issues. The authors conclude by providing guidance on how states and municipalities can meet their human rights obligations with respect to water and sanitation for vulnerable Roma individuals and informal settlements in their communities. © 2017 Davis and Ryan.
