  • Bypassing public procurement regulation : a study of rationality in local decision making

    • Using private contractors through procurement is common in most public sector areas. Despite the benefits of procurement, officials are sometimes tempted to circumvent procurement regulations. The aim of this article is to examine the strategies used by local governmental decisionmakers to bypass procurement regulations and to analyze the rationality underlying these officials' actions. Interviews, court documents, municipal documents, and newspaper articles describing the actions of Swedish municipal officials concerning special transport service (STS) procurements were collected and analyzed. In a case in which rural municipalities lost regular taxi services after STS procurement, we demonstrate how decisions were driven by pressure from the public and local interest groups, making municipal officials deviate from procurement regulations in striving to secure the existence of regular taxi services. One outcome was that local businesses were given preferential treatment, violating regulations and reducing economic efficiency.

    • Public procurement has become a common element in Swedish administration. One purpose of procuring is to lower the costs of the procured service and another is for the political level to gain better control over what it is purchasing. However, monitoring problems exist when conducting public procurements; recent studies indicate that actions related to corruption among public servants are most common in public procurement processes. This article takes its departure in public actors monitoring problems. I argue that, in the case of public procurement, private actors have taken on a type of monitoring role towards the public sector, and that the public system in fact, depends on private actors to detect bypasses committed by civil servants. This article provides an understanding of this monitoring role and discusses its theoretical and practical implications for the public system. It is concluded that upholding the public system is not the primary objective for the private whistleblower but a positive effect. The monitoring role is analysed in the framework of principal-agent theory and should be seen as complementary to existing monitoring functions that public principals have at their disposal.

    • This article examines the role of moral arguments in the delegitimation of transition policies. Previous research has highlighted attitudes and arguments that explain resistance against transition policies, including perceptions of unfairness; inefficiency and effectiveness; lack of trust; and ideology. This article provides further understanding of resistance to climate policies by zooming in on how social movements implicitly and explicitly use moral arguments to delegitimise low-carbon transition policies. Through a qualitative interview study with members of a Swedish social media movement against low-carbon transport policies, we analyse central arguments against policies; how moral considerations figure in them; and how these strengthen argumentative delegitimation practices against transition policies in the transport sector. We show how moral arguments serve to legitimise protests both by instilling an urgency in the cause and generalising the demands to delegitimise mainstream transition policies, and suggest that recognition of this may contribute to both better analysis and policies.

    • Despite the EU’s increasing role in regulating public transport procurement, few studies have considered this aspect when analysing procurement problems of public transport. This paper examines how the institutional relationships between different actors, including international governmental bodies, in public transport effects the possibility of exerting control over a county public transport authority (PTA) in a multi-principal setting. The analysis is carried out using empirical material from an infringement process including a Swedish PTA and the EU. The conclusions have clear policy implications for the procedural order when exerting control over the PTA in cases of procurement problems. It is for example shown, that the implementation process would be much more efficient if the regulations allowed the EU to impose sanctions directly towards the local authorities without having to involve the national government when the procurement laws are violated.

    • Smart mobility includes automation, shared mobility services and other new forms of mobility made possible by digital technologies. This book argues that smart mobility will only be developed in a desired direction and fulfil global sustainability goals if it is steered in that direction. There is a vast body of literature on public policy and policy instruments, and there are many different conceptualisations and categorisations. Applying an open and broad approach, whereby a variety of policy instruments that are used to govern smart mobility are introduced and discussed, this book is ideal for both professionals and researchers. The book is organised into three parts: the first part explores why there is a need for policy instruments in relation to smart mobility, the second part examines how policy instruments are chosen and developed, and the third part explores what policy instruments are doing and what smart mobility is doing to them. Of the policy instruments used today, many focus on producing knowledge for governments and thereby making smart mobility governable. Because of the difficulties with implementing policy instruments that make the transport sector more sustainable, the book concludes by discussing in which ways citizen deliberation can breathe new life into the debate.

  • How to measure efficiency in risk prevention?

    • Risk assessment methods form corner stones in the striving to reduce risks and threats to human life and society. Proposed actions can be physical or non-physical and adopted or declined after political evaluation, with consideration taken to available resources and estimated effect on risk. To optimize and avoid regrettable actions, decision-makers are in need of well-founded analyses of how efficient different options might be. Analytically, there are several possible steps that can contribute.Firstly, the correlation between a measure and its effect should be based on causality, which often is difficult to establish quantitatively. High frequent accidents (e.g. traffic) can normally be treated statistically , while low frequent accidents with severe consequences (e.g. natural hazards) are more restricted to qualitative descriptions of correlation. Systematic monitoring of injury and damage data and gathering into databases, are a crucial activity for causality valuation. Secondly, economic valuation of effect is an important contribution in a cost-benefit perspective. Thirdly, a measure often brings several different effects and some may fall outside the actual purpose. An additional problem is how to handle effects that exert varied influence on different stakeholders or social groups in society. Fourthly, certain criteria are required for final prioritization. For instance, in analysis of goal fulfillment, effects are compared with politically decided quantified goals.In cases where basic data from steps 1-3 are incomplete, alternative criteria like “acceptable risk” might be necessary to agree about politically. To use similar approaches on how to describe and quantify effect correlations, promote gathered efforts at local level where risk reducing measures are decided upon by different actors and with regard to diverse local conditions. Tests of suitable methods and approaches to measure efficiency of planned or accomplished actions in gain for risk prevention, are described and discussed.
