- Following the juxtaposition of American and European standards and procedures for accessing and mining personal data in law enforcement and judicial procedures, the presentation point out that the practice and political philosophy behind regulating public access to criminal data is influenced by both the commercial sector’s involvement and incentives, as well as the volume and degree of expectation of state transparency and privacy. The comparison of the Swedish and the Hungarian cases provides fruitful findings, where we argue that there are also differences between European countries regarding the degree of access restrictions and whether or not data in court files are made anonymous or not. We analyse those differences and ask to what degree the expectation of privacy is influenced by generational, geographic and historical differences.
