    • The regulation on ship recycling at international and European Union (EU) level has transitioned from the realm of transboundary movement of wastes to a specialized regime, i.e., the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships (2009) (Hong Kong Convention). Although this convention is not in force yet, the principal features of it have been incorporated in EU Regulation 1257/2013 on ship recycling. This paper examines the rationale behind developing a ship recycling regime, its disassociation from wastes, and the departure from the main principles of transboundary movement of wastes, such as the proximity principle, reduction of transboundary movement of wastes, and the prior informed consent procedure. While acknowledging some of the positive features of the emerging ship recycling, it is submitted that the Hong Kong Convention and EU Regulation 1257/2013 on ship recycling represent a step back in the regulation of ship recycling.

    • Legal research in Sweden has traditionally focused on a systematization of the legal rules and their practical application, while the task of studying the effects of the application of the laws has been handed over to other branches of the social sciences. In contrast, new legal theories focusing on proactive and therapeutic dimensions in law have gained increasing attention in the international arena. These approaches may be better suited for evaluating legislation governing compulsory psychiatric care. Theoretical discussions and studies of causal mechanisms underlying criminal behaviour, as well as the implementation and value of instruments for predicting behaviour, are relevant to contemporary criminological research. Criminal behaviour varies across different groups of perpetrators, and the causes can be sought in the interplay between the individual and social factors. Multi-disciplinary efforts, integrating research from forensic psychiatry, psychology, sociology, and criminology, would be beneficial in leading to a better understanding of the causes underlying criminal behaviour.

    • Enligt EG-rätten skall det råda fri rörlighet för tjänster. Sjuk- och hälsovård är sådana tjänster som omfattas av den fria rörligheten. Om allmän sjukvård i Sverige tidigare har uppfattats mer som en skyldighet för landstingen, har EG-rätten medfört att möjligheten att under vissa förutsättningar få vård i andra EU-länder utgör en rättighet för dem som är bosatta i Sverige.Rättsläget i EG-rätten är idag ganska klart. I fråga om sjukvård eller tand-vård som tillhandahålls utanför sjukhus kan en person som är bosatt i Sverige välja om den vill att vården skall utföras i Sverige eller i ett annat EU- eller EES-land. Förutsättningen är att det rör sig om vård som ges av den allmänna sjukvården i Sverige. Svenska myndigheter får ersätta utländska vårdgivare och patienten betalar endast sådana kostnader som den skulle ha betalat i Sve-rige.För vård på sjukhus har EG-domstolen godkänt att patienter får resa utom-lands för vård endast efter tillstånd från den egna staten eller försäkringskassa. Sådana tillstånd måste dock beviljas om patienten inte kan få vården eller minst lika effektiv vård i tid i den egna medlemsstaten. Sverige har ännu inte infört ett förhandstillståndssystem, men det finns planer på detta. När ett så-dant system införs, ökar myndigheternas möjligheter att avslå begäran om att få vård utomlands. Därmed begränsas svenska patienters möjligheter att söka sig till andra EU-länder. Samtidigt begränsas ovissheten om ersättning kom-mer att medges eller inte. De ekonomiska transaktionerna kring vården utom-lands behöver inte längre skötas av de enskilda patienter som får tillstånd.I den mån vårdens kringkostnader, som kostnad för resa, logi, att patienten behöver stöd av en medföljande etc. ersätts vid vårdresor inom Sverige, gäller i princip att sådana kostnader också skall ersättas när patienten reser utom-lands. Det skall råda likabehandling mellan patienter som får vård inom Sveri-ge och svenska patienter som får vård i andra EU-länder.EG-rätten innebär ett förändringstryck på svensk sjukvård. Vård skall i EU-länderna ges efter behov och inte efter betalningsförmåga. För att alla skall kunna få vård efter behov krävs någon form av kollektiv finansiering. I och med att EG-rätten gör det möjligt för enskilda patienter att ta med sig skatte-pengar utomlands utan att själva behöva betala annat än svenska patientavgif-ter, uppstår ett finansiellt utflöde. Om väldigt många patienter gör bruk av den fria rörligheten, skulle det kunna leda till dåliga finanser för sjukvården. Erfa-renheterna visar att det trots allt är ganska få patienter som verkligen söker vård utomlands. Den svenska sjukvården kan också möta ett eventuellt pati-entutflöde genom att erbjuda effektiv vård i tid i Sverige och förbättra vårdens tillgänglighet.Sammantaget kan inte rättsutvecklingen inom EU sägas utgöra ett hot mot den europeiska sociala modellen.

  • EU Citizenship: Twenty Years On : Special Issue German Law Journal

    • The Maastricht Treaty (the “Treaty”) first introduced the status of EU citizenship. The twentieth anniversary of the signing of the Treaty, marked in 2013, was declared the European Year of the Citizen. Union citizenship has been understood as the world’s first post-national citizenship, although it is still complementary to national citizenships. EU citizens enjoy rights that have been expanded, modified, and reinterpreted in light of the EU integration process. The Court of Justice of the European Union (CJEU) has been a driving force in this process. This twentieth anniversary has provided the occasio for this special issue. Indeed, much has happened over the last two decades. The Maastricht Treaty entered into force on the heels of German reunification, and afterwards, a series of EU treaties followed: The Amsterdam Treaty, the Nice Charter of Fundamental Rights, the aborted constitutionalization process and the Rome Treaty in 2004, and the Treaty of Lisbon. The Euro took over former national currencies in 2002; the enlargement process led to today’s twenty-eight Member States. But the ratio of this special issue is based on other events as linked to the 2008 financial crisis, bailouts, the fiscal compact, and similar measures. In a nutshell, the timeliness of this volume is linked to the current financial disarray. Since prognosis presupposes diagnosis, no further words are necessary as to the importance of this task. It is (almost) self-evident that before taking action and preparing for the future, one needs to address the very first question: Nosce te ipsum...

    • The ocean provides essential ecosystem services such as food production, off- shore renewable energy, carbon sequestration, and recreation. However, scientif- ic evidence warns us about the severe impacts the ocean is facing due to pollution, unsustainable fishing practices, and climate change effects. These effects include ocean acidification, biodiversity loss, and sea level rise. From international, EU, and national perspectives, there is an outspoken aim to boost the ‘blue’ economy while securing healthy marine ecosystems. However, the legal system handling these integrated demands is diverse and fragmented regarding sectoral aims, geographical areas, and governance levels. In their current form, they are not designed or fit to provide an ecosystem-based approach to managing human–ocean relations or to implementing the objective of a healthy and sustainable ocean. To integrate legal competence relevant to ocean governance in both practice and theory, scholars of different legal areas within the Department of Law col- laborate internally and, more importantly, with scholars within other disciplines and actors outside academia. Our ambition is for this interdisciplinary endeavor to prompt changes in socio-environmental governance structures and legal ed- ucation. From a socio-environmental perspective, we examine opportunities to integrate our knowledge of different legal areas and improve our transdisciplinary capacity. We analyze and discuss challenges, drivers, and pathways to provide knowledge supporting a transformation to a more sustainable blue economy. From a legal education perspective, interdisciplinarity requires a problem-based approach and the introduction of threshold concepts that shape how we apprehend a particular phenomenon. Ocean governance is an example of a concept providing a valuable opportunity for broader legal reasoning and for finding meaning- ful connections between national, regional, and international law.
