- Nos nossos dias, nos passaportes e carteiras de identidade, a cidadania não é, em geral, distinta da “nacionalidade”. Não obstante, o recurso jurídico à noção de “nacionalidade” foi estabelecido somente após um longo e acidentado percurso. Mas o que entendemos com a equiparação da cidadania com a nacionalidade e, sobretudo, quais são os efeitos para o discurso jurídico da cidadania? Este artigo analisa a questão abordando, em primeiro lugar, a ambiguidade da ideia de nação em si e, em segundo lugar, a artificialidade das tipologias de nacionalidade que encontramos principalmente na literatura.

- This article revisits one of the central topics of Hans Morgenthau’s realism – the world state – as a major gateway to one of the most neglected areas in the current historiography of the realist tradition: that of international law. The article thus argues that Morgenthau’s realism can be read in light of Locke’s metaphysical challenge to Hobbes’ view of the state of nature. National interest can in this light be seen as highly conditioned by the republican ideal of popular sovereignty – akin to that of limited government – where law is already operating socially, even before being posited by the state. By developing this parallel with Locke – shared in part by German legal philosophy that preceded Morgenthau – we are in a better position to understand how he accommodates the functional approach in his realist take on international law and on the social prerequisites of a world state.

- Learning Society, Cosmopolitan, Public Health, Criminal Prevent Today. The learning society expresses principles of a universal humanity and a promise of progress that seem to transcend the nation. The paper indicates how this society is governed in the name of a cosmopolitan ideal that despite its universal pretensions embodies particular inclusions and exclusions. These occur through inscribing distinctions and differentiations between the characteristics of those who embody a cosmopolitan reason that brings social progress and personal fulfilment and those who do not embody the cosmopolitan principles of civility and normalcy. Mapping the circulation of the notion of the learning society in arenas of Swedish health and criminal justice, and Swedish and US school reforms is to examine the mode of life of the citizen of this society: the learner, as a representative of the unfinished cosmopolitanism.
