    • In this paper my concern is with the collective moral responsibility of criminal investigators for the outcomes of their investigations, bearing in mind that it is important to distinguish collective moral responsibility from, and relate it to, individual moral responsibility. In what sense, if any, are police detectives individually and collectively morally responsible for their success (or, for that matter, their failure) in gathering sufficient evidence to identify, arrest, and charge an offender who has committed a serious crime? Alternatively, in what sense are they morally responsible in cases where they identify, arrest, and charge an innocent person? And in what sense, if any, are police detectives individually and collectively morally responsible for the ultimate outcome of the trial, the finding by the courts of someone they have investigated and charged with a serious crime to be guilty or innocent?

  • Criminal Behavior and Mental Health Problems among Adolescents : A Cross-sectional Study and Description of Prevention Policy in Sweden

    • The present study investigates the association between mental health problems and criminal behavior among adolescents in Sweden. Community crime prevention in a Swedish context is also discussed. Every two years, pupils from schools in Stockholm answer the Stockholm School Survey with questions and statements about their social situation, alcohol and drug use, attitudes, school climate, school grades and criminal behavior. Data collected from pupils who answered the survey in 2014, 2018 and 2020 form the basis of this study. A significant association between mental health problems and criminal behavior was shown, even after controlling for factors suggested in international literature. Mental health problems were shown to be a strong explanation for criminal behavior among adolescents.

  • Motives, Reasons, and Responsibility in Hate/Bias Crime Legislation

    • Hate/bias crimes, according to what we may call the literal interpretation, are crimes distinguished by their connection to a certain kind of motive. Hate crime laws and sentencing provisions state that such motives may result in penalty enhancements. According to the standard objection to hate crime laws, this position is problematic: first, criminal law should not be used to pass moral judgments on motives. Its concern should be with actions as modified by intentions, not with the values and reasons of perpetrators. Second, our motives are not directly responsive to the will, so we should not be held responsible for them. In reply to the second part of the objection, this article defends a version of the literal interpretation of hate crime that conceives of it as acting on a bad reason. Hate crime laws add punishment not for motives/thoughts, but for the decision to treat a patently bad reason (such as racism) as a reason to commit a criminal act. If the act itself is reason-responsive, we can be held responsible for what reasons we act on. Given that the truth or falsity of hate/bias on these grounds is not a disputed matter, we can justify using the criminal law to recognize the moral status of such motives.
