    • The Nordic countries have had a close co-operation with joint legislation in many fields since the beginning of the 20th century. Above all, it has resulted in a common contract law.     • Swedish as well as Danish, Norwegian and Finnish law had between 1936 and 1976 an Article 8 in their joint Promissory Notes (Debt Instruments) Act providing that obviously unconscionable terms could be modified. This article was in some cases, but very restrictively, applied by analogy. Courts had however other means to take reasonableness into regard. This contribution discusses these other means and the application of article 36 of the Contracts Act in force since 1976.

    • The case of Yearworth decided by the Court of Appeals of England and Wales (2009) put the application of tort law and contract law to the test in several respects. A claim was brought by a number of men who had undergone treatment for cancer and therefore stored their sperm, which was negligently destroyed by the hospital, causing the men a psychiatric injury. It is thus a case of shock injury suffered consequential to an initial harm. However, what has been destroyed: a body part that constitutes a personal injury or damage to property? In addition, how is liability for a shock injury in such a case or other cases delimited? I argue that the assessment cannot be driven by an introspective definition of the concepts of harm. Instead, it is necessary to grasp the nature of the initial harm caused by the tortfeasor - including the rights (or protected interests) and duties related to that initial harm - and the normative correlation to the final personal injury (shock injury) suffered by the injured person. A model for making that assessment is presented here from a Swedish tort law perspective on shock injuries consequential to the destruction of biological material and property in general.

    • The facts of Kleinwort Benson Ltd v. Lincoln City Council will become clear from the following case notes. The case has attracted quite some attention in England. This is not only because it includes the final speech on the law of restitution by Lord Goff of Chievely, it also raises some highly interesting questions. How should interest rate swaps with local authorities be judged? When should recovery for mistake of law be allowed? Do judicial decisions act retrospectively?It is especially the latter question which is a central point in the discussion of the case in the ensuing case notes. Foreign observers obviously are baffled by the fully retrospective effect which the majority accords to judicial change. Is not this against the whole idea of precedent in the common law?

    • The problem of excessive debt among households in Sweden is increasing. As a result of the development within the financial sector, households in Sweden have increased their debt incurrence markedly. It has been relatively easy to borrow money, due to the deregulation of the credit market in Sweden in the 1990s and the low interest rates in recent years. As mortgage loan is the bulk of the total household debt, the risk that individuals will be affected by excessive debt incurrence and insolvency has therefore increased. Therefore, a number of new legislative changes have been implemented to overcome this problem. In order to prevent these risks, the Financial Authority has adopted a rule that stipulates that new loans should not exceed 85% of the property market value. Reports from both the Swedish Enforcement Authority and the Swedish Financial Supervisory Authority show that 20% of Swedish households have a difficult time making ends meet. Those who are affected by excessive debt often experience a lower standard of living since frequently they are impacted by distraint.The aim of this paper is to describe and analyze the excessive debt situation in terms of insolvency and effects on households and society. Firstly, we intend to investigate foreclosures in Sweden, both regionally and over time. Why are certain regions less frequently affected by these risks while other regions show higher levels of risk even during generally good years? Secondly, we will investigate whether (a) whether properties that have undergone executive auction are sold at a lesser value, (b) if these properties have an impact on the property prices in the vicinity and (c) if those who buy these properties themselves run a greater risk of insolvency. Thirdly, a closely related area of legal interest is investigating to what extent legislation provides a protective net for the debtor who, through the executive auction, thereby loses his/her residence.

    • A plusieurs reprises, pendant une période d’environ vingt ans avant sa mort, Mme F. a exigé du demandeur, chaque fois que celui-ci lui rendait visite, qu’il emporte avec lui un bien mobilier de valeur qu’elle déclarait vouloir lui donner. Mais de son côté le demandeur lui proposait de garder ce bien chez elle aussi longtemps qu’elle vivrait. Dans un premier testament de Mme F., mention fut faite de cette donation. Mais celle-ci n’ayant pas été reprise dans le dernier testament de la défunte, il s’en est suivi un litige sur la réalité de cette donation entre le demandeur et le défendeur. Dans l’arrêt commenté, l’OGH a déclaré que le demandeur était devenu propriétaire et que le défendeur, qui avait vendu le bien dont il n’était pas le possesseur de bonne foi, était tenu de l’indemniser.

    • The fourth Ole Lando Memorial Lecture is mainly about the interaction between soft law and precedents. The paper argues that precedents are an increasingly important source of law in civil law jurisdictions with examples from Brazil, China, France and Sweden. The paper provides an overview of some problems and benefits of precedents within the area of private law, inter alia judges as lawmakers compared to developments through statutory law and how to identify a legal rule from a precedent. I do not master German or French sufficiently well to be able to submit abstracts in these languages.

    • The UK Supreme Court has recently decided two interesting cases on harsh remedies for breach of contract (the penalty doctrine). I will give approximate descriptions of the cases and compare the outcome in the UK Supreme Court with the likely outcomes and reasonings as if the cases were tried by the Swedish Supreme Court. My conclusion is that the outcomes would be similar. The reasonings would differ slightly, but not much. The applicable types of sources of law, however, differ considerably.

    • The perspective taken in the contribution is broader than consumer dispute resolution and alternative dispute resolution (ADR) encompassing EU law developments in civil justice and the impact that the EU has on civil procedure and dispute resolution as a whole. The aim is to thereby provide to a broader perspective on the current development of ADR in the EU. The particular aim is to highlight two issues. First, when the EU acts to create special rules for consumer dispute resolution and ADR, the whole dispute resolution system, i.e., the whole entity of EU civil justice, needs to be taken into account in order to achieve a regulatory coherent and efficient justice system. Second, certain weaknesses have been identified in using ADR as a regulatory choice in order to achieve effective enforcement of law and efficient access to justice. It is posited that these findings should be remembered and taken into account when the EU further develops ADR both generally and in particular for consumer matters.
