    • Purpose: This study aims to empirically evaluate the effectiveness of government auditing of local authorities’ compliance with the procurement rules.Design/methodology/approach: A diff-in-diff approach is used where the measure of compliance is (changes in) the incidence of private litigation under the Public Procurement Act, in audited vs non-audited municipalities. Further, semi-structured interviews were conducted with chief procurement officials.Findings: No statistically significant effect is found. While strong effects of audits can be ruled out, the statistical results and the interviews do not, however, contradict a modest but long-lasting effect.Originality/value: Few studies have addressed the effect of public procurement auditing on compliance. This study develops an empirical framework and presents empirical results.

  • The perks of being an attractive public customer

    • Purpose – In industrial buyer–supplier relationships, being an attractive customer has been found to result in superior supplier performance. However, there is a limited understanding of how these benefits transfer to the public domain. This study aims to explore the influence of customer attractiveness on supplier resource mobilization efforts toward the public sector.Design/methodology/approach – A qualitative approach was used, focusing on in-depth interviews with 23 informants from 3 critical and complex supplier markets. The data were processed using inductive coding and thematic analysis.Findings – The findings indicate that customer attractiveness in the public sector influences suppliers’ mobilization efforts on several dimensions. In addition to stimulating competition in the tender phase, customer attractiveness can yield important benefits to quality, supply stability and innovation during the business relationship. It appears imperative for the public sector to improve its standings with suppliers to both mitigate the apparent risk of sub-par treatment and to unlock the preferential supplier treatment associated with being an attractive customer.Social implications – Receiving increased mobilization from suppliers will result in better use of public money and help improve resilience and innovation in public procurement.Originality/value – This study extends the research on customer attractiveness in the public sector by being the first to explore the range and nature of its influence on supplier mobilization efforts.

  • How to increase the uptake of circular public procurement? : Lessons learned from local authorities in Sweden

    • Purpose: Circular procurement is assumed to foster innovation and influence demand for and supply of goods through criteria setting and dialogue with suppliers. However, even in countries placed at the forefront of sustainability practices such as Sweden, examples of procurement that can truly be considered to be circular are rare. This paper aims to examine circular public procurement practices in a selection of Swedish municipalities and regions through the lens of the Advocacy Coalition Framework. The authors propose a categorisation of municipalities by circular procurement uptake and identify factors that support the acceleration of the circular transition in Sweden. Design/methodology/approach: Using the key informant approach, the authors conducted semi-structured interviews with employees of seven municipalities, one region and one external procurement agency, as well as seven suppliers of various sizes. The authors also analysed procurement documents received from municipalities. Participating organisations represented a variety of Swedish local government structures and local conditions. Findings: The authors proposed a categorisation of circular procurement uptake. Notably, beginners differ from leaders in circular procurement, most importantly by the level of flexibility policy brokers have within their organisations and by policy brokers’ ability to accommodate changes that materialise between existing organisational structures and set routines. Social implications: The fragmented uptake of circular procurement poses a challenge for local businesses interested in implementing circular business models. It also both highlights and exacerbates inequalities in access to resources between sparsely populated, rural municipalities and more urbanised areas. Originality/value: Despite existing national government guidelines for the circular economy transition in Sweden, circular procurement is not fully realised at the local level. In this paper, the authors examine the Swedish experience with circular procurement and propose several steps to improve the uptake of circular procurement by the public authorities. The authors' findings concerning the role of policy brokers may well be generalised to similar socio-cultural contexts.

    • Combinatorial procurement auctions are increasingly being employed in the private and public sector as an alternative to simultaneous single contract auctions. This mechanism has the advantage that it enablessuppliers to express synergies across bundles of public contracts. This mitigates the exposure problem and also has the potential to both lower the price paid by the procuring authority and enhance efficiency. Thispaper provides stylized facts of recently performed combinatorial public procurements in various markets in Sweden.

    • This paper is an empirical analysis of firs-price sealed bid procurement auctions in Sweden, with and without combinatorial bidding. The data comprises procurement auctions of identical contracts (road resurfacing) with identical bidders under the same time period (2009-2011) in two different regions in Sweden. Given the comparison of the suppliers' offered price per tons of asphalt, we cannot reject the hypothesis of identical distribution of standalone bids generated in both types of auction. The distribution of package bids within the combinatorial format is significantly lower than the distribution of standalone bids within the non-combinatorial format, suggesting substantial cost reduction of allowing package bidding. Also, within the combinatorial format, our analysis od data indicates higher costs when packages are predetermined by the purchaser rather than chosen freely by the suppliers.

    • Purpose: Several sectors, especially the construction industry, use unit price contracting (UPC). This contracting form provides agents, ex ante, with estimated quantities of the work to be done. Competing agents then offer corresponding unit prices i.e. the bid is a price vectors, and most often the lowest vector sum is awarded the contract. This way of procuring is not only transparent but also entails a potential problem of unbalanced bidding. Unbalanced bidding occurs when an informed agent skews unit prices to win the ex ante bid. The concept is not new topic in research, but theoretical models from an economics perspective are not extensive.Design/methodology/approach: This paper will focus on how competition among informed bidders will affect the optimal solution.Findings: It is shown that skewing is still a dominating strategy under competition. However, competition will decrease, but not necessarily eliminate, information rents.Originality/value: In this setting, unbalanced bidding could mainly be seen as a way to win the contract and not to extract information rents. Thus, it would not constitute an efficiency problem for the client.

    • While implementing the EC Procurement Directives in Swedish legislation, there remains a reference to 'business-like' (affärsmässig) practice as an external system of norms. The problem is that the term a. might contradict non-economic considerations in the award of contracts. Municipal procurement is often managed by professionals with limited legal expertise, and diverging practices are found. In recent years, the term a. has spread to court practice in other fields and even to one act belonging to private law. The term a. appears as a chameleon, since when used in a context of private law, it conveys a sense of transparency and objectivity traditionally associated with the operation of the legal system rather than with private business practices.
