  • Marine ecosystem bodies as entangled environments and entangled laws: drones and the marine environment

    • The adoption of the 1982 UN Convention on the Law of the Sea (UNCLOS) and the steady development of international environmental law in the twentieth century shaped the marine environment as an object of legal protection. However, the exponential growth of substantive obligations to protect the marine environment, conserve marine biodiversity, and prevent marine pollution, has been largely ineffective due to lack of enforcement. Unmanned aerial vehicles (UAVs) deployed for marine environmental protection are seen, in scholarship and policy, as a means to close the enforcement gap, thereby revolutionizing the field by significantly increasing states’ maritime awareness. In contrast, our tentative analysis shows that while UAVs can translate complex environmental concerns into data readily available for analysis and action, such datafication of marine environments comes with high risks. More specifically, datafication enables multiple uses of gathered data, including for surveillance, military, and commercial purposes. These concerns tend to fall outside current debates on the international regulation of the use of UAVs in marine environments. In our essay, we explore whether international law recognizes the possibilities and risks involved in deploying UAVs into the marine environment. We draw on doctrinal and posthuman feminist legal approaches to analyze how UAVs interact with the wider context of “marine ecosystem bodies” in terms of international law, as well as how those terms may need to be reconfigured to accommodate the complexity of the many actors, agents, and materials of marine ecosystems.

  • Regulation of ships at anchor: Safety and environmental implications

    • Ships waiting at anchor are associated with considerable environmental pressures and impacts. Growing and congested anchoring areas are receiving increasing scholarly attention to understand the environmental effects caused by large sea-going ships anchoring in coastal waters. While there is a lack of studies addressing the entire spectrum of environmental pressures and impacts from ships at anchor, ranging from scouring of the seafloor, operational emissions and discharges and waste from maintenance carried out while at anchor, it is well established that anchoring is associated with such pressures. This article takes a problem-oriented approach since there are potential cumulative environmental impacts of ships waiting at anchor. From both a public and private law perspective, we examine the legal structures and challenges associated with the regulation of ships waiting at anchor. We also analyze the public and private law factors that may limit the ability to prevent harmful anchoring practices. Our examination shows that while coastal states have significant jurisdictional powers to regulate anchoring in coastal waters, the current international regulatory framework addresses anchoring incidentally and lacks mechanisms for considering the cumulative impacts of anchoring. Furthermore, the incentives for ships to spend a considerable amount of time at anchor appear to differ substantially across different types of charterparties. Improved regulation requires better scientific knowledge, substantial mapping of legal structures, and a stakeholder survey providing a basis for the exploration of potential contractual practices that may reduce market incentives for anchoring.

  • Costs and resource utilization for diagnosis and treatment during the initial year in a European inflammatory bowel disease inception cohort : an ECCO-EpiCom Study

    • BACKGROUND: No direct comparison of health care cost in patients with inflammatory bowel disease across the European continent exists. The aim of this study was to assess the costs of investigations and treatment for diagnostics and during the first year after diagnosis in Europe.METHODS: The EpiCom cohort is a prospective population-based inception cohort of unselected inflammatory bowel disease patients from 31 Western and Eastern European centers. Patients were followed every third month from diagnosis, and clinical data regarding treatment and investigations were collected. Costs were calculated in euros (&OV0556;) using the Danish Health Costs Register.RESULTS: One thousand three hundred sixty-seven patients were followed, 710 with ulcerative colitis, 509 with Crohn's disease, and 148 with inflammatory bowel disease unclassified. Total expenditure for the cohort was &OV0556;5,408,174 (investigations: &OV0556;2,042,990 [38%], surgery: &OV0556;1,427,648 [26%], biologicals: &OV0556;781,089 [14%], and standard treatment: &OV0556;1,156,520 [22%)]). Mean crude expenditure per patient in Western Europe (Eastern Europe) with Crohn's disease: investigations &OV0556;1803 (&OV0556;2160) (P = 0.44), surgery &OV0556;11,489 (&OV0556;13,973) (P = 0.14), standard treatment &OV0556;1027 (&OV0556;824) (P = 0.51), and biologicals &OV0556;7376 (&OV0556;8307) (P = 0.31). Mean crude expenditure per patient in Western Europe (Eastern Europe) with ulcerative colitis: investigations &OV0556;1189 (&OV0556;1518) (P < 0.01), surgery &OV0556;18,414 (&OV0556;12,395) (P = 0.18), standard treatment &OV0556;896 (&OV0556;798) (P < 0.05), and biologicals &OV0556;5681 (&OV0556;72) (P = 0.51).CONCLUSIONS: In this population-based unselected cohort, costs during the first year of disease were mainly incurred by investigative procedures and surgeries. However, biologicals accounted for >15% of costs. Long-term follow-up of the cohort is needed to assess the cost-effectiveness of biological agents.

  • Initial Disease Course and Treatment in an Inflammatory Bowel Disease Inception Cohort in Europe : The ECCO-EpiCom Cohort

    • Background:The EpiCom cohort is a prospective, population-based, inception cohort of inflammatory bowel disease (IBD) patients from 31 European centers covering a background population of 10.1 million. The aim of this study was to assess the 1-year outcome in the EpiCom cohort.Methods:Patients were followed-up every third month during the first 12 (3) months, and clinical data, demographics, disease activity, medical therapy, surgery, cancers, and deaths were collected and entered in a Web-based database (www.epicom-ecco.eu).Results:In total, 1367 patients were included in the 1-year follow-up. In western Europe, 65 Crohn's disease (CD) (16%), 20 ulcerative colitis (UC) (4%), and 4 IBD unclassified (4%) patients underwent surgery, and in eastern Europe, 12 CD (12%) and 2 UC (1%) patients underwent surgery. Eighty-one CD (20%), 80 UC (14%), and 13 (9%) IBD unclassified patients were hospitalized in western Europe compared with 17 CD (16%) and 12 UC (8%) patients in eastern Europe. The cumulative probability of receiving immunomodulators was 57% for CD in western (median time to treatment 2 months) and 44% (1 month) in eastern Europe, and 21% (5 months) and 5% (6 months) for biological therapy, respectively. For UC patients, the cumulative probability was 22% (4 months) and 15% (3 months) for immunomodulators and 6% (3 months) and 1% (12 months) for biological therapy, respectively in the western and eastern Europe.Discussion:In this cohort, immunological therapy was initiated within the first months of disease. Surgery and hospitalization rates did not differ between patients from eastern and western Europe, although more western European patients received biological agents and were comparable to previous population-based inception cohorts.

  • Description of two new Cisticola species endemic to the marshes of the Kilombero floodplain of southwestern Tanzania

    • The presence of two undescribed cisticola warblers in the marshes of the Kilombero floodplain in central Tanzania has been known since the 1980s and these putative new species have been illustrated in field guides on African birds, although with no formal name. Here we name both species, based on two museum specimens collected in 1961 and recently detected in a museum collection. We use these specimens to provide formal descriptions of each form and, using DNA sequence data extracted from these specimens, we place them in a broad phylogenetic framework for the genus Cisticola. The phylogenetic placement indicates that one of the new species is nested within a group of plain-backed duetting cisticolas and the other within the streak-backed marsh cisticolas. We use our own and public recordings to characterize the vocal repertoire of each of these new species and compare song characteristics with other members of their respective clades. Dating of nodes in the molecular phylogeny suggests that both cisticolas endemic to the Kilombero became isolated and diverged from their sister-species between 2.5 and 3.5 million years ago, long after the formation of the Eastern Arc Mountains and the Malawi Rift. We propose that both species should be classified as globally endangered, owing to immense anthropogenic pressures on the floodplain, as documented in several publications and by a recent Ramsar Advisory Mission.

    • The ocean provides essential ecosystem services such as food production, off- shore renewable energy, carbon sequestration, and recreation. However, scientif- ic evidence warns us about the severe impacts the ocean is facing due to pollution, unsustainable fishing practices, and climate change effects. These effects include ocean acidification, biodiversity loss, and sea level rise. From international, EU, and national perspectives, there is an outspoken aim to boost the ‘blue’ economy while securing healthy marine ecosystems. However, the legal system handling these integrated demands is diverse and fragmented regarding sectoral aims, geographical areas, and governance levels. In their current form, they are not designed or fit to provide an ecosystem-based approach to managing human–ocean relations or to implementing the objective of a healthy and sustainable ocean. To integrate legal competence relevant to ocean governance in both practice and theory, scholars of different legal areas within the Department of Law col- laborate internally and, more importantly, with scholars within other disciplines and actors outside academia. Our ambition is for this interdisciplinary endeavor to prompt changes in socio-environmental governance structures and legal ed- ucation. From a socio-environmental perspective, we examine opportunities to integrate our knowledge of different legal areas and improve our transdisciplinary capacity. We analyze and discuss challenges, drivers, and pathways to provide knowledge supporting a transformation to a more sustainable blue economy. From a legal education perspective, interdisciplinarity requires a problem-based approach and the introduction of threshold concepts that shape how we apprehend a particular phenomenon. Ocean governance is an example of a concept providing a valuable opportunity for broader legal reasoning and for finding meaning- ful connections between national, regional, and international law.

  • Bioprospecting and deep-sea genetic resources in a fragmenting international law

    • This thesis investigates if public international law manages to function as a coherent system in the case of deep-sea bioprospecting, where rules in three regimes provide seemingly inconsistent obligations for states. Based on an investigation of the development of bioprospecting and patenting of deep-sea genetic resources, the study explores how rules in the United Nations Convention on the Law of the Sea (UNCLOS), the Convention on Biological Diversity (CBD) and the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights (WTO TRIPS) apply to such activities. It is illustrated how rules of these treaties provide different and seemingly inconsistent obligations for states in the context of deep-sea bioprospecting. This is explained by their origin in different regimes of public international law with distinctively dissimilar perspectives on the appropriation of genetic resources. It is discussed how the prima facie norm conflict in some cases can be resolved on the basis of the principles on treaty application and interpretation under the Vienna Convention on the Law of Treaties. In other cases, such as the obligations for bioprospecting of deep-seabed micro-organisms, states are faced with an irreconcilable dilemma; the different treaty obligations cannot be simultaneously applied. In order to prevent such conflicts and ensure the credibility of international law as a functioning system, new approaches are suggested, in particular the development of holistic conflict clauses and lex specialis. The case of deep-sea bioprospecting calls for a more state-oriented perspective in the debate on the fragmentation of international law.
