- This doctoral thesis examines the different forms of procedural communication available to the Swedish courts. The choice traditionally stood between oral and written procedure. Today the procedure in the general courts is dominated by the principle of orality, while in the administrative courts, procedure chiefly takes the written form. This being said, the types of communication procedures used in courts today are constantly changing, the reason being, in part, the advent and advancement of new communication tools such as telephone, video and the internet.The cardinal aspiration for this doctoral thesis has been to prepare a generous substructure that will allow an assessment of how the principles that constitute the foundation for the choice of a form of procedural communication stand up against the arrival of new conditions. In attaining this goal the thesis takes stock of, structure, and evaluate the current knowledge of the regulation of the forms of procedural communication and the arguments that have been put forward regarding its design and application.The chosen method is a rhetorical-topical audit of the arguments provided by the legislative community. In addition it examines the relationship between these arguments and the activities of the courts and includes a comparative analysis of the current and historic conditions of the procedural communication forms.In the thesis nine different principle topoi (argument sources) for the analysed argumentation are identified and discussed: The Purpose of the Proceedings, Security, Speed, Cost-effectiveness, the European Convention on Human Rights and Fundamental Freedoms, the Decision-making, the Parties, Publicity and the Rules and Regulations.

Reactions in the System Nitro-cellulose/ Diphenylamine with Special Reference to the Formation of a Stabilizing Product Bonded to Nitro-cellulose

- The methods HPLC, microcalorimetry and FTIR together with chemometry, provide good analytical tools to follow the degradation of nitro-cellulose.The degradation products formed from diphenylamine (DPA) during storage can be followed with HPLC. FTIR, together with chemometry, also gives the precision needed for safety control of propellants.Nitro-cellulose (NC) containing DPA obtained a green colour already after 1 day storage at 70°C. About 10% of the stabilizer, and its derivatives, added were not extractable giving an extended time to autocatalysis. This time could be extended up to 70 days at 70°C for an extracted sample compared to about 3 days for non-stabilized NC. This was not shown before.Aged and extracted NC samples contained a non-extractable nitro compound. The most likely compound is 2,4´-dinitroDPA, probably bonded to NC via the amine nitrogen. The bonding to NC occurs after the formation of NNODPA. This is something not described before.Using another batch of nitro-cellulose to find out if a chemical bonding occurs gave inconclusive results as a blue NC was formed. Low molecular NC with high stability was obtained. A chemical bonding probably occurs when using NNODPA as a stabilizer, indicating NNODPA plays a key role.The use of FTIR/chemometry is a promising method to use when studying small chemical changes. The described methodology should be used to find out more about the compound(s) being bonded to NC.

- This thesis is concerned with the impact of Community law on provisional judicial protection in Swedish courts. Attention is focused mainly on security measures in civil proceedings according to chapter 15 of the Swedish Code of Judicial Procedure and on stay of execution and other orders for interim relief according to section 28 of the Swedish Administrative Courts Procedure Act (1971:291). Two typical cases attract most of the attention. The first is when the compatibility of national law with community law is challenged and the second when a Community act is alleged to be invalid. An important question for the thesis is what is required for provisional judicial protection in the stated situations, that is, what are the conditions for interim measures in each case. The three preliminary rulings Factortame I, Zuckerfabrik and Atlanta are discussed in detail. The European Court of Justice refers to its own case law on interim measures when it comes to the conditions national courts must consider in certain cases. This case law is examined from a Swedish perspective. Further the significance of the main matter at issue encompassing a conflict of norms on the trial of interim measures is discussed.
