    • Introductory chapter to the volume. This book aims at taking stock of the state of the rule of law in the EU 30 years after the fall of the Berlin Wall. It pays special attention to the chal- lenges that the EU Member States from CEE and their citizens have been facing in the transition to democracy and the rule of law, and in the process of EU accession. But the book also inquires, more broadly, after the causes for what appears to be a more general weakening, if not an outright crisis, of the rule of law in the Union. Furthermore, the book reflects on the way forward, weigh- ing alternative approaches for curbing instances of democratic backsliding in individual EU Member States and ensuring robust and sustainable rule of law in the Union. Crucially, the book addresses the question: What is and what should be the role of EU institutions in upholding the rule of law in the Union and its Member States?

    • Historically, the Court of Justice of the European Union (CJEU) has played a central role in the development of the EU’s legal system. Although it is a judicial institution, the Court’s decisions are often regarded as “political” because of their strong impact on the economic and social conditions of Member States. This report deals with the juridico-political tension in the development of EU law. It presents some of the main findings of a research project from the University of Gothenburg which explores the relationship between the CJEU and Member State governments in the interpretation of EU law.

    • This Chapter provides a doctrinal perspective on the EU Screening Regulation. It seeks to present, clarify, and assess the very rules contained therein. Following a sketch of the way in which the rules are organised in the Regulation, the chapter discusses in more detail the rules which are directed at the establishment of ï¿œa framework for the screening by Member States of foreign direct investments into the Union on the grounds of security or public orderï¿œ. It continues by critically assessing the rules which create the ï¿œmechanism for cooperation between Member States, and between Member States and the Commission, with regard to foreign direct investments likely to affect security or public orderï¿œ. The chapter closes with a brief summary and outlook.

    • In today’s networked world, technology shifts happen faster than most people even realize. Some of these shifts have made us all potentially powerful: media powerful. We used to sit in silence in front of newspapers and TV screens and the world was explained to us by the few “who always knew what was right and wrong.” Today, thanks to the Internet, social media, and Web 2.0, we can not only share our own thoughts with everyone in a more self-determined way, but we can also take part in public debate and even co-organize it ourselves. Of course, the Internet is not the counter-draft to the communication (power) structures of the past. Gains in communicative self-determination are threatened due to algorithmization, platformization, and value extraction from self-created private markets in data capitalism. However, there is arguably more potential for self-determination in the technology relating to the Internet, social media, and Web 2.0 when it comes to mass communication by individuals than there has ever been before with “old media.”

  • The art of casting political dissent in law: The EU’S framework for the screening of foreign direct investment

    • This paper describes and analyses the EU Regulation establishing a framework for the screening of foreign direct investments (FDI) into the Union. The negotiations that preceded the adoption of the Regulation were characterized by greatly divergent views of Member States on the proper use of FDI screening. Under such conditions, the Regulation's framework for administrative cooperation and information sharing was as much as the Commission could hope for. The main challenge going forward lies in balancing the policy priorities of individual Member States in determining what constitutes a threat to security and public order, with the needs of the collective, that is the EU. In that respect, the indicative criteria set out in the Regulation may initiate a drive towards a rough consensus. While any ambition to fully harmonize FDI screening has now become only a long-term goal, this paper finds that the Regulation has established a nascent EU screening mechanism, albeit a well-camouflaged one.
