Statssuveränitet och humanitär intervention - (o)förenliga principer i dagens globaliserade värld

- Föreliggande paper diskuterar begreppen (o)förenligheten hos begreppen statsuveränitet och humanitär intervention (eller rätten till skydd). I texten visas att synen på humanitär intervention har genomgått flera förändringar sedan FN-stadgan skrevs, inte minst under 1990-talet och kalla krigets slut. Författaren diskuterar några traditionella argument pro respektive contra humanitär inter-vention och argumenterar för att begreppen statssuveränitet och humanitär intervention faktiskt är förenliga inom ramen för FN-stadgan om FN:s medlemsstater kommer överens om vad som skall utgöra grund för humanitär interventioner på förhand och överger den ad hoc-praxis som tillämpats under senare år. Författaren argumenterar också för att debatten idag inte ytterst handlar om världssamfundet skall intervenera på humanitär grund, utan hur man skall göra det. Vidare argumenteras för att FN måste reformeras och att medlemsstaterna under generalförsamlingens möte hösten 2005 måste visa upp såväl politiskt mod som politisk handlingskraft.

“Visual Literacy and Translation”

- This article questions one of the narratives that dominate our disciplinary and professional discourses on translation, namely the narrative of visibility of translation as a means of promoting better understanding and increasing the symbolic and materialistic value of translation. It starts with arguing that the majority of the metaphor discourse is limited due to the fact that it focuses on verbal approaches. Examples of interpretations of visibility as a means of public engagement, visibility in terms of its sense proper, are then offered, including Venuti’s Invisibility of the Translator (1995). The article ultimately argues that translators and translation scholars have to rethink the text-based strategies that dominate scholarly engagement and have to consider visibility in the context of contemporary media and visuality-driven consumer society in order to develop suitable theoretical models to think about visibility that enable translators to negotiate strategies actively rather than reactively.

An Empirical Approach to Separation of Powers Research in the EU – Introducing the SepaRope Judiciary Dataset

- The idea that public powers should be shared between the legislature, the executive, and the judiciary is foundational in constitutional theory as well as practice. While separation of powers is, as a concept, well established, its meaning is not. This is particularly true in the case of the EU, whose institutional set-up and the allocation of powers does not reflect the traditional trias politica. Against this background, the project Separation of Powers for 21st Century Europe examines how, within the EU, the different branches and levels of government co-determine each other's powers, how they contribute to or hinder democratic will-formation, and how they serve or fail to serve as each other's checks and balances. In this paper, we describe the first results of an empirical analysis of the EU Court of Justice's exercise of public powers in relation to other EU and Member State actors. Our observations not only enrich traditional, doctrinal legal analysis of individual judgments, but also help us identify accountability and legitimacy gaps in the EU constitutional infrastructure, ultimately forming the basis for the construction of empirically-grounded principles for strengthening and maintaining a feasible separation of powers concept in the EU.

- An eternal fight between Good and Evil fuels the imaginaries of the European Radical Right (ERR) in a psychology of continuous panic-mongering. Is Europe the bulwark and pinnacle of Western civilization, the safe haven of Christianity, tradition and family values or has it turned into a dystopian oppressive dictatorship of ‘globalist’ Eurocracy? The imminent end of European civilization as we know it has received many names in the ERR such as the ‘breaking point’ in UKIP-rhetoric, ‘systemkollaps’ in Swedish (the ‘breakdown of the system’) or ‘Asylflut’ in German (the ‘refugee deluge’ – a biblical trope of scourge).
