  • EU Criminal Law Relocated : Recent Developments

    • This paper seeks to chart recent developments in EU criminal law with particular emphasis on case law delivered after the entry into force of (and in the run up to) the Lisbon Treaty. It begins by set-ting the scene of EU criminal law post the Lisbon Treaty, by briefly sketching the main changes as provided by this Treaty. The specific focus of this paper is however the operation of mutual recognition in this area and the implications of citizenship rights as demon-strated in the Wolzenburg case. In addition, the paper cautiously looks at the notion of an ‘autonomous interpretation’ of EU crimi-nal law as implied by the Court in the recent Mantello case as well as briefly examining the IB case regarding the scope of mutual rec-ognition in the present field.

  • EU Data Protection Rules and the Lack of Compliance in Sweden

    • In this short reflection paper, I will set out to explain how and why Sweden breaches EU data protection rules. I will start by providing a brief overview of the EU data protection framework to paint the background picture. Thereafter I will discuss the scope for derogating from the obligations set out in the GDPR and thereby test the Swedish exception and show that it is not proportionate and undermines the purpose of the GDPR. Subsequently, I will discuss why some core fundamental rights of EU law should not be possible to derogate from, when as in the Swedish case it seems to boil down to economic question of who gets to own the data. I will conclude by linking the question of the right to data protection and why licenses should not give companies a carte blanche to publish personal data about people in Sweden to the question of market access. There is an imbalanced relationship here, to use the internal market vocabulary, with Swedish people having all their private data published online while other EU states do not do that. Likewise, there is an external dimension here: the data is available on the internet globally and therefore third countries also access it.

    • If the state outsources a responsibility to private actors to plant trees, is that necessarily a bad thing? Surely, one would think not. Still, in constitutional theory, there are many forceful arguments against privatisation. One of the core arguments against privatisation is the question of who ought to do what and what it means for a policy area to be inherently public. In this paper, I am interested in varieties of privatisation and in particular what privatisation means in the context of climate change. The aim of the paper is to show that precisely because there is a variety of privatisation, in some areas, such as the environment and regarding climate change, we may discuss the question of ‘duty’ rather than privatisation as such.

    • The COVID-19 pandemic has raised many intriguing questions both in the EU and globally, from the critical task of safeguarding lives to technical legal issues about competences to regulate health as well as the boundaries of emergency laws. This paper is interested in the connection between non-domination theory and the EU’s constitutional structure in the context of emergency laws. A key theme of the paper is that risk and emergencies are nothing new in an EU context, but concepts used by the legislator in a wide range of policy areas which give rise to a number of constitutional challenges. The paper sketches out the main characteristics of non-domination and republication theory and addresses the question of how and why the notion of non-domination may be useful for understanding the EU constitutionalism venture in the framework of risk and emergency laws.

    • The notion of solidarity is a key constitutional concept in EU law, but its exact meaning remains somewhat vague. What, if anything, is ‘constitutional’ about solidarity we may readily ask? It could be argued that solidarity is connected to the structure of EU law and linked to the very idea of trust, loyalty, and interdependence between the Member States. Moreover, solidarity appears to have many traits that are similar to the notions of fairness and justice, and values in the EU. In this article, I will trace and discuss the similarities between solidarity on the one hand and other constitutional concepts such as the idea of a ‘constituent power’ and non-domination on the other in order to further clarify their meaning and interdependence.

    • In this paper I discuss Claudio Corradetti’s recent fascinating book on Relativism and Human Rights, A Theory of Pluralist Universalism (Springer 2022, 2nd ed.) by focusing on the global reach of human rights and its implications for law. The paper discusses, inter alia, what relativism conceivably means in the context of EU and international human rights. Moreover, the paper examines human rights and justice in the context of universality. The paper concludes by briefly looking at peace and war theory and argue for its salience for understanding the framework of global human rights protection.

    • This paper explores the constitutional dimension of comparative criminal law procedure in a European context. It does so by focusing on the European civil law traditions and by explaining how the impact of constitutional law reasoning has changed the criminal law landscape. The paper argues that the influence of European Union law and the European Convention on Human Rights regime together with other comparative law effects have led to an adapted version of the comparative law project, where the orthodox distinction between civil law and common law is largely erased. Specifically, the paper focuses on the question of fairness and justification in the criminal law process, the principle of proportionality and the notion of dignity in a comparative perspective. The paper draws on both doctrinal and theoretical examples.

    • The Kantian project of achieving perpetual peace among states seems (at best) an unfulfilled hope. Modern states’ authority claims and their exercise of power and sovereignty span a spectrum: from the most stringently and explicitly codified—the constitutional level—to the most fluid and turbulent acts of war. The Public Uses of Coercion and Force investigates both these individual extremes and also their relationship. Using Arthur Ripstein’s recent work Kant and the Law of War as a focal point, this book explores this connection through the lens of the (just) war theory and its relationship to the law. The Public Uses of Coercion and Force asks many key questions: what, if any, are the normatively salient differences between states’ internal coercion and the external use of force? Is it possible to isolate the constitutional level from other aspects of the state’s coercive reach? How could that be done while also guaranteeing a robust conception of human rights and adherence to the rule of law? With individual replies by Ripstein to chapters, this book will be of interest to students and academics of constitutional law, justice, philosophy of law, criminal law theory, and political science.
