    • This dissertation deals with the position of working parents in labour legislation and the protection. The starting point for the thesis is that the rules in labour law concerning employees? parenthood, despite the fairly strongly formulated protection of their rights, in practice have a relatively weak normative position in working life and in labour law. The weakness of the rules on parenthood can be explained as a result of a normative conflict, or incoherence, affecting the judicial sphere, which means that deviating norms and values encroach on the rules about parenthood and weaken their position. The central aim of the dissertation is to elucidate and analyse this normative conflict, against the background of an account of the content of the relevant legal rules. To achieve this purpose requires specially studying the weakness of the rules on parenthood due to gender-related notions about employees and parents which exist in society, and which are also expressed in the law and the legal argumentation. Initially the dissertation surveys the content of the legal rules concerning employees? parenthood during the hundred years they have existed, cites the argumentation concerning these rules, and clarifies and discusses the changes in values reflected by this legislative development. The following chapter, chapter three, is devoted to gender-related notions about parents in everyday life. Chapter four examines how gender-related ideas about employees influence the formal and informal conditions that determine the ability to combine work with parenthood. Chapters five, six, and seven investigate the special rules of labour law, both EC law and Swedish law, which apply to employees who have parental responsibility or are about to have parental responsibility. The eighth and ninth chapters deal with rules related to parenthood in the large context of labour law to which they belong. This leads to a more complete analysis of the meaning of the rules on parenthood. In the tenth and last chapter there is a theoretical discussion of the central issues raised in the book. Here the basic questions posed by the dissertation are also linked to a forward-looking analysis based on recent developments in working life.

    • This article deals with the legal understanding of the demands in working life on employees’ability to cooperate. The concept of cooperation ability is here used in the sense of an ability to actively facilitate communication and foster relationships with colleagues and supervisors through flexibility and commitment, and thereby benefit the employer’s business. Special attention is paid to the discourse on employability in the employment policies at the EU level,and on the understanding of cooperation as a field in which it is possible to possess and acquire specific skills. The main aim of the article is to survey and conceptualize the demands on employees’ ability to cooperate in labour law, and to explore a number of important legal questions relating to employees’ ability to cooperate. The purpose is primarily exploratory, in the sense that the article seeks to discern new and special problems confronting labour law as a result of the increased demand for employee’s cooperation at work. To this end the article identifies three important issues: the legal implications of the fact that the employer is free to take the employee’s ability to cooperate into consideration when making work-related decisions, the question of the extent to which the employment contract can be said to include a duty to cooperate, and the legal implications of the fact that employees are sometimes unable to cooperate due to external factors at work. These three issues provide the structural basis for the discussion, which, primarily with the use of examples from the Swedish setting, seeks to identify some key questions in labour law arising out of a legal development that involves an acceptance of stricter requirements on employees’ ability to cooperate.

    • This article identifies, conceptualizes and analyses a normative conflict, embedded in social practises and conceptions on gender in the institutional framework of the market, which underlies labour law regulation as well as legal argumentation regarding working parents. The article evinces and models the basic structure of vital mechanisms operative in weakening parental rights in working life and labour law. The model is fleshed out inductively, using examples from Swedish national law, where the protection of parental rights is fairly strongly formulated, but where, in the same time, the provisions concerning employees’ parenthood have a relatively weak position in the living law. The weakness is explained as a normative incoherence, as expressed in labour law adjudication. In their application, legal provisions to support parental caring and gender equality thus can be forced to give way to encroaching norms based on the value of market efficiency.
