    • The paper presents an ontology-based approach to the comparison of property transactions. The approach developed within the framework of the COST Action Gg 'Modelling Real Property Transactions' extends first initial comparisons of process models to a formal, ontology-based methodology which supports domain experts in the detailed analysis of differences and commonalities between national property transactions. We demonstrated the feasibility of applying our approach by modelling and comparing purchase processes in Denmark and England/Wales.

    • Despite the common seventy-year history, post-Soviet states have differently developed their land sectors. Belarus has also experienced its own way in development of land administration, which might be characterized by domination of state land ownership and underdeveloped land market. The paper aims to address significant changes occurred in land policy of Belarus after declaration of independence in 1991. It particularly concerns innovations in land tenure system, land use planning and taxation, land development and land information. This paper also highlights innovative trends in technologies employed, which improved functioning of the land market. Innovative technologies such as satellite remote sensing, e-services, accurate mathematical models for mass land valuation and persistent data on land transactions are important factors for efficient land management in the country. The paper is finalised by outlining the possible ways to develop sustainable e-enabling land administration in Belarus.

    • Current development in many countries demands a new type of land professionals who willbe able not only to adequately cope with the reality but also to act efficiently in the rapidlychanging society. In other words, economical as well as legal and environmental issues mustbe taken into rapt consideration by surveyors while solving complex problems of managementof land for economic, social, and environmental sustainability. Thus, land management shallbe on the top of the modern agenda of practice and education. In particular, special attentionis to be paid to building up a capacity of land professionals at university level.One step in this direction has been made by Royal Institute of Technology (Stockholm,Sweden), which since 1996 with support of the Swedish International DevelopmentCooperation Agency (SIDA) trains Master students in property law and economics within theInternational Master programme in Land Management. This programme was from thebeginning open only for students from some specific countries. However, from autumn 2010(the application deadline is annually January 15) it will be available for students from all overthe world. The emphasis in the new Master programme is placed on land policy and landadministration with deepened studies of how to use legal, economic, and organisational toolsfor changes of rights to land without jeopardising sustainable development.

    • In Sweden as in other countries worldwide people are constantly looking for place for livingand housing demand is very keen. The Government seeks to solve this problem in the mostefficient way, i. e. to build more houses for lesser resources with the highest possibleinvolvement of private entrepreneurs into the processes. The Government is eager to providecitizens with knowledge and tools allowing them to accomplish this task with minorassistance from the state. It is to ask which steps ought to be undertaken by people in order toget own place for living? Are those steps in Sweden complicated or customer-friendly? Whichadditional mechanisms shall be developed to reduce transaction costs?This paper presents some results of the Swedish national on-going project “Home BuildingGuide” (Bygga Villa1 in Swedish) aimed at creating E-government services in the processes ofpurchasing, planning, building, and living in home. This project has merged several nationalgovernmental authorities, business companies and universities into a consortium with aim todevelop one e-entrance to all information and other e-services related to those processes.The aim of this paper is to elucidate three specific property related processes that are now inoperation in Sweden, namely property subdivision, property purchase and getting a buildingpermit. The paper describes each of three processes separately and identifies their mainactivities and stakeholders involved as a background for research questions stated in the finalpart of this paper. Descriptions are followed by evaluation and concluding remarks outliningresearch questions. The processes are graphically represented on activity diagrams.

  • Property Formation Process within an Institutional context

    • The paper generally touches upon property institutions within the land administration domain and introduces the way property formation processes might be compared among jurisdictions in respect to transaction costs generated. This paper assumes that processes are differently arranged all over the world and that countries thereby may learn from each other’s experiences. It is based on a part of the PhD research "Real property processes – An explorative study of property institutions in Belarus" defended at the Royal Institute of Technology (Stockholm, Sweden) in June 2012.Land could potentially be overused if no property rights existed. To reduce uncertainties while utilising land, formal property rights have been developed. These rights cannot exist without a legal framework facilitating property transfers on the market. Thus, institutions are specifically necessary to a property market and enhance the economic development of a country in general. If institutions do not meet the requirements of a market, economic growth is hampered.The paper elucidates on a combination of economic results of a country, institutions and transaction costs in application to a property formation process. Specifically it deals with property formation process in three European countries (i.e. Slovenia, Sweden and Belarus) from a transaction costs perspective with the aim to identify differences among them and thereby generally enrich the theoretical knowledge in the land administration domain through their comparison. The latter is based on the transaction costs generated by this specific property formation process and relatively estimated with a focus on the stakeholders involved, their functions and interactions. Therefore, such an analysis may further be applied for proposing simplified property formation processes of a country and thereby economising on transaction costs.

    • The most active sector of the real property market in Belarus deals with privately ownedapartments (mainly in multi-stored buildings), whereas the land market is regarded asundeveloped and strongly regulated by the state. This paper addresses purchase as a specificcase of property transfer with special emphasis on the available mortgage system. It is alsoaimed at identifying the obstacles in property purchasing, particularly in its organisationalframework that hinder development of the real property market.Specifically the paper considers purchase of a land plot with a single-family house on it bothheld in private ownership by the same owner. The purchase process is presented in UnifiedModelling Language (UML) notion and the developed models are supplemented withexplanatory text.Moreover, the paper assesses transaction cost (expressed in time term) of this particularpurchase for the parties involved (i.e. seller and buyer) and compares it with the similar datafor several European countries taken from “Doing Business in 2005” (World Bank 2004). Italso argues that long administrative procedures for property purchase extend the grounds forcorruption as parties may try to speed up the process by bribing public officials.

  • Real Property Processes : An explorative study of property institutions in Belarus

    • This work aims at advancing the scientific understanding of the real property processes stimulating the Belarusian property market specifically in order to promote its development. For a property market to operate efficiently, real properties ought to be able to be smoothly created and securely transferred with the aid of real property processes. These processes, after being implemented, generate transaction costs for a society, while the ways by which they are arranged can increase or decrease such costs. This research applies institutions as a theoretical ground with the transaction costs theory as a core concept for the examination of the selected property processes, resulting in a body of new knowledge on the relations between institutions, property processes and transaction costs. This study specifically investigates property formation and purchase processes in Slovenia, Sweden and Belarus through an ontological modelling supported by their descriptions. It additionally explores the content of property rights along with the existing real property legislation of the selected countries, as such are recognised as components influencing real property processes. Consequently, general descriptions of the land tenure systems of these three countries and a classification of fundamental property rights are presented. The examined property processes are compared in order to identify differences and thereby generally enrich the theoretical knowledge in the land administration domain. This comparison is based on the transaction costs generated by the specific real property processes and relatively estimated by this research with a focus on the stakeholders involved, their functions and interactions. This study places its main emphasis on property formation and property purchase processes in Belarus, while corresponding property processes of selected European countries are taken as benchmarks for new approaches. This research results in proposing simplified property processes for Belarus that may sensibly be established with the long-term aim of facilitating the functioning of the national property market and thereby economising as to transaction costs. In conclusion, the property market of Belarus would benefit from a simplification of the real property processes by utilising international practices while, however, not disregarding national peculiarities.

    • Last decade many various legal and administrative measures (including adoption of the newState registration Act as well as organisational reform) were undertaken by the Governmentto improve land administration in general and thereby to support the establishment of welloperative property market in Belarus. Good land administration implies sound land tenuresystem, which in turn shall not be overcomplicated. This paper attempts to clarify the landtenure system in the Republic of Belarus through analyzing of existing property rights,particularly the ownership right, right of life heritable possession and the right of use(permanent and temporary). Each of them is described in detail and several differences aredisplayed. Moreover, the general overview of the whole land tenure system is presented. Thepaper considers the possibilities of its simplification by decreasing the number of applicableproperty rights and, therefore, conclusions for a simplified land tenure system for Belarus areoutlined.
