  • Prohibiting Sex Purchasing and Ending Trafficking : The Swedish Prostitution Law

    • The Swedish prostitution law from 1999, now followed by Norway and Iceland, criminalized the purchaser and decriminalized the prostituted person. This is analyzed as a cogent state response under international trafficking law, particularly to the obligations set forth in the United Nation’s Trafficking Protocol from 2000. The Protocol states that a person is regarded a trafficking victim when, e.g., someone abuses her “position of vulnerability” in order to exploit her. International jurisprudence and social evidence strongly suggest that prostitution, as practiced in the world, usually satisfies this definition. Further, the Protocol urges states to reduce the demand for prostitution and to protect and assist victims, for instance by adopting laws deterring purchasers of sex, and by supporting those exploited in prostitution. Policy makers, such as the U.S. Department of State, are criticized for taking an inadequate position in face of the growing evidence from the Swedish law's impact.The article shows that Sweden has significantly reduced the occurrence of trafficking in Sweden compared to neighboring countries. It also scrutinizes some misinformation of the law's impact, showing for instance that claims alleging a more dangerous situation for those still in prostitution after 1999 were unfounded. In addition, the article addresses remaining obstacles to the law's effective implementation, arguing that in order to realize the law's full potential to support escape from trafficking, the civil rights of prostituted persons under current law should be strengthened to enable them to claim damages directly from the purchasers for the harm to which they have contributed, and for the violation of the prostituted persons' equality and dignity - a position now recognized by the government to some extent by clarifying amendments made in 2011.

    • This doctoral thesis examines labour market legislation on disability and work in Sweden, England and Germany. In order to provide increased access to the labour market for people with disabilities all three studies countries have undertaken more of less far-reaching legislative measures over a number of decades, both in line with, or as a result of, general labour and employment legislation, but also as more specific parts of the labour market regulation. Obviously legislators in all three countries, and more recently in the European Union, have realised that access to the labour market is a vital and important part of societal inclusion and participation. The study provides a legal dogmatic and comparative analysis of the field of law and raises questions about how rights are provided to individuals under these laws in the different national settings and in what way the legislation represents or reproduces different normative patterns. Three different legal areas appear all over the dissertation, these are positive measures, employment protection and discrimination law. Legislation on positive measures, such as quota-legislation and regulations on supported or sheltered employment, vary widely between the countries, as do employment protection legislation, while the disability discrimination legislation in the different countries is turning into a more EC-conform shape in line with recent EC-legislation on discrimination.

  • Realizing the Single Software Market : Cross-National Validity of Software License Agreements

    • The Internet has revolutionized the software industry, one of the world’s largest businesses. A single software market is emerging, independent of national borders, where products and services are digitally distributed. But the legal framework for software transfers is not geographically independent; relevant underlying law varies substantially between different legal systems.In this doctoral thesis, cross-national validity of certain standard software license agreements is examined as a solution to overcome national differences and improve the emerging single software market. Cross-national validity is mapped, explained, and improved under American and German law. The United States and the European Union collectively dominate the single software market. Within the EU, Germany is the most relevant legal system, and many conclusions reached under German law can be extended to the entire EU.The study identifies many current issues, caused by inter alia inherent limits of law, fundamental differences between German and American law, and problematic transferor choices. Current issues exist regarding formation, substantive content, and interpretation of software license agreements on a cross-national level. This leads to increasing legal and practical problems for the industry and individual transferors.Major and minor improvements in software license agreements and business models are suggested to achieve cross-national validity. Simple advice includes better assent mechanisms, prior disclosure, clear notice, and translating software license agreements. More comprehensive advice includes focusing on provisions that are essential from a business or technical perspective, rethinking certain business and technical choices that might lead to legal problems, making compromises over certain provisions that have only minor legal advantages but clear legal disadvantages, and choosing a way to bridge or avoid national differences regarding central provisions and practices from among available suggestions adapted to different business models.Making such improvements is becoming increasingly important as lawmakers and consumer associations in different countries become ever more active, and as developing countries become increasingly important. Improving cross-national validity will enhance legal certainty and bring us one step closer to realizing the single software market.

  • A toolbox for administrative law cooperation beyond the state

    • The purpose of the article is to identify and look into the function of a number of means of legal international cooperation in administrative law. In this discussion on function, the roles and the interplay of the different tools are highlighted as striking a balance between international cooperation, national self-determination and individual rights. Within this theoretical framework, two main types of tools are discussed with examples from environmental law, transport law, and social security law. First, tools related to the establishment of administrative networks are dealt with. Here, international organisations as a framework for administrative cooperation and other network cooperation structures are highlighted. Second, tools relating to an administrative conflict of laws perspective are treated. Here, situations of coordination, recognition of foreign decisions, harmonisation, and application of foreign law in the administrative field are explored. It is concluded that the use of the different tools make possible a balancing of the conflicting interests of international cooperation and national self-determination. Furthermore, in the legal fields treated in the article, it is difficult to see that administrative action entirely leaves the connection to the state. Rather, in the discussed examples, various structures of cooperation mean that national administrative bodies engage in international contacts as an important part of fulfilling their tasks in the national systems.

    • Species have intrinsic value but also partake in a long range of ecosystem services of major economic value to humans. These values have proved hard to quantify precisely, making it all too easy to dismiss them altogether. We outline the concept of the species stock market (SSM), a system to provide a unified basis for valuation of all living species. The SSM amalgamates digitized information from natural history collections, occurrence data, and molecular sequence databases to quantify our knowledge of each species from scientific, societal, and economic points of view. The conceptual trading system will necessarily be very unlike that of the regular stock market, but the looming biodiversity crisis implores us to finally put an open and transparent price tag on symbiosis, deforestation, and pollution

    • This open access book provides insight on how to interpret capability in ageing – one’s individual ability to perform actions in order to reach goals one has reason to value – from a multidisciplinary approach. With for the first time in history there being more people in the world aged 60 years and over than there are children below the age of 5, the book describes this demographic trends as well as the large global challenges and important societal implications this will have such as a worldwide increase in the number of persons affected with dementia, and in the ratio of retired persons to those still in the labor market. Through contributions from many different research areas, it discussed how capability depends on interactions between the individual (e.g. health, genetics, personality, intellectual capacity), environment (e.g. family, friends, home, work place), and society (e.g. political decisions, ageism, historical period). The final chapter by the editors summarizes the differences and similarities in these contributions. As such this book provides an interesting read for students, teachers and researchers at different levels and from different fields interested in capability and multidisciplinary research.

    • This chapter provides family law experts worldwide with a glimpse into and an update on the latest changes in European family law, specifically to conflict of law rules for resolving European Union (EU) cross-border family law cases and most notably those regarding responsibility for children, marital dissolution and distribution of assets after death. Examined are EU-level legal developments affecting cross-border family relationships within the 27 nations of the European Union that have been introduced primarily through significant new EU legislation and by recent case decisions by the Court of Justice of the European Union (CJEU). The changes' impacts at the national-law level on substantive and procedural family law and on national and personal (party) autonomy are illustrated using reports on the experiences across the EU. The experience of my own Member State, Sweden, is described as an example of how EU-level, increasingly harmonised family law ('international private law' primarily) is being negotiated and implemented both between and within EU Member States. This research aims to overview ongoing (and indeed ever-present) tensions between autonomy and uniformity interests within the EU, contributing to the significant existing literature on the present state of and future possibilities for 'European family law' while also introducing non-EU scholars to this growing, rather complex legal area. As the chapter's final sections describe, a steadily-increasing Europeanisation of family law is observed, co-existing with the tensions, which is reducing legal difficulties for individuals and state actors in Sweden and throughout the EU within a broader context of ongoing legal, economic and cultural globalisation. Family law, no longer taking a back seat to other EU legal areas, is today playing a remarkably prominent role.

    • The general aim of this doctoral thesis is to study the legal regulation of the managerial prerogative and how it relates to the employee’s obligation to work in Swedish, English and German law in the light of the increasing flexibilisation of working life. The ongoing flexibilisation of working life is often described as an increase in adaptability and allocative flexibility, and as a shift from traditional to atypical employment. The aim of functional flexibility, which is the main focus of this study, is to vary the content of work in relation to the changing demands of production. In order to achieve functional flexibility the employer can broaden job descriptions and the obligation to work in general, and invest in training and education. This study provides a legal dogmatic and comparative description and analysis of questions regarding the employer’s right to direct and allocate work (including the employer’s right to transfer employees and assign them new and different tasks), the industrial relations model and rules regarding information, consultation and co-determination, the employee’s obligation to work and the employer’s possibilities to achieve a variation in the employee’s obligation to work. Furthermore, the development towards a more general requirement for objective grounds with regard to decision-making in the area of the direction and allocation of work is discussed. The research approach is wide and multidisciplinary, and the aim of the study is to analyse the development and functionality of the law in relation to the flexibilisation of working life.

    • Intensifying global trade will result in increased numbers of plant pest and pathogen species inadvertently being transported along with cargo. This paper examines current mechanisms for prevention and management of potential introductions of forest insect pests and pathogens in the European Union (EU). Current European legislation has not been found sufficient in preventing invasion, establishment and spread of pest and pathogen species within the EU. Costs associated with future invasions are difficult to estimate but past invasions have led to negative economic impacts in the invaded country. The challenge is combining free trade and free movement of products (within the EU) with protection against invasive pests and pathogens. Public awareness may mobilise the public for prevention and detection of potential invasions and, simultaneously, increase support for eradication and control measures. We recommend focus on commodities in addition to pathways, an approach within the EU using a centralised response unit and, critically, to engage the general public in the battle against establishment and spread of these harmful pests and pathogens.

    • As in other areas of social engineering, Sweden is considered as world-leading in creating systems that address social inequality. One of the cases in point is the Swedish day-fine system which has been considered as pioneering by systematically considering both the wealth of the offender and the seriousness of the offence when imposing the penalty. This chapter analyses in detail the Swedish day-fine system. The case study of Sweden sheds light on the pros and cons of day-fines by recalling the discussion in Sweden prior to introducing the system and the recent academic debates on extending the use of day-fines. The chapter also offers an account of the comprehensive prosecutorial guidelines as well as an analysis of the relevant case law, particularly in relation to adjustment of day-fines. The chapter argues that the Swedish day-fine system overall must be considered as a largely successful project which holds high esteem among courts and practitioners. The common view is that it is a merit of the system that it forces the courts to consider the economic circumstances of the accused and to articulate openly for the way in which such consideration has been done.

    • The United Nations identifies the food crisis as one of the primary overarching challenges facing the international community. Different stakeholders in the food system have widely different perspectives and interests, and challenging structural issues, such as the power differentials among them, remain largely unexamined. These challenges make rational discourse among food system actors from different disciplines, sectors and levels difficult. These challenges can often prevent them from working together effectively to find innovative ways to respond to food security challenges. This means that finding solutions to intractable and stuck issues, such as the food crisis often stall, not at implementation, but at the point of problem identification. Food system sustainability means very different things to different food system actors. These differences in no way undermine or discount the work carried out by these players. However, making these differences explicit is an essential activity that would serve to deepen theoretical and normative project outcomes. Would the impact and reach of different food projects differ if these differences were made explicit? The purpose of this initial part of a wider food system research project is not to search for difference or divergence, with the aim of critique, but rather to argue that by making these differences explicit, the overall food system project engagement will be made more robust, more inclusive and more encompassing. This paper starts with some discussion on the different food system perspectives, across scales, regions and sectors but focuses primarily on the design of processes used to understand these divergent and at times contradictory views of what a sustainable food system may be. This paper draws on ongoing work within the Mistra Urban Futures project, using the food system projects in cities as diverse as Cape Town, Manchester, Gothenburg and Kisumu as sites for this enquiry.

    • Inom ramen för undertecknads uppdrag som goodwill-ambassadör för Glöm aldrig Pela och Fadime (GAPF) under året 2020 påbörjades ett tvärvetenskapligt samarbete vid Karlstads universitet som fokuserar på frågeställningen – Vad har högre utbildning med hedersrelaterat våld och förtryck att göra? Samverkande ämnesdiscipliner är folkhälsovetenskap, juridik, lärarutbildningen och socialt arbete. Forskarsamarbetet har under denna relativt korta tid utmynnat i en antologi.Syftet med denna antologi är bland annat att uppmärksamma och bidra med kunskapsstöd om det nya examensmålet i högskoleförordningen gällande mäns våld mot kvinnor i nära relationer. Fokus är att ge en övergripande bild av hedersrelaterat våld och förtryck, samt att bidra med kunskaper om våldets uttryckssätt och dess konsekvenser. Antologin utgår från de drabbades perspektiv.I boken ges handfasta råd till de universitetslärare som ansvarar för undervisning och examination rörande mäns våld mot kvinnor i nära relationer i högre professionsutbildning. Exempelvis lärare, jurister, sjuksköterskor, psykologer, tandhygienister och socionomer. Boken vänder sig till studenter i högre utbildning. Boken vänder sig också till yrkesverksamma som möter utsatta för hedersrelaterat våld och förtryck. Boken är även lämplig för beslutsfattare, för forskare och de som ansvarar för att utarbeta riktlinjer och handlingsplaner på området för mäns våld mot kvinnor, inklusive hedersrelaterat våld och förtryck.Redaktör för antologin är Marie Karlsson-Tuula, professor i civilrätt. The research provides an extensive survey of legal as well as political solutions to the protection of accrued rights and its conflict with different interests to reform the pension schemes in the respective countries under investigation as well as under the European Convention of Human Rights. The thesis has two main parts. The first part deals with statutory pensions and the focus in this part is on constitutional law and the legal institutions of property and legitimate expectations. The second part dealing with occupational and company pension schemes concentrates on contractual protection but the concept of legitimate expectations is of great importance also in this part. The in depth survey and analysis of the protection of accrued pension rights carried out in the two first parts of the thesis form an important and substantial part of the purpose with this research. In the third part of the thesis however the results of the first two parts are levitated to a more abstract level. The different solutions to the conflict between the interests to protect and the interests to reform are analysed in their societal and normative contexts. The public and constitutional law protections are compared with the private law protections in order to illustrate the difficulty in upholding the strict division between private law and public law in present society. By dissolving this division, solutions to the conflict between a protection of accrued pension rights and different interests to reform the pension schemes can be resolved on the basis of the actual content of these schemes instead of according to the legal dogmatic sys- tematisation of law.

Most of this research regards the effects of societal responses to perceived problems in families, thus underlying policy on interventions such as adoption, foster care and temporary assumption of custodianship, but also support structures that help families cope with various challenges. However, reference to the best interest of children can also be applied to a more basic issue in family policy, namely that of what is to be considered a family in the first place. This issue does not raise any questions regarding the proper conditions for when society should intervene in or change the family context of a child. Rather, it is about what social configurations should be recognized as a potentially fitting context for children to enter into and (if all goes well) eventually develop into adulthood within /.../ such that society’s default institutional arrangements allow it to have (by sexual and artificial reproduction, adoption, and combinations of these), care for and/or guard children. [This] will frame any further discussion of /.../ policies having further implications for, for example, the practices of adoption and reproductive technology, as well as regulation of custody in the event of separation or parental disagreement.

    • Enligt EG-rätten skall det råda fri rörlighet för tjänster. Sjuk- och hälsovård är sådana tjänster som omfattas av den fria rörligheten. Om allmän sjukvård i Sverige tidigare har uppfattats mer som en skyldighet för landstingen, har EG-rätten medfört att möjligheten att under vissa förutsättningar få vård i andra EU-länder utgör en rättighet för dem som är bosatta i Sverige.Rättsläget i EG-rätten är idag ganska klart. I fråga om sjukvård eller tand-vård som tillhandahålls utanför sjukhus kan en person som är bosatt i Sverige välja om den vill att vården skall utföras i Sverige eller i ett annat EU- eller EES-land. Förutsättningen är att det rör sig om vård som ges av den allmänna sjukvården i Sverige. Svenska myndigheter får ersätta utländska vårdgivare och patienten betalar endast sådana kostnader som den skulle ha betalat i Sve-rige.För vård på sjukhus har EG-domstolen godkänt att patienter får resa utom-lands för vård endast efter tillstånd från den egna staten eller försäkringskassa. Sådana tillstånd måste dock beviljas om patienten inte kan få vården eller minst lika effektiv vård i tid i den egna medlemsstaten. Sverige har ännu inte infört ett förhandstillståndssystem, men det finns planer på detta. När ett så-dant system införs, ökar myndigheternas möjligheter att avslå begäran om att få vård utomlands. Därmed begränsas svenska patienters möjligheter att söka sig till andra EU-länder. Samtidigt begränsas ovissheten om ersättning kom-mer att medges eller inte. De ekonomiska transaktionerna kring vården utom-lands behöver inte längre skötas av de enskilda patienter som får tillstånd.I den mån vårdens kringkostnader, som kostnad för resa, logi, att patienten behöver stöd av en medföljande etc. ersätts vid vårdresor inom Sverige, gäller i princip att sådana kostnader också skall ersättas när patienten reser utom-lands. Det skall råda likabehandling mellan patienter som får vård inom Sveri-ge och svenska patienter som får vård i andra EU-länder.EG-rätten innebär ett förändringstryck på svensk sjukvård. Vård skall i EU-länderna ges efter behov och inte efter betalningsförmåga. För att alla skall kunna få vård efter behov krävs någon form av kollektiv finansiering. I och med att EG-rätten gör det möjligt för enskilda patienter att ta med sig skatte-pengar utomlands utan att själva behöva betala annat än svenska patientavgif-ter, uppstår ett finansiellt utflöde. Om väldigt många patienter gör bruk av den fria rörligheten, skulle det kunna leda till dåliga finanser för sjukvården. Erfa-renheterna visar att det trots allt är ganska få patienter som verkligen söker vård utomlands. Den svenska sjukvården kan också möta ett eventuellt pati-entutflöde genom att erbjuda effektiv vård i tid i Sverige och förbättra vårdens tillgänglighet.Sammantaget kan inte rättsutvecklingen inom EU sägas utgöra ett hot mot den europeiska sociala modellen.

    • In this paper we investigate the possibility of socially assistive robots (SARs) supporting diagnostic screening for peripartum depression (PPD) within the next five years. Through a HRI/socio-legal collaboration, we explore the gender norms within PPD in Sweden, to inform a gender-sensitive approach to designing SARs in such a setting, as well as governance implications. This is achieved through conducting expert interviews and qualitatively analysing the data. Based on the results, we conclude that a gender-sensitive approach is a necessity in relation to the design and governance of SARs for PPD screening.

    • Countries worldwide have very different national regulations on human embryonic stem (ES) cell research, informed by a range of ethical values. Some countries find reason to extend the applicability of their regulations on such research to its citizens when they visit other countries. Extraterritorial jurisdiction has recently been identified as a potential challenge towards global regulation of ES cell research. This chapter explores the implications and impact of extraterritorial jurisdiction and global regulation of ES cell research on researchers, clinicians and national health systems, and how this may affect patients. The authors argue that it would make ethical sense for ES cell restrictive countries to extend its regulations on ES cell research beyond its borders, because, if these countries really consider embryo destruction to be objectionable on the basis on the status of the embryo, then they ought to count it morally on par with murder (and thus have a moral imperative to protect embryos from the actions of its own citizens). However, doing so could lead to a legal situation that would result in substantial harm to central values in areas besides research, such as health care, the job market, basic freedom of movement, and strategic international finance and politics. Thus, it seems that restrictive extraterritorial jurisdiction in respect to ES cell research would be deeply problematic, given that the ethical permissibility of ES cell research is characterised by deep and wide disagreement.

    • The Water Framework Directive (WFD) is an ambitious piece of legislation designed to protect and improve water quality throughout Europe. However, forests are only mentioned once in the WFD, and forestry is not mentioned at all, despite its potential implications for streams, rivers and lakes. Here we present a transdisciplinary commentary on the WFD and its implications for forests and forestry in Sweden. This commentary has been prepared by forestry stakeholders, biophysical and social scientists. While we were cognizant of a large body of discipline-specific research, there are very few inter-or trans-disciplinary commentaries which link academic and stakeholder perspectives on the WFD. We had originally felt that there would be little commonality in our concerns. However, we found significant areas of agreement. Our key areas of concern about the implications of the WFD for forestry in Sweden included: (i) concerns about what is meant by good ecological status and how it is assessed; (ii) a perceived lack of clarity in the legal framework; (iii) an inadequate environmental impact assessment process; and (iv) uncertainties about appropriate programs of measures for improving water quality. We were also concerned that ecosystem services provided by forests and the positive effects of forestry on water quality are inadequately recognized in the WFD.

  • Prohibiting Purchase of Sex in Sweden : Impact, Obstacles, Potential, and Supporting Escape

    • This paper analyzes the core reasons for the Swedish law from 1999 which criminalizes purchase of sex and decriminalizes the prostituted person, passed as part of an omnibus bill against violence against women and recognizing prostitution as a form of it. Further, it documents the law’s impact by comparing data from several recent Swedish studies with the situation in other relevant countries, concluding the law has significantly reduced the occurrence of prostitution manifolds compared to its neighboring countries. Crucial obstacles to effective implementation are also addressed, particularly in current case law. Some of the critique against the law and disinformation about the law’s effects are also commented. Finally, to realize its full potential to support escape from prostitution more efficiently, it is argued that the civil rights of prostituted persons under current law should be strengthened to get damages paid for directly by the tricks/johns for the harm they have contributed to. An additional consideration is for individual states to extend the use of the Palermo Protocol (international law acknowledging connections between prostitution and sex trafficking) to charge tricks for trafficking when they “receive” persons who are effectively pimped.

    • In Sweden, extractive industries are placing increasing pressure on the traditional indigenous Sami livelihood of reindeer herding. Consequently, the intersection of indigenous rights and mining-related development in Sweden has become an increasingly contested socio-legal space. In this article, we analyse the extent to which there are meaningful opportunities for Sami reindeer herding communities in Sweden to effectively influence the permit procedures concerning proposed mines, in order to protect their rights and interests. We provide a comprehensive socio-legal analysis that highlights the weak level of recognition of Sami rights and related impact assessments within the mining permitting system in Sweden. We demonstrate the weakness is caused by several factors: an a priori assumption by Swedish authorities that reindeer herding and mining can generally co-exist; the lack of a codified Swedish State duty to consult the Sami; the narrow scope and the weak status of cumulative impact assessments in Swedish EIA legislation and practice; and the weak recognition of Sami reindeer herding as a “property right” during the permit review process under the balancing of competing land-uses. Our results highlight the urgent need for legislative reform in Sweden, if the State is to fulfil its international obligations and improve its legal consistency concerning the rights of the Sami as an indigenous people.

    • Ensuring just distribution of and adequate funding for children whose parents do not live together is a global legal challenge. It affects many families as well as every legal jurisdiction’s welfare state and family law.This comparative study describes child support legal solutions in two jurisdictions, California (a liberal welfare state) and Sweden (a social democratic one). Analyzed are the similarities and differences in these states’ legal responses to the inequalities child support law functions to alleviate, and the implications for child support theory and practice in these and other jurisdictions.Micro-comparative chapters demonstrate how the jurisdictions’ regulations differ by analyzing children’s rights and needs and parents’ duties and abilities to pay, each as defined in the child support law. Also compared are procedural laws enforcing child support rights and duties in private and public law cases.Macro-comparative chapters draw a comparative portrait of two welfare state ideological and family law child support approaches, both aiming to reduce inequalities, in terms of how their child support laws and welfare states have defined and addressed the best interests of children and society at large.Most of the differences in the laws and their interpretations are found to reflect the welfare state ideals of the two societies including their ideal models of the family and of individuals’ relationships to the state. Ideals for judicial and negotiated family law conflict resolution also play a significant role.Analyses of the differences include comparison of the jurisdictions’ (1) histories, (2) legal principles and traditions, (3) gender equality ideals and realities and (4) income equality ideals and realities, all as related to legal child support rights and duties.The study provides a better understanding of some of the weaknesses within these regulations, and also of the child support system design choices they represent. Weaknesses in child support laws arise not just from confusions over how to prioritize conflicting interests directly regulated by the legal rules, but also how to prioritize those interests given conflicting ideals of the state and the family, both between and within these societies. Despite the different ideals influencing both systems’ solutions, elements of each jurisdiction’s experience have potential to inform the other’s further development.
