  • Prohibiting Sex Purchasing and Ending Trafficking : The Swedish Prostitution Law

    • The Swedish prostitution law from 1999, now followed by Norway and Iceland, criminalized the purchaser and decriminalized the prostituted person. This is analyzed as a cogent state response under international trafficking law, particularly to the obligations set forth in the United Nation’s Trafficking Protocol from 2000. The Protocol states that a person is regarded a trafficking victim when, e.g., someone abuses her “position of vulnerability” in order to exploit her. International jurisprudence and social evidence strongly suggest that prostitution, as practiced in the world, usually satisfies this definition. Further, the Protocol urges states to reduce the demand for prostitution and to protect and assist victims, for instance by adopting laws deterring purchasers of sex, and by supporting those exploited in prostitution. Policy makers, such as the U.S. Department of State, are criticized for taking an inadequate position in face of the growing evidence from the Swedish law's impact.The article shows that Sweden has significantly reduced the occurrence of trafficking in Sweden compared to neighboring countries. It also scrutinizes some misinformation of the law's impact, showing for instance that claims alleging a more dangerous situation for those still in prostitution after 1999 were unfounded. In addition, the article addresses remaining obstacles to the law's effective implementation, arguing that in order to realize the law's full potential to support escape from trafficking, the civil rights of prostituted persons under current law should be strengthened to enable them to claim damages directly from the purchasers for the harm to which they have contributed, and for the violation of the prostituted persons' equality and dignity - a position now recognized by the government to some extent by clarifying amendments made in 2011.

  • A Multidisciplinary Approach to Capability in Age and Ageing

    • This open access book provides insight on how to interpret capability in ageing – one’s individual ability to perform actions in order to reach goals one has reason to value – from a multidisciplinary approach. With for the first time in history there being more people in the world aged 60 years and over than there are children below the age of 5, the book describes this demographic trends as well as the large global challenges and important societal implications this will have such as a worldwide increase in the number of persons affected with dementia, and in the ratio of retired persons to those still in the labor market. Through contributions from many different research areas, it discussed how capability depends on interactions between the individual (e.g. health, genetics, personality, intellectual capacity), environment (e.g. family, friends, home, work place), and society (e.g. political decisions, ageism, historical period). The final chapter by the editors summarizes the differences and similarities in these contributions. As such this book provides an interesting read for students, teachers and researchers at different levels and from different fields interested in capability and multidisciplinary research.

    • Countries worldwide have very different national regulations on human embryonic stem (ES) cell research, informed by a range of ethical values. Some countries find reason to extend the applicability of their regulations on such research to its citizens when they visit other countries. Extraterritorial jurisdiction has recently been identified as a potential challenge towards global regulation of ES cell research. This chapter explores the implications and impact of extraterritorial jurisdiction and global regulation of ES cell research on researchers, clinicians and national health systems, and how this may affect patients. The authors argue that it would make ethical sense for ES cell restrictive countries to extend its regulations on ES cell research beyond its borders, because, if these countries really consider embryo destruction to be objectionable on the basis on the status of the embryo, then they ought to count it morally on par with murder (and thus have a moral imperative to protect embryos from the actions of its own citizens). However, doing so could lead to a legal situation that would result in substantial harm to central values in areas besides research, such as health care, the job market, basic freedom of movement, and strategic international finance and politics. Thus, it seems that restrictive extraterritorial jurisdiction in respect to ES cell research would be deeply problematic, given that the ethical permissibility of ES cell research is characterised by deep and wide disagreement.

    • Species have intrinsic value but also partake in a long range of ecosystem services of major economic value to humans. These values have proved hard to quantify precisely, making it all too easy to dismiss them altogether. We outline the concept of the species stock market (SSM), a system to provide a unified basis for valuation of all living species. The SSM amalgamates digitized information from natural history collections, occurrence data, and molecular sequence databases to quantify our knowledge of each species from scientific, societal, and economic points of view. The conceptual trading system will necessarily be very unlike that of the regular stock market, but the looming biodiversity crisis implores us to finally put an open and transparent price tag on symbiosis, deforestation, and pollution

    • One of the less known problems in settlement geography is the issue of so-called degraded and restituted towns. This lack of reconnaissance, however, is perhaps less the result of the towns’ scarcity than their specificity of being ‘awarded’ or ‘deprived of’ an urban label by means of strictly socio-political actions. Degraded and restituted towns, hence, are spatial units made ‘urban’ or ‘rural’ instantaneously, irrespective of their de facto state along what is widely considered a gradual path of (de)urbanization. Instead, they become compartmentalized into two constructed spatial categories that have survived the onslaught of material transformations and philosophical repositioning through different whims of time. While ‘rural’ and ‘urban’ are conceptual binaries that certainly need to be treated with caution, their cultural salience may cause tangible consequences within national administrative systems that abide by a formalized rural-urban distinction. This issue becomes particularly important for settlements that clearly transcend any imagined rural-urban divide, i.e. those, whose material and immaterial characteristics seem counterfactual to their assigned category. It is also crucial in formal practices designed to avert such counterfactualities, but whose ran-domness of approach more creates confusion than helps straighten out a historical concoction. Both processes, nonetheless, lend ‘urbanity’ and ‘rurality’ a resonance of objectivity, justifying their use as guides for a host of developmental endeavors, despite subverting a much more intricate reality. Degraded and restituted towns are direct derivatives of this. Drawing on the above-mentioned irreconcilabilities, the aim of this book is to present and scrutinize degraded and restituted towns through the example of Poland, where these towns occupy a special niche. For one, Poland, due to its chequered and variegated history, is home to a conspicuously large number of degraded (831) and restituted (236) towns; for another, Poland’s relentlessness of formalizing ‘urbanity’ as a category of statistical, political and cultural guidance has a direct bearing on the lives of the towns’ residents. Realizing the intricacy of degraded and restituted towns in the face of commonplace ru-ral-urban ideations, the editors and the 17 contributing Authors of this book have made an effort to capture the towns’ complexity with special foci on their shrouded origins, developmental specificity and incurred problems. Owing to the involvement of researchers from different scientific disciplines and subdisciplines, the undertaken project has helped elucidate the problem from multiple perspectives: spatial, social, demographic, economic, environmental, historical, architectural, cultural, legal and philosophical. Allocated into 17 chapters, not only have the presented interpretations allowed for a first interdisciplinary synthesis on the topic, but they also helped outline some prospective directions for future research. Moreover, collecting materials of such diversity into an amalgamated whole has helped identify specific discourses that enwrap the concept of “urbanity” when seen through its oscillations within formal contexts, and to which degraded and restituted towns serve as expendable game pieces. By combining knowledge arrived at through ontologically and epistemologically different approaches, the incremental contribution of this book as a whole could be summarized in two attainments: a) extending theoretical frameworks used to study degraded and restituted towns in terms of definition, conceptualization and assessing predispositions for future de-velopment on account of their spatial, legal, socio-economic and historical charac-teristics; b) initiating an anticipated discussion on a number of important and current topics re-lated to the practices of degradation and restitution that have not received adequate attention, e.g., the urbanity-vs.-rurality paradox, the changeability of human settlement forms vs. the consequences of rigid spatial categorizations; the role of various actors in shaping the socio-economic reality under the guise of an ossified binary; or identifying spatio-conceptual conflicts as future challenges for local, regional and national policy.

    • The United Nations identifies the food crisis as one of the primary overarching challenges facing the international community. Different stakeholders in the food system have widely different perspectives and interests, and challenging structural issues, such as the power differentials among them, remain largely unexamined. These challenges make rational discourse among food system actors from different disciplines, sectors and levels difficult. These challenges can often prevent them from working together effectively to find innovative ways to respond to food security challenges. This means that finding solutions to intractable and stuck issues, such as the food crisis often stall, not at implementation, but at the point of problem identification. Food system sustainability means very different things to different food system actors. These differences in no way undermine or discount the work carried out by these players. However, making these differences explicit is an essential activity that would serve to deepen theoretical and normative project outcomes. Would the impact and reach of different food projects differ if these differences were made explicit? The purpose of this initial part of a wider food system research project is not to search for difference or divergence, with the aim of critique, but rather to argue that by making these differences explicit, the overall food system project engagement will be made more robust, more inclusive and more encompassing. This paper starts with some discussion on the different food system perspectives, across scales, regions and sectors but focuses primarily on the design of processes used to understand these divergent and at times contradictory views of what a sustainable food system may be. This paper draws on ongoing work within the Mistra Urban Futures project, using the food system projects in cities as diverse as Cape Town, Manchester, Gothenburg and Kisumu as sites for this enquiry.

Samverkande ämnesdiscipliner är folkhälsovetenskap, juridik, lärarutbildningen och socialt arbete. Forskarsamarbetet har under denna relativt korta tid utmynnat i en antologi.Syftet med denna antologi är bland annat att uppmärksamma och bidra med kunskapsstöd om det nya examensmålet i högskoleförordningen gällande mäns våld mot kvinnor i nära relationer. Fokus är att ge en övergripande bild av hedersrelaterat våld och förtryck, samt att bidra med kunskaper om våldets uttryckssätt och dess konsekvenser. Antologin utgår från de drabbades perspektiv.I boken ges handfasta råd till de universitetslärare som ansvarar för undervisning och examination rörande mäns våld mot kvinnor i nära relationer i högre professionsutbildning. Exempelvis lärare, jurister, sjuksköterskor, psykologer, tandhygienister och socionomer. Boken vänder sig till studenter i högre utbildning. Boken vänder sig också till yrkesverksamma som möter utsatta för hedersrelaterat våld och förtryck.     • In 2020, for the first time in history, there were more people in the world aged 60 years and over than there were children below the age of 5 years. The population aged over 65 years is projected to increase from one billion in 2019 to more than two billion in 2050, and those aged over 80 years are projected to increase from 143 to 426 million, with the largest increase occurring in the developing world (UN World Population Prospects, 2019). This demographic trend constitutes the largest global health challenge, according to the World Health Organisation (WHO). The European Union has set it as one of the major challenges in Horizon 2020 and it has important societal implications (European Commission, 2020). The proportion of retired individuals will increase, leading to an increased ratio between those who have exited the workforce and those still active in the labour market. Thus, ageing represents a global societal and scientific challenge requiring integrated efforts, multidisciplinary translational research approaches and social innovations that build on ideas of potentials and capabilities, emphasising the value of old age.

    • The notion of the best interest of children figures prominently in family and reproductive policy discussions and there is a considerable body of empirical research attempting to connect the interests of children to how families and society interact. Most of this research regards the effects of societal responses to perceived problems in families, thus underlying policy on interventions such as adoption, foster care and temporary assumption of custodianship, but also support structures that help families cope with various challenges. However, reference to the best interest of children can also be applied to a more basic issue in family policy, namely that of what is to be considered a family in the first place. This issue does not raise any questions regarding the proper conditions for when society should intervene in or change the family context of a child. Rather, it is about what social configurations should be recognized as a potentially fitting context for children to enter into and (if all goes well) eventually develop into adulthood within /.../ such that society’s default institutional arrangements allow it to have (by sexual and artificial reproduction, adoption, and combinations of these), care for and/or guard children. [This] will frame any further discussion of /.../ policies having further implications for, for example, the practices of adoption and reproductive technology, as well as regulation of custody in the event of separation or parental disagreement.

    • The purpose of this work is to detect a pattern: the concordance of Ethics and Aesthetics, Poetics and Politics in the most influential American thinker of the nineteenth century. It is an attempt to trace a basic concept of the Emersonian transcendentalist doctrine, its development, its philosophical meaning and practical implications. Emerson’s thought is analyzed genetically in search of the generating paradigm, or the set of axioms from which his aesthetic ideas as well as his political reasoning are derived. Such a basic structure, or point of convergence, is sought in the emergence of Emerson’s idea of universal laws that repeat themselves on all levels of reality.A general introduction is given in Part One, where the crisis in Emerson’s life is seen as representing and foreshadowing the deeper existential crisis of modern man.In Part 2 we follow the increasingly skeptical theologian’s turn to science, where he tries to secure a safe secular foundation for ethical good and right and to solve the problem of evil.Part 3 shows how Emerson’s conception of the laws of nature and ethics is applied in his political philosophy.In Part 4, Emerson’s ideas of the arts are seen as corresponding to his views of nature, morality, and individuality.Finally, in Part 5, the ancient and classical nature of Concord philosophy is brought into focus.The book concludes with a short summary.

    • While recent progress has been made in several fields of data-intense AI-research, many applications have been shown to be prone to unintendedly reproduce social biases, sexism and stereotyping, including but not exclusive to gender. As more of these design-based, algorithmic or machine learning methodologies, here called adaptive technologies, become embedded in robotics, we see a need for a developed understanding of what role social norms play in social robotics, particularly with regards to fairness. To this end, we i) we propose a framework for a socio-legal robotics, primarily drawn from Sociology of Law and Gender Studies. This is then ii) related to already established notions of acceptability and personalisation in social robotics, here with a particular focus on iii) the interplay between adaptive technologies and social norms. In theorising this interplay for social robotics, we look not only to current statuses of social robots, but draw from identified AI-methods that can be seen to influence robotics in the near future. This theoretical framework, we argue, can help us point to concerns of relevance for questions of fairness in human-robot interaction.

    • The vision of legendary criminologist Cesare Lombroso to use scientific theories of individual causes of crime as a basis for screening and prevention programmes targeting individuals at risk for future criminal behaviour has resurfaced, following advances in genetics, neuroscience and psychiatric epidemiology. This article analyses this idea and maps its ethical implications from a public health ethical standpoint. Twenty-seven variants of the new Lombrosian vision of forensic screening and prevention are distinguished, and some scientific and technical limitations are noted. Some lures, biases and structural factors, making the application of the Lombrosian idea likely in spite of weak evidence are pointed out and noted as a specific type of ethical aspect. Many classic and complex ethical challenges for health screening programmes are shown to apply to the identified variants and the choice between them, albeit with peculiar and often provoking variations. These variations are shown to actualize an underlying theoretical conundrum in need of further study, pertaining to the relationship between public health ethics and the ethics and values of criminal law policy.

    • In this paper we investigate the possibility of socially assistive robots (SARs) supporting diagnostic screening for peripartum depression (PPD) within the next five years. Through a HRI/socio-legal collaboration, we explore the gender norms within PPD in Sweden, to inform a gender-sensitive approach to designing SARs in such a setting, as well as governance implications. This is achieved through conducting expert interviews and qualitatively analysing the data. Based on the results, we conclude that a gender-sensitive approach is a necessity in relation to the design and governance of SARs for PPD screening.

    • Insolvency law is the rooth of commercial and financial law because it obliges the legislator to chose. There is not enough money to go round so the law must chose who to pay. The law must always decide who is to bear the risk so there is always a winner and a loser. The insolvency law has been at the policy agenda in many countries in the last years. In France, Germany, Italy, Japan and other countries have the legal frameworks changed from liquidation procedures to reorganization business. The legal situation in Sweden has also changed from compositions to reorganization business, lagen om företagsrekonstruktion. The key issues are to encourage the formal proceeding by enlarging the debtors control of the business and by inroads creditors rights, in which case the proceeding is pro-debtor.This dissertation compares Swedish and American Bankruptcy Codes with respect to similarities and differences at macro- and micro perspectives. Chapter 11 Reorganization Business in America provides a corporate rehabilitation model, which has been used in other countries. The dissertation also compares the use of the concepts of - the purpose, - the function and - the direction of Swedish and American Bankruptcy Laws in order to establish whether the law is pro-debtor or pro-creditor. The key indicators of whether the rescue proceeding is pro-debtor or pro-creditor include; - How easy it is to enter the rescue proceeding. Debtor's incentives to commence proceeding, freeze on executions and liquidation petitions, impact on security, impact on title of finance, impact on set-off and netting, impact on contract rescissions and lease forfeitures. Disclaimer and abandonment, ability to replace the management, financing of the rescue, scope of the rehabilitation plan. It is argued that the optimal bankruptcy law can be achieved if the law purpose, the function and the law direction relate to each other in Sweden, in both reorganization business and in the liquidation code and it also compared with the American Bankruptcy Code. According to my opinion this is important both in a national and international context.The dissertation also deals with debtor's contract in an insolvency situation in reorganization business and in liquidation. Swedish Laws are compared to the American Bankruptcy Code and point out similarities and differences. In the American Bankruptcy Code there is a special section 365 § BC dealing with executory contract, this section is nearly the same for both the reorganization- and liquidationproceedings. The contracts must be unperformed which means the obligation of both the bankrupt and the other party in the contract are so far unperformed that the failure of either to complete performance would constitute a material breach excusing the performance of the other. If the contract is unperformed the debtor has the possibility to chose if the contracts shall be assumed, assumed and assigned or rejected. Section 365 § BC requires the court to consider whether assumption of the contract in question will further be needed in either rehabilitation or liquidation of the bankruptcy estate. The court reviews the financial impact of the estate and if it is benefiting becoming administratively obligated to perform. The court also review if is best to breach the contract. In Sweden we have different sections which regulate the situation. One section in our reorganization law, lagen om företagsrekonstruktion, we also have two special sections in the law of Sale of Goods, which deals with contract when a debtor became insolvent or file for reorganization business. But we don't have any section in our liquidation law, konkurslagstiftningen, which in my opinion is very strange. We also have a problem with the legislation about swaps and netting which are regulated in a special law, lagen om handel med finansiella intrument. Particular attention is given to the advantages and disadvantages of the existing rules in Swedish legal system compared with 365 § in American Bankruptcy Code. From a national point of view such section should preferably include all types of contract in only one section which is nearly the same as the American model of section 365 §.

    • Intensifying global trade will result in increased numbers of plant pest and pathogen species inadvertently being transported along with cargo. This paper examines current mechanisms for prevention and management of potential introductions of forest insect pests and pathogens in the European Union (EU). Current European legislation has not been found sufficient in preventing invasion, establishment and spread of pest and pathogen species within the EU. Costs associated with future invasions are difficult to estimate but past invasions have led to negative economic impacts in the invaded country. The challenge is combining free trade and free movement of products (within the EU) with protection against invasive pests and pathogens. Public awareness may mobilise the public for prevention and detection of potential invasions and, simultaneously, increase support for eradication and control measures. We recommend focus on commodities in addition to pathways, an approach within the EU using a centralised response unit and, critically, to engage the general public in the battle against establishment and spread of these harmful pests and pathogens.

    • Agricultural biotechnology, in particular genetically modified organisms (GMOs), is subject to regulation in many areas of the world, not least in the European Union (EU). A number of authors have argued that those regulatory processes are unfair, costly, and slow and that regulation therefore should move in the direction of increased ‘technology neutrality’. The issue is becoming more pressing, especially since new biotechnologies such as CRISPR increasingly blur the regulatory distinction between GMOs and non-GMOs. This paper offers a definition of technology neutrality, uses the EU GMO regulation as a starting point for exploring technology neutrality, and presents distinctions between variants of the call for technology neutral GMO regulation in the EU.

    • This chapter provides family law experts worldwide with a glimpse into and an update on the latest changes in European family law, specifically to conflict of law rules for resolving European Union (EU) cross-border family law cases and most notably those regarding responsibility for children, marital dissolution and distribution of assets after death. Examined are EU-level legal developments affecting cross-border family relationships within the 27 nations of the European Union that have been introduced primarily through significant new EU legislation and by recent case decisions by the Court of Justice of the European Union (CJEU). The changes' impacts at the national-law level on substantive and procedural family law and on national and personal (party) autonomy are illustrated using reports on the experiences across the EU. The experience of my own Member State, Sweden, is described as an example of how EU-level, increasingly harmonised family law ('international private law' primarily) is being negotiated and implemented both between and within EU Member States. This research aims to overview ongoing (and indeed ever-present) tensions between autonomy and uniformity interests within the EU, contributing to the significant existing literature on the present state of and future possibilities for 'European family law' while also introducing non-EU scholars to this growing, rather complex legal area. As the chapter's final sections describe, a steadily-increasing Europeanisation of family law is observed, co-existing with the tensions, which is reducing legal difficulties for individuals and state actors in Sweden and throughout the EU within a broader context of ongoing legal, economic and cultural globalisation. Family law, no longer taking a back seat to other EU legal areas, is today playing a remarkably prominent role.

    • Since a couple of decades, the notion of a precautionary principle plays a central and increasingly influential role in international as well as national policy and regulation regarding the environment and the use of technology. Urging society to take action in the face of potential risks of human activities in these areas, the recent focus on climate change has further sharpened the importance of this idea. However, the idea of a precautionary principle has also been problematised and criticised by scientists, scholars and policy activists, and been accused of almost every intellectual sin imaginable: unclarity, impracticality, arbitrariness and moral as well as political unsoundness. In that light, the very idea of precaution as an ideal for policy making rather comes out as a dead end. On the basis of these contrasting starting points, Christian Munthe undertakes an innovative, in-depth philosophical analysis of what the idea of a precautionary principle is and should be about. A novel theory of the ethics of imposing risks is developed and used as a foundation for defending the idea of precaution in environmental and technological policy making against its critics, while at the same time avoiding a number of identified flaws. The theory is shown to have far-reaching consequences for areas such as bio-, information- and nuclear technology, and global environmental policy in areas such as climate change. The author argues that, while the price we pay for precaution must not be too high, we have to be prepared to pay it in order to act ethically defensible. A number of practical suggestions for precautionary regulation and policy making are made on the basis of this, and some challenges to basic ethical theory as well as consumerist societies, the global political order and liberal democracy are identified

Förordningen syftar till att upprätthålla eller nå en god miljöstatus i havsmiljön. Enligt HMF ska Havs- och vattenmyndigheten se till att det görs en inledande bedömningen av havsmiljön i de svenska delarna av de två förvaltningsområdena Nordsjön och Östersjön (13 § - 16 §). Den inledande bedömningen, som ska vara avslutad den 15 juli 2012 och rapporteras till Europeiska kommissionen senast den 15 oktober samma år, ska ligga till grund för fastställande av god miljöstatus, miljömål och miljöövervakningsprogram samt utarbetande av åtgärdsprogram för att nå uppsatta mål. I den inledande bedömningen ingår att utföra en ekonomisk och social analys, den förra kan delas in i två delar där den första syftar till att analysera nyttjandet av havsområdet och den andra delen att beskriva kostnaderna av att miljön i havsområdena försämras (HMF, 13 §, p.4 samt Havsmiljödirektivet, Artikel 8.1c). Det primära syftet med den sociala analysen i den inledande bedömningen är att skapa en bild av förutsättningarna för det kommande arbetet med att uppnå direktivets syften, dvs. god miljöstatus (GES, artikel 9). Analysen ska också tjäna som underlag vid utformningen av miljömål (artikel 10) som sedermera kommer att ligga till grund för åtgärdsprogram och styrmedel (artikel 13). Bedömningen inbegriper en analys av hur olika grupper i samhället kan beröras av havets nyttjande, havsrelaterade miljöproblem och deras åtgärdande. I denna studie lanseras en metod att genomföra en sådan analys. Metoden inbegriper en tankemodell som består av komponenterna Indirekta drivkrafter, Direkta drivkrafter, Påverkan/tillstånd/effekt i miljön, Effekt i samhället och Respons med. Modellen används tillsammans med en frågemall för att kartlägga aktörer och drivkrafter. Fallstudier avseende tre miljöproblem - selektivt överfiske av torsk samt oönskad spridning av kvicksilver och fosfor - visar att ett stort antal aktörer är inblandade såväl indirekt som direkt. Dessutom verkar aktörerna på olika nivåer: lokalt/regionalt, nationellt och internationellt. Varje miljöproblem behöver sin egen analys och har egna förutsättningar.     • The Marine Environmental Ordinance (SFS 2010:1341) is part of a strategy to bring about ecosystem-based management and sustainable use of the marine environment in accordance with the EU’s the Marine Strategy Framework Directive (MSFD, 2008/56/EC). The ordinance is intended to maintain or achieve good environmental status in the marine environment. Under the Marine Environmental Ordinance, the Swedish Agency for Marine and Water Management (SwAM) must ensure that an initial assessment is carried out on the marine environment in the Swedish waters of the two regions, the North Sea and the Baltic Sea (Articles 13–16). The initial assessment, which is to be completed by 15 July 2012 and reported to the European Commission not later than 15 October of the same year, is to provide a basis for the establishment of good environmental status, environmental targets and environmental monitoring programmes, as well as the preparing of programmes of measures by which established targets may be achieved. The initial assessment will include conducting an economic and social analysis. The former can be divided into two parts, the first of which is designed to analyse the use of the marine region and the second to describe the cost of the degradation of the marine environment (Marine Environmental Ordinance, Article 13, para. 4, and the Marine Strategy Framework Directive, Article 8.1c). The primary purpose of the social analysis in the initial assessment is to create a picture of the underlying conditions of the upcoming work to achieve the aims of the directive, that is, good environmental status (GES, Article 9). The analysis is also intended to provide basic information for the establishment of environmental targets (Article 10) that will subsequently form the foundation of programmes of measures and administrative funding (Article 13). The assessment includes an analysis of how different groups in society can be affected by how the sea is used and by marine environmental problems and measures taken to address them. This study presents a method by which such an analysis can be conducted. The method includes a conceptual model that consists of the components 'Indirect driving forces, 'Direct driving forces , 'Environmental pressures, state and impact', 'Impact on society', and 'Response'. The model is used in combination with a question template to analyse actors, activities and driving forces. Case studies involving three environmental problems – selective overfishing of cod and the unwanted dispersion of mercury and phosphorous – show that a large number of actors are involved, directly and indirectly. In addition, these actors operate on several levels –local/regional, national and international. Every environmental problem requires its own analysis and has its own set of conditions. The study shows that the information needed for making decisions regarding the measures that should be taken is relatively extensive. The determination of the amount of information necessary and therefore how much should be systematically collected in future can have a great impact on the development of society and the environment. Finally, suggestions are given as to how future social analyses relating to the marine environment might be carried out.

    • The sculpture EP9 Starlight Reserves was installed in Amerikadammen in Göteborgs Botaniska Trädgård and part of GIBCA Extended 2023. This work is situated in the expanded field of sculpture, where the negotiation with a specific situation plays a central role in material investigations of environmental and sustainability concerns. The shape and title of the sculpture derive from the container of old batteries, "Exposed Pallet 9," which the International Space Station launched into space in 2021 to circulate around the Earth for 2-4 years before entering the Earth's atmosphere and hopefully burn up. [1] Commercial interests, colonization, and tourism led by rich nations and private companies contribute to the increase of space debris. The main inquiry of this research project is how artistic work, through visualization in sculptural form, can draw attention to scientific observations and advocacy in establishing international environmental space law concerning space debris. By using recycled plastic from electronic scrap for the large-scale IRBAM printing of the sculpture, the work highlights the potential for sustainable and ephemeral materials in sculptural production to promote environmental awareness and question the validity of the standard requirement for "permanence" in public sculpture. 3D printing in collaboration with Samuel Johansson and Woodrow Wiest RISE – AM center in Mölndal, Sweden with in-kind funding.     • In Sweden, extractive industries are placing increasing pressure on the traditional indigenous Sami livelihood of reindeer herding. Consequently, the intersection of indigenous rights and mining-related development in Sweden has become an increasingly contested socio-legal space. In this article, we analyse the extent to which there are meaningful opportunities for Sami reindeer herding communities in Sweden to effectively influence the permit procedures concerning proposed mines, in order to protect their rights and interests. We provide a comprehensive socio-legal analysis that highlights the weak level of recognition of Sami rights and related impact assessments within the mining permitting system in Sweden. We demonstrate the weakness is caused by several factors: an a priori assumption by Swedish authorities that reindeer herding and mining can generally co-exist; the lack of a codified Swedish State duty to consult the Sami; the narrow scope and the weak status of cumulative impact assessments in Swedish EIA legislation and practice; and the weak recognition of Sami reindeer herding as a “property right” during the permit review process under the balancing of competing land-uses. Our results highlight the urgent need for legislative reform in Sweden, if the State is to fulfil its international obligations and improve its legal consistency concerning the rights of the Sami as an indigenous people.

    • Extant literature points to how the risk of discrimination is intrinsic to AI systems owing to the dependence on training data and the difficulty of post hoc algorithmic auditing. Transparency and auditability limitations are problematic both for companies' prevention efforts and for government oversight, both in terms of how artificial intelligence (AI) systems function and how large-scale digital platforms support recruitment processes. This article explores the risks and users' understandings of discrimination when using AI and automated decision-making (ADM) in worker recruitment. We rely on data in the form of 110 completed questionnaires with representatives from 10 of the 50 largest recruitment agencies in Sweden and representatives from 100 Swedish companies with more than 100 employees ("major employers"). In this study, we made use of an open definition of AI to accommodate differences in knowledge and opinion around how AI and ADM are understood by the respondents. The study shows a significant difference between direct and indirect AI and ADM use, which has implications for recruiters' awareness of the potential for bias or discrimination in recruitment. All of those surveyed made use of large digital platforms like Facebook and LinkedIn for their recruitment, leading to concerns around transparency and accountability-not least because most respondents did not explicitly consider this to be AI or ADM use. We discuss the implications of direct and indirect use in recruitment in Sweden, primarily in terms of transparency and the allocation of accountability for bias and discrimination during recruitment processes.

    • As in other areas of social engineering, Sweden is considered as world-leading in creating systems that address social inequality. One of the cases in point is the Swedish day-fine system which has been considered as pioneering by systematically considering both the wealth of the offender and the seriousness of the offence when imposing the penalty. This chapter analyses in detail the Swedish day-fine system. The case study of Sweden sheds light on the pros and cons of day-fines by recalling the discussion in Sweden prior to introducing the system and the recent academic debates on extending the use of day-fines. The chapter also offers an account of the comprehensive prosecutorial guidelines as well as an analysis of the relevant case law, particularly in relation to adjustment of day-fines. The chapter argues that the Swedish day-fine system overall must be considered as a largely successful project which holds high esteem among courts and practitioners. The common view is that it is a merit of the system that it forces the courts to consider the economic circumstances of the accused and to articulate openly for the way in which such consideration has been done.

    • Ocean temperatures are rising; species are shifting poleward, and pH is falling (ocean acidification, OA). We summarise current understanding of OA in the brackish Baltic-Skagerrak System, focussing on the direct, indirect and interactive effects of OA with other anthropogenic drivers on marine biogeochemistry, organisms and ecosystems. Substantial recent advances reveal a pattern of stronger responses (positive or negative) of species than ecosystems, more positive responses at lower trophic levels and strong indirect interactions in food-webs. Common emergent themes were as follows: OA drives planktonic systems toward the microbial loop, reducing energy transfer to zooplankton and fish; and nutrient/food availability ameliorates negative impacts of OA. We identify several key areas for further research, notably the need for OA-relevant biogeochemical and ecosystem models, and understanding the ecological and evolutionary capacity of Baltic-Skagerrak ecosystems to respond to OA and other anthropogenic drivers.
