    • The Nordic countries have had a close co-operation with joint legislation in many fields since the beginning of the 20th century. Above all, it has resulted in a common contract law. For the benefit of non-Nordic lawyers and future Nordic cooperation a Restatement of Nordic Contract Law was published in 2016.

    • Swedish as well as Danish, Norwegian and Finnish law had between 1936 and 1976 an Article 8 in their joint Promissory Notes (Debt Instruments) Act providing that obviously unconscionable terms could be modified. This article was in some cases, but very restrictively, applied by analogy. Courts had however other means to take reasonableness into regard. This contribution discusses these other means and the application of article 36 of the Contracts Act in force since 1976.

    • The fourth Ole Lando Memorial Lecture is mainly about the interaction between soft law and precedents. The paper argues that precedents are an increasingly important source of law in civil law jurisdictions with examples from Brazil, China, France and Sweden. The paper provides an overview of some problems and benefits of precedents within the area of private law, inter alia judges as lawmakers compared to developments through statutory law and how to identify a legal rule from a precedent. I do not master German or French sufficiently well to be able to submit abstracts in these languages.
