- The last few years have seen major reforms to the delegation of powers and post-delegation supervision of the European Commission. In light of these reforms, Rulemaking by the European Commission: The New System for Delegation of Powers assesses whether the new system has really affected the old doctrine of delegation of powers, and if so, how? Specific questions answered include: have the objectives of the reform been achieved and what were these objectives? How does the new system affect the division of functions between the institutions of the EU and the institutional balance? Has this new system affected the relationship between the EU and its Member States, and if so, how does it concern its citizens? Presented by an interdisciplinary group of experts who have actively followed or participated in the process of reform, the book is structured in four parts: (1) the political and historical context in which the rule-making takes place, (2) the operation and functioning of the system before and after the reform, (3) the legal substance of a new framework for rule-making and the emerging case law from the Court of Justice of the EU, and (4) the procedural dimension, including the legal preconditions for non-institutional actors to participate.

- Den svenska offentlighetsprincipen består av ett antal grundlagsstadgade fri- och rättigheter och det tycks råda en stor enighet om att den utgör ett särpräglat inslag i den svenska identiteten och demokratin. Syftet med principen är att främja en fri och demokratisk åsiktsbildning genom att stödja ett fritt meningsutbyte och en allsidig upplysning av allmänheten. Tillgång till allmänna handlingar, tryck- och yttrandefrihet samt meddelarfrihet utgör alla väsentliga delar av offentlighetsprincipen. Vid EU-inträdet 1995 fanns farhågor att sekretessen skulle komma att öka i och med att beslutanderätt flyttades över till EU. Med facit i hand – vad har hänt? I den här rapporten till ESO granskar Carl Fredrik Bergström och Mikael Ruotsi hur den svenska offentlighetsprincipen påverkats sedan Sverige blev medlem i EU och hur öppenheten i EU utvecklats under samma tid. En slutsats är att det oftare är svenska sekretessregler än sekretessregler från EU som begränsar offentlighetsprincipen. Flera av de svenska sekretessreglerna är visserligen påverkade av EU:s syn på sekretess, men de flesta medlemsländer förefaller sedan 1995 ha gått mot större öppenhet med egna regler för medborgarnas rätt till allmänna handlingar. Frågan är hur Sverige bäst kan fortsätta verka för öppenhet i EU – är det genom att betona likhet och framhålla offentlighetsprincipen som en allmän EU-rättslig princip eller är det genom att fortsätta hävda vår nationella särart? Vilka inskränkningar av offentlighetsprincipen är rimliga och vem ska få göra dem? Det är några av de frågor som diskuteras i rapporten.

- This chapter explain the basic notions will be used in the book, how they have emerged and what they mean; ‘primary’ and ‘secondary’ law, ‘legislative’ and ‘non-legislative’ acts, ‘delegated’ and ‘implementing’ acts, ‘delegation of powers’, ‘essential elements’ and ‘implementation’. The tone is neutral, careful not to reduce the complexity or interfere with the qualified assessments of all different authors. Focus is set on the development over time and the institutional context in which that development has taken place. An important ambition is to identify the legal sources which have been central for the development and also the sources which are today fundamental for the new system of delegation of powers. In addition to that statistics are presented on EU regulatory activity, which are central for all chapters of the book. Finally, the aim of the book is formulated and some important delimitations explained.

- The last chapter of the book provides a general conclusion where the striking patterns which can be observed from the authors are set out and the most forceful findings sought to identify. These patterns and findings are sorted within five different themes covering; the contrast between the constitutional expectations on the reform and its result; the seemingly smooth operation of the regulatory machinery; the over-simplified and still unclear implications for the institutional balance of powers; the unsolved and, thus, remaining problems where fundamental difference of opinion has persisted; and, finally, the judicial response. In addition to that the editors provide their answer to the basic question they addressed – If the new system has really affected the old doctrine of delegation of powers – and discuss, briefly, some of all that which remains for further study.
